Evaluation Of The Effectiveness Of A Sexual Assault Curriculum At The University Of Northern Iowa, Faith Hope Sonksen Jan 2000

Evaluation Of The Effectiveness Of A Sexual Assault Curriculum At The University Of Northern Iowa, Faith Hope Sonksen

Dissertations and Theses @ UNI

The purpose of this study was to assess university students' attitudes toward rape and rape mythology and to measure any impact on these attitudes following exposure to a rape/sexual assault awareness curriculum unit. It was hypothesized that students attending the rape/sexual assault unit would demonstrate a statistically significant difference in their rape/sexual assault awareness attitudes and beliefs after taking a sexual assault program, and there would be a statistically significant difference according to gender.

The study sample consisted of 46 (28 male, 18 female) physical education major students enrolled in sections of 420:016, Self-Defense Class at UNI. The mean age …

Typology And Critique Of Title Ix Sexual Harassment Law After Gebser And Davis, William A. Kaplin Jan 2000

Typology And Critique Of Title Ix Sexual Harassment Law After Gebser And Davis, William A. Kaplin

Scholarly Articles

Sexual harassment is not a new phenomenon. It has long been with us in harassment problem in colleges and universities, focusing particularly on the harassment of students by their teachers or by their peers. Special attention will be given to whether and how students may hold colleges and universities liable in court for money damages for a failure to protect them from harassment. Then, using such private causes of action by students as the centerpiece, this article will develop a typology of Title IX sexual harassment claims and of the variable contexts in which they may arise. Following the typology, …

Intervention Selection For Students With Asperger's Disorder, Tracy Lynn Gappa Jan 2000

Intervention Selection For Students With Asperger's Disorder, Tracy Lynn Gappa

Dissertations and Theses @ UNI

The diagnosis of Asperger's Disorder (AsD) is a relatively recent possibility. Although first described in 1944, AsD was not recognized until its inclusion in the Fourth Edition of the Diagnostic and Statistical Manual of Mental Disorders in 1994. Due to the newness of the disorder and because of a lack of a consensual definition, there is considerable confusion among researchers in this field. For those children with characteristics of AsD, the confusion has resulted in misdiagnosis and, more importantly, inappropriate interventions. Individuals with AsD have deficits in several areas that impair their ability to function normally in the educational environment, …

Planning For The Future: Using Child Support Trusts To Prepare Both Father And Child For Life After Professional Sports, Thomas C. Quinlen Jan 2000

Planning For The Future: Using Child Support Trusts To Prepare Both Father And Child For Life After Professional Sports, Thomas C. Quinlen

Vanderbilt Journal of Entertainment & Technology Law

The issue of professional athletes siring children out of wedlock was first thrust into the national conscience in an article in Sports Illustrated in May 1998. The SI piece was followed by several newspaper articles in various cities around the country, but like most hot news topics, it was quickly forgotten as the nation moved on to more pressing issues. This Note aims to revisit this issue with an eye towards practical and legal resolution of this pervasive problem, suggesting ways that lawyers and agents can establish child support trusts to represent their clients' interests and provide the best result …

Guarantying A Hit (Or Miss): Understanding The Completion Guaranty Business In Hollywood, James W. Coupe Jan 2000

Guarantying A Hit (Or Miss): Understanding The Completion Guaranty Business In Hollywood, James W. Coupe

Vanderbilt Journal of Entertainment & Technology Law

Titanic was. So was Waterworld. Heck, even The Adventures of Baron Munchausen was. Blockbusters? No. Oscar winners? Wrong again. Yet these three films do share one unfortunate characteristic-- each of these pictures was over budget, drastically in some cases. Although caused by different forces and cured by different individuals, each film eventually forced someone to pay a great deal of money unexpectedly. Like many unforeseen expenses, these too can be insured against. Enter stage right, a completion guaranty company.

