Protecting The Sacred Sites Of Indigenous People In U.S. Courts: Reconciling Native American Religion And The Right To Exclude, Kevin J. Worthen Jan 2000

Protecting The Sacred Sites Of Indigenous People In U.S. Courts: Reconciling Native American Religion And The Right To Exclude, Kevin J. Worthen

Faculty Scholarship

The key to understanding current U. S. caselaw concerning the protection of Native American sacred sites is arguably found in the dissenting opinion of an eighteen-year old case involving not religious freedom, not sacred sites, and not cultural heritage - but the right of Indian tribes to impose severance taxes on non-tribal members who extract oil and gas from tribal lands. In Merrion v. Jicarilla Apache Tribe, Justice Stevens refused to join the majority’s conclusion that the inherent sovereignty of the Jicarilla Apache Tribe included the power to impose such a tax. In his view, a tribe’s authority to regulate …

Tracing Image And Bodily Displacement In Modern And Postmodern Dance, Carolyn Margaret Griffiths Jan 2000

Tracing Image And Bodily Displacement In Modern And Postmodern Dance, Carolyn Margaret Griffiths

Theses: Doctorates and Masters

Through time the dancer has been both celebrated and disadvantaged by antithetical ideas: the division of soul and body, form and matter, life and death, artist and audience. For the romantics, the dancing body stood in a relationship to poetic thought in much the same way as the dancer stood to the body. Notions of the body in early modernism arose from cultural and political constructs through which poets and writers examined the nature of truth. These poets, Yeats in particular, hinted at a premise that a whole history of culture may be necessary to explain why women and art …

Identifying The 'Aboutness' Of Highly Structured Expository Documents, N. Stuart Hawthorne Jan 2000

Identifying The 'Aboutness' Of Highly Structured Expository Documents, N. Stuart Hawthorne

Theses: Doctorates and Masters

The increases in commercial documentation over the past 50 years and the permeation of computers into all areas of business has led to a major increase in the individual's reading load. This thesis proposes a method of writing procedural documentation to enable rapid appreciation of the 'aboutness' of such material, thus making the reading task more efficient. The method is derived from a document structure which is used as a basis for the development of rules to construct a hierarchy of in-text headings which encapsulates the 'aboutness' of the text. Reading efficiency is achieved through needing to only interpret the …

Comparison And Evaluation Of The Moral Significance Of Emotions In Aquinas, The Manualists And Catholic Moral Theology 1960-1990, Thomas Ryan Jan 2000

Comparison And Evaluation Of The Moral Significance Of Emotions In Aquinas, The Manualists And Catholic Moral Theology 1960-1990, Thomas Ryan

Theses

This is a comparative study of the moral significance of emotions in Catholic Moral Theology. It is done with reference to Thomas Aquinas, to selected Manualist authors immediately prior to Vatican II, to representative Catholic theologians 1960-1990 and to a sample of contemporary writers from other disciplines. The project argues five points. Firstly, Aquinas sees emotions as designed to have a necessary and constructive significance in moral reasoning and moral development. In their habituated form as affective virtues, they enable a person to have the right emotional responses in terms of their object and intensity. Secondly, the Manualists, by a …

Limaria Hians (Mollusca: Limacea): A Neglected Reef-Forming Keystone Species, J. M. Hall-Spencer, P. G. Moore Jan 2000

Limaria Hians (Mollusca: Limacea): A Neglected Reef-Forming Keystone Species, J. M. Hall-Spencer, P. G. Moore

School of Biological and Marine Sciences

1. The case is made for recognition of the marine bivalve Limaria hians as a reef-forming species, which plays a key architectural role in certain benthic communities around the United Kingdom and Ireland. 2. This species uses byssal threads to construct nests that can coalesce to form reefs that cover hectares of seabed, contain multiple conspecifies and bind sediment. In so doing, L. hians modifies physical, chemical and biological processes at the sediment-water interface. 3. Such nests support a high diversity of associated organisms in coarse-grade sediments (19 species of algae and 265 species of invertebrates from six discrete nests …

M-Garch Hedge Ratios And Hedging Effectiveness In Australian Futures Markets, Wenling Yang Jan 2000

M-Garch Hedge Ratios And Hedging Effectiveness In Australian Futures Markets, Wenling Yang

Theses: Doctorates and Masters

This study deals with the estimation of the optimal hedge ratios using various econometric models. Most of the recent papers have demonstrated that the conventional ordinary least squares (OLS) method of estimating constant hedge ratios is inappropriate, other more complicated models however seem to produce no more efficient hedge ratios. Using daily AOIs and SPI futures on the Australian market, optimal hedge ratios are calculated from four different models: the OLS regression model, the bivariate vector autoaggressive model (BVAR), the error-correction model (ECM) and the multivariate diagonal Vcc GARCH Model. The performance of each hedge ratio is then compared. The …

