The New Fabrica, Alan L. Gillen Jul 2000

The New Fabrica, Alan L. Gillen

Faculty Publications and Presentations

Two thousand years after the writing of Psalm 139, Andreas Vesalius (Figure 1) began to unlock the mysteries of the human body. When Vesalius was born in Brussels in 1514, no one could have foreseen that anatomy would be changed forever. During Vesalius’ time, the teachings of the Greek physician Claudius Galen (130-201 A. D.) were the ultimate authority on anatomy. Because Galen had dissected very few (if any) human cadavers, his anatomical descriptions were limited to animal dissections. Galen’s works contained many errors because his conclusions regarding human body functions were based on data obtained from nonhuman animals. Vesalius …

Thawing Out The Cold Record: Some Thoughts On How Videotaped Records May Affect Traditional Standards Of Deference On Direct And Collateral Review, Robert C. Owen, Melissa Mather

The Journal of Appellate Practice and Process

Appellate courts are unable to “smell the smoke of battle” from a trial. For this reason, a trial court’s decision is owed deference when examining an appeal. Video technology makes this reason for deference less relevant.

Inevitability Of The Eclectic: Liberating Adr From Ideology, The, Jeffrey W. Stempel, Kimberlee K. Kovach

Journal of Dispute Resolution

In this essay, I continue to argue against such rigid characterization of the mediation enterprise and in favor of what I term an "eclectic" approach to mediation. The eclectic style is one in which a mediator - while maintaining neutrality and impartiality at all times - attempts to both assist the disputants in finding acceptable solutions on their own and also remains free to provide necessary guidance as to the outcomes that might obtain in the legal regime that will govern their dispute should no agreement result from the mediation. In short, my view of good mediation practice is one …

Employment Discrimination, Peter Reed Corbin, John E. Duvall

Mercer Law Review

The 1999 survey period was another active year for employment discrimination litigation in the Eleventh Circuit and before the United States Supreme Court. In addition to the many cases decided by the Eleventh Circuit, the Supreme Court rendered several key decisions defining the scope of the Americans with Disabilities Act and redefining the concept of sovereign immunity. The Court also set standards for punitive damages awards under Title VII. Each of these decisions are discussed in detail below.

Implicit Memory For Music In Alzheimer's Disease, Andrea R. Halpern, Margaret G. O'Connor Jul 2000

Implicit Memory For Music In Alzheimer's Disease, Andrea R. Halpern, Margaret G. O'Connor

Faculty Journal Articles

Short, unfamiliar melodies were presented to young and older adults and to Alzheimer's disease (AD) patients in an implicit and an explicit memory task. The explicit task was yes–no recognition, and the implicit task was pleasantness ratings, in which memory was shown by higher ratings for old versus new melodies (the mere exposure effect). Young adults showed retention of the melodies in both tasks. Older adults showed little explicit memory but did show the mere exposure effect. The AD patients showed neither. The authors considered and rejected several artifactual reasons for this null effect in the context of the many …

Complexity, Age, And Building Preference, Thomas R. Herzog, Ronda L. Shier Jul 2000

Complexity, Age, And Building Preference, Thomas R. Herzog, Ronda L. Shier

Peer Reviewed Articles

The authors explore the role of complexity in the relation between building age and preference. Age was assessed as a categorical (via stimulus selection) and a continuous (via ratings of 64 color slides of urban buildings) variable. In either case, the authors replicated earlier research in showing that modern buildings were preferred over older buildings when building maintenance was not controlled, but when it was controlled, the relation reversed, and the older buildings were better liked. However, when a composite-rating measure of complexity was introduced, a somewhat different pattern emerged. Complexity interacted with rated age. The nature of the interaction …

Evidence, Marc T. Treadwell Jul 2000

Evidence, Marc T. Treadwell

Mercer Law Review

This survey marks the fourteenth year the author has surveyed Eleventh Circuit evidence decisions. During these years there has been, in the author's opinion, an unmistakable trend-a trend that continued during the current survey period. In stark contrast to the days when the Eleventh Circuit rigorously examined district court evidentiary decisions and freely reversed those decisions, the Eleventh Circuit now carefully defers to district judges. The abuse-of-discretion standard that has always governed evidentiary issues on appeal now seems to be the standard of review in practice as well as in name.

Absent some action by Congress, the most extensive changes …

Legal Hermeneutics At A Crossroads: Giuseppe Zaccaria's Questioni Di Interpretazione (1996), Ioannis S. Papadopoulos, Mark Tushnet Jul 2000

Legal Hermeneutics At A Crossroads: Giuseppe Zaccaria's Questioni Di Interpretazione (1996), Ioannis S. Papadopoulos, Mark Tushnet

Cardozo Journal of International and Comparative Law

The article explores the potential for enriching U.S. legal scholarship through engagement with European legal hermeneutics, particularly the work of Giuseppe Zaccaria. It argues that while U.S. legal thought has been influenced by various movements like legal realism and critical legal studies, it often lacks the deeper philosophical underpinnings found in continental scholarship. Zaccaria's work, rooted in hermeneutic theory, offers a bridge between European and American legal thought, emphasizing the role of practical reason, language, and community in legal interpretation.