Any and all film productions financed by non-producer third parties should have a completion guaranty. In the most fundamental terms, a …

Don't Sell Out, Sell Bonds: The Pullman Group's Securitization Of The Music Industry, Hewson Chen Jan 2000

Don't Sell Out, Sell Bonds: The Pullman Group's Securitization Of The Music Industry, Hewson Chen

Vanderbilt Journal of Entertainment & Technology Law

Securitization is the selling of debt to investors. In general, securitization converts future income streams like credit card receivables or auto loan payments to present in-pocket cash. Notably, this transformation from future income to current wealth gives the issuer of the security immediate access to cash at less cost than other financing methods such as bank loans. In the 1970s, this technique was applied to the housing industry, and since then, securitization has evolved into greater varieties of income streams, including medical insurance, typhoon insurance, and unused airline tickets. The application of securitization in the entertainment industry, however, remains largely …

The Wrong Tool For The Right Job: Are Commercial Websites Places Of Public Accommodation Under The Americans With Disabilities Act Of 1990?, Patrick Maroney Jan 2000

The Wrong Tool For The Right Job: Are Commercial Websites Places Of Public Accommodation Under The Americans With Disabilities Act Of 1990?, Patrick Maroney

Vanderbilt Journal of Entertainment & Technology Law

The text of the ADA does not support such an extension. The interpretative canons of "noscitur a sociis" and "ejusdem generis" dictate that "places of public accommodation" refer exclusively to physical facilities. The canons also sufficiently resolve any possible statutory ambiguities, thereby foreclosing the opportunity for contrary agency interpretations. Although the intentionally broad purpose and design of the ADA make the statute an attractive avenue for advocates of online expansion, that same purpose and design limit the ADA to physical facilities. This note addresses the issues in two parts. First, it presents the arguments just listed. Second, it recognizes the …

Concerts: Rated Or Raided? First Amendment Implications Of Concert-Rating, Deborah Cazan Jan 2000

Concerts: Rated Or Raided? First Amendment Implications Of Concert-Rating, Deborah Cazan

Vanderbilt Journal of Entertainment & Technology Law

This Note examines the constitutionality as well as practicality of two different concert-rating statutes. San Antonio ordinance 61,850, the first attempt at concert-rating, has never been challenged constitutionally. This Note asserts that if the ordinance were challenged, the Court would find it constitutionally valid on its face, despite the possibility of unconstitutional applications. However, some unconstitutional consequences remain. The second statute examined is one recently proposed by Senator Shugars in the Michigan state legislature. Like the San Antonio ordinance, this Note concludes that Senate Bill 239 would also withstand a constitutional challenge.

This Note examines the history and structure of …

Muslim Women's Rights In The Global Village: Challenges And Opportunities, Azizah Y. Al-Hibri Jan 2000

Muslim Women's Rights In The Global Village: Challenges And Opportunities, Azizah Y. Al-Hibri

Law Faculty Publications

In this age of information technology that shrank our world into a global village, it is fair to ask how this recent development has impacted Muslim women's rights across the world. Having just traveled through nine Muslim countries, ranging from Pakistan and Bangladesh to the Gulf States, Egypt, Syria, and Lebanon, I would answer that it is leading, slowly but surely, to reassessment and change.' Attempts to accelerate the pace of this change, however, without full understanding of its complex topology, and the deep-rooted commitment by most Muslim women to spiritual and cultural authenticity, could halt or even reverse this …

Generations: Borges And His Progeny, David Laraway Jan 2000

Generations: Borges And His Progeny, David Laraway

Faculty Publications

"Jovenes, imatad a Borges!" Legend has it that these were the parting words of novelist Witold Gombrowicz as he set sail for his native Poland after spending the duration of World War II in Argentina (King xi). Gombrowicz perceived---correctly, as it turns out-that subsequent generations of writers would need to reconcile themselves to Borges before they could find their own voices. To be sure, Borges was not always engaged willingly by his immediate successors, and anecdotes about the suspicions with which he was regarded by the so-called Boom writers are as ubiquitous as the traces of his presence in their …