The Enforcement Of Environmental Law In England And Wales, Lisa Jane Page Jan 2000

The Enforcement Of Environmental Law In England And Wales, Lisa Jane Page

Plymouth Business School Theses

The control of environmentally damaging activities has become one of the most important areas for concern in recent years. The amount of legislation relating to this subject area has increased several-fold, with European Directives and domestic laws being introduced in response to pressure from a variety of avenues. Key studies on the enforcement of environmental law have been carried out. However, this work was undertaken prior to the expansion of legislative provisions at the start of the 1990s. In the light of this new legislation, new regulatory agencies, and changing public opinion, the following research aims were formulated: 1. To …

Mental Models, Cognitive Style, And Organisational Learning : The Development Of Shared Understanding In Organisations, David Philip Spicer Jan 2000

Mental Models, Cognitive Style, And Organisational Learning : The Development Of Shared Understanding In Organisations, David Philip Spicer

Plymouth Business School Theses

Organisational learning is seen by many to be a key determinant of organisational performance. This is demonstrated by the growth of the 'learning company' concept (Pedler et al. 1991), and by the suggestion that the ability to learn faster than one's competitors is the only sustainable competitive advantage (DeGeus 1988). Consequently, organisations need to integrate and maximise the knowledge and learning of their individuals, and central to the learning process in firms is an effective means of transferring knowledge and learning between individuals and their organisation as a whole. Mental models (individual and shared) have been postulated as a mechanism …

Great Copper Caper: Is Market Manipulation Really A Problem In The Wake Of The Sumitomo Debacle, Benjamin E. Kozinn

Fordham Law Review

In the financial arena, the name of the game is money - make it now, make it fast, make a lot. To some players in this financial game, the question of whether to play fairly or unfairly, legally or illegally, is not debated. Their only issue of concern is how much, how fast, and what are the chances of being caught.

International Child Abduction And The Escape From Domestic Violence, Merle H. Weiner

Fordham Law Review

The violence went on for nine months. . . . By the end, the beatings were happening weekly, sometimes three times a week. . . . It always went on in front of the kids. . . . My daughter still asks, 'Why'd papa try to break your arms and legs?'. . . I left France when I realized after nine months that there was nothing I could do there to stop the violence.

The e+-jet invariant mass spectrum produced in the reaction e+p → e+ X has been studied at a center-of-mass energy of 300 GeV. The data were collected using the ZEUS detector operating at the HERA collider, and correspond to an integrated luminosity of 47.7 pb-1. The observed mass spectrum is in good agreement with Standard Model expectations up to an e+-jet mass of 210 GeV. Above this mass, some excess is seen. The angular distribution of these events is typical of high-Q2 neutral current events and does not give convincing evidence for the presence of a narrow scalar or vector …

Consortia Vs Reform: Creating Congruence, Margaret Landesman, Johann Van Reenen

University Libraries & Learning Sciences Faculty and Staff Publications

The inability of research libraries to offer the collections their users desire has become more pronounced each year. In response, libraries have moved in two directions: the rapidly growing consortial movement and the movement to advocate and support reforms in scholarly communication. However, if libraries do not pay careful attention, these two directions may, at least partially, cancel one another out.

Improving The Quality Of Foliage Transplants For Supply To The Kerry Foliage Industry, Gwen Lanigan Jan 2000

Improving The Quality Of Foliage Transplants For Supply To The Kerry Foliage Industry, Gwen Lanigan

Theses

The possibility of improving the quality of transplants of ornamental foliage species, Eucalyptus perriniana, E. parvifolia and Pittosporum tenuifolium, for supply to the Kerry Foliage Industry was investigated. At present transplants (seedlings) are propagated from seed under glass and subsequently transplanted into the field. Therefore nursery practices for seed propagation, such as optimum sowing date, pot and medium selection, irrigation and fertilisation regimes, were investigated and optimised. The possibility of eliminating the occurrence of J- roots, a major problem with Eucalyptus species was also investigated. Vegetative propagation methods, such as cutting propagation and in vitro micro-propagation were investigated for comparative …

Bismuth(Iii) Oxide Perchlorate Promoted Rearrangement Of Epoxides To Aldehydes And Ketones, Ram Mohan, Andrew Anderson, Jesse Blazek, Parie Garg, Brian Payne

Scholarship

Aryl-substituted epoxides and aliphatic epoxides with a tertiary epoxide carbon undergo smooth rearrangement in the presence of 10–50 mol% bismuth(III) oxide perchlorate, BiOClO4•xH2O, to give carbonyl compounds. The rearrangement is regioselective with aryl substituted epoxides and a single carbonyl compound arising from cleavage of benzylic C―O bond is formed. BiOClO4•xH2O is relatively non-toxic, insensitive to air and inexpensive, making this catalyst an attractive alternative to more corrosive and toxic Lewis acids such as BF3•Et2O or InCl3 currently used to effect epoxide rearrangements.