Sorting Out Voices On Women’S Rights In Morocco, Sumi Colligan Jan 2000

Sorting Out Voices On Women’S Rights In Morocco, Sumi Colligan

Journal of International Women's Studies

From the Article:

In this chapter, I intend to expand on the theme of developing “our listening capacity, to be sure that we hear everything” in an attempt to avoid perpetuating the stereotype of the passive, victimized Third World woman whose only hope of liberation is through the consciousness raising and activist efforts of Western feminists. Much of the current writing on human rights and women’s rights in North Africa and the Middle East suggests that world-wide endorsement of such principles and platforms is most likely to be successful if the people to whom they apply feel a sense of …

The White Rose: Judges And Justice In The Third Reich, Matthew Lippman Jan 2000

The White Rose: Judges And Justice In The Third Reich, Matthew Lippman

Connecticut Journal of International Law

In recent years there has been an increased interest in the Holocaust.' One concern has been to explain the willingness of ordinary Germans2 and highly educated medical professionals' to conform to the draconian dictates of the Third Reich.4 This scholarly effort largely has ignored the complicity of lawyers and judges in the Nazi's depredations.5 The lack of academic concern may be based on the belief that the Reich was a "lawless" regime in which legal professionals performed a limited role. Most studies accordingly have centered on the extra-judicial and summary exterminations carried out by the Nazi government. 6 However, the …

Cellular Release Of And Response To Atp As Key Determinants Of The Set-Point Of Signal Transduction Pathways, Rennolds S. Ostrom, Caroline Gregorian, Paul A. Insel Jan 2000

Cellular Release Of And Response To Atp As Key Determinants Of The Set-Point Of Signal Transduction Pathways, Rennolds S. Ostrom, Caroline Gregorian, Paul A. Insel

Pharmacy Faculty Articles and Research

The determinants of “basal” activity of signaling pathways regulating cellular responses are poorly defined. One possibility is that cells release factors to establish the set-point of such pathways. Here we show that treatment of Madin-Darby canine kidney cells with the nucleotidase apyrase decreases basal arachidonic acid release and cAMP production 30–40% and that inhibitors of P2Y receptor action also affect basal and forskolin-stimulated cAMP accumulation. Changing medium prominently increases extracellular levels of ATP in Madin-Darby canine kidney, COS-7, and HEK-293 cells. Mechanical stimulation of ATP release likely occurs in virtually every experimental protocol with cultured cells, implicating such release and …

A Mathematical Model For Spatially Varying Extracellular Matrix, J. C. Dallon, J. A. Sherratt Jan 2000

A Mathematical Model For Spatially Varying Extracellular Matrix, J. C. Dallon, J. A. Sherratt

Faculty Publications

Orientation of extracellular matrix fibers in the skin is a key ingredient of tissue appearance and function, and differences in fiber alignment are one of the main distinctions between scar tissue and normal skin. In this paper, the authors develop a mathematical model for alignment of collagen fibers and the fibroblast cells that remodel them; the model extends previous work in which spatial variation was excluded. Numerical simulations of the model are presented, which show spatial variations in alignment over long transients, but with spatially uniform behavior in the long term. This is investigated further via asymptotic analysis, using the …

Estimating Tessellation Parameter Intervals For Rational Curves And Surfaces, Thomas W. Sederberg, Jianmin Zheng Jan 2000

Estimating Tessellation Parameter Intervals For Rational Curves And Surfaces, Thomas W. Sederberg, Jianmin Zheng

Faculty Publications

This paper presents a method for determining a priori a constant parameter interval with which a rational curve or surface can be tessellated such that the deviation of the curve or surface from its piecewise linear approximation is within a specified tolerance. The parameter interval is estimated based on information about the second order derivatives in the homogeneous coordinates, instead of using affine coordinates directly. This new step size can be found with roughly the same amount of computation as the step size presented in [Cheng 1992], though it can be proven to always be larger than Cheng's step size. …

Proclamation-Based Principles Of Parenting And Supportive Scholarship, Craig H. Hart, Lloyd D. Newell, Lisa L. Sine Jan 2000

Proclamation-Based Principles Of Parenting And Supportive Scholarship, Craig H. Hart, Lloyd D. Newell, Lisa L. Sine

Faculty Publications

How parents view the nature of a child and their own role as parents has great influence over the life of that child. Many perspectives about the nature of children have arisen in the course of Western Civilization that have shaped childrearing practices for centuries, including the increasingly accepted scholarly view that parents matter relatively little in children’s lives. (2) This chapter emphasizes inspired, eternal principles that are supported by empirical and conceptual scholarship, which suggests that optimal parenting does indeed matter in children’s lives.

Accreditation And Academic Quality: A Comparison With Healthcare Accreditation, Ramon B. Zabriskie, Bryan P. Mccormick Jan 2000

Accreditation And Academic Quality: A Comparison With Healthcare Accreditation, Ramon B. Zabriskie, Bryan P. Mccormick

Faculty Publications

The origins of accreditation in higher education began at the turn of this century, resulting from the rapid growth in number and variety of educational institutions. One of the key concerns of accreditation has been to address quality in educational experiences. Specialized accreditation of higher education programs in recreation, park resources, and leisure services has evolved over the past 20 years; however; concerns can be raised regarding the ability of the current process to adequately measure quality. Comparisons are made with trends identified in the evolution of accreditation in healthcare and their implication to the future of accreditation. Recommendations are …

Muddying Boundaries: Mixing Genres With Five Paragraphs, Deborah M. Dean Jan 2000

Muddying Boundaries: Mixing Genres With Five Paragraphs, Deborah M. Dean

Faculty Publications

The Paper Bag Princess by Robert Munsch is a charming children's picture book. Part of its charm lies in its ability to anticipate the conventions of the fairy tale genre, creating expectations for readers, then pushing the boundaries of the genre in novel ways. As the story moves outside traditional expectations with its unexpected reversals (the princess fights the dragon to save the prince, and the fight is more mental trickery than physical battle), the boundaries of the genre are muddied, making my secondary students smile when I read to them. But it is the ending that surprises them most. …

Assessing The Practicality And Constitutionality Of Alaska's Split-Recovery Punitive Damages Statute, Scott Dodson Jan 2000

Assessing The Practicality And Constitutionality Of Alaska's Split-Recovery Punitive Damages Statute, Scott Dodson

Faculty Publications

In 1997, Alaska responded to its reputation for unusually high punitive awardsby amending its punitive damages statuteto require that 50% of any punitive damages award be deposited into the general fund of the state.Such “split-recovery” statutes attempt to reduce some of the plaintiff's windfall by allocating part of the punitive award to the state.Although the plaintiff shares in the award to compensate her for bringing the punitive claim in the first place, the state receives the balance to use for the public benefit. This Note evaluates the practicality and constitutionality of Alaska’s split- recovery statute. Part I reviews the nature and purpose …

Meaningful Work: Rethinking Professional Ethics, Mike W. Martin Jan 2000

Meaningful Work: Rethinking Professional Ethics, Mike W. Martin

Philosophy Faculty Books and Book Chapters

As commonly understood, professional ethics consists of shared duties and episodic dilemmas--the responsibilities incumbent on all members of specific professions joined together with the dilemmas that arise when these responsibilities conflict. Martin challenges this "consensus paradigm" as he rethinks professional ethics to include personal commitments and ideals, of which many are not mandatory. Using specific examples from a wide range of professions, including medicine, law, high school teaching, journalism, engineering, and ministry, he explores how personal commitments motivate, guide, and give meaning to work.
