A Law of Her Own: The Reasonable Woman as a Measure of Man by Caroline A. Forell and Donna M. Matthews aspires to provide a solution for an enigmatic jurisprudential problem - the systemic failure of the legal order to recognize and to redress the injuries that women experience. Feminist scholars have agreed that, for women, the legal separation of public and private spheres often insulates from legal review behavior that harms women. Enforcing Contracts In Dysfunctional Legal Systems: The Close Relationship Between Public And Private Orders: A Repy To Mcmillan And Woodruff, Ariel Porat

When the public order is dysfunctional, a private order for enforcing contracts will develop. In the absence of courts, transactors will seek ways to secure performance without recourse to legal sanctions. Social and economic sanctions imposed on the party in breach, whether by the aggrieved party or by the economic and social community in which both parties operate, replace legal sanctions. These sanctions sometimes arise within a private order functioning spontaneously, as when ongoing contractual relationships prevail between the parties, or when a close-knit economic or social community exists in which information concerning breaches of contract flows freely. In 1993, the country's interest in the issue of military service by gay citizens escalated to a level that can only be described as a national obsession, and "obsession" is by no means too strong a term. Few would dispute that law and legal procedures lie at the core of American self-identity and are woven deeply into the fabric of our culture. Indeed, our nation's faith in law has frequently been the subject of criticism. Most recently, self-proclaimed "communitarian" commentators have warned that our insistence on legal solutions is encouraging us to become a society of litigants whose attachment to "rights talk" and legal battles is thwarting our ability to reach consensus on social issues or instill shared values in our communities. In this Article, we critically address several philosophical underpinnings of ethical decision-making that impact persons with psychiatric disorders. We focus our attention, however, upon an admittedly limited target area. Thus, we canvass a select number of significant issues that pose unique problems for humanity. The purpose of these excursions is that of reflection. Among the lessons we can glean from the past is the importance of agreement on the nature of our field, and especially its core. Building on a model of the field from the 1940s and a model of the current language arts curriculum designed for Iowa's public schools, Becker presents a possible model of contemporary communication studies in which the core consists of relationships of the source, audience, code, and "reality" with the message. The purpose of this study was to determine which factors and the degree to which these factors influenced the Joint Committee when deciding how much money should be allocated to the different services funded by the Ryan White CARE Act. This study focused on the possible explicit and implicit factors influencing the decision-making process and interactions of the members of the HIV/AIDS Joint Prioritization & Allocation Committee in the decisions that were being made on behalf of the people who are infected and affected by this disease.

A Domesticated Landscape: Native American Plant Cultivation On The Northwest Coast Of North America., Douglas Eugene Deur

By all accounts, the peoples of the Northwest Coast of North America did not cultivate plants at the time of European contact. This dissertation provides an interdisciplinary assessment of evidence to the contrary, and presents a critique of the literature from which this orthodoxy has been derived. As a primary line of evidence, this thesis describes estuarine gardens found on this coast during the contact period. Northwest Coast peoples created gardens of Pacific silverweed (Potentilla anserina ssp. pacifica), springbank clover (Trifolium wormskjoldii) and other plants with edible, starchy roots within estuarine plots. Ethnographic sources suggest that these gardens were maintained …

Professional Versus Caregiver Ratings Of The Communicative Abilities Of Adults Displaying Moderate To Profound Communication Challenges., Paul Steven Miller

Ninety caregivers of 30 adults with moderate-to-serve cognitive, sensory, and physical challenges living in an institutional setting participated in this study to investigate caregiver perceptions of communicative abilities. A mixed effects design was used to compare communication scores of thirty adults. The adults were assigned to three communication proficiency groups. The communicative scores with challenges that were generated with three different assessment activities: a direct/participatory evaluation conducted by a certified speech-language pathologist, an interview of the caregivers, and an observation of daily routine activities. Results indicated that all of the rating procedures differentiated the three communication proficiency groups. Correlations between …

This dissertation develops a new approach to the analysis of narratives by combining the analysis of narrative structure and character analysis. Through the in-depth analysis of two stories of a collection of 32 Nanzi stories (from Curacao), which are spider/trickster stories in Papiamentu, I develop a method to analyze the structure of the Nanzi stories. My method is based on the determination of narrative division into (1) episodes, organized as macro-propositions under a macro-structure (Van Dijk 1982; 1992); (2) different sections (six), based on narrative and free clauses (Labov 1972); and, (3) major events (Barthes 1975; Chatman 1978). Rhetoric, Prudence, And The "Morrill Act" Of 1862., Jason Brian Munsell

The Morrill Act was the political telos of numerous rhetorical messages calling for pedagogical changes in higher education. This study examines the role of prudence in four of them. The method is a mode of textual criticism that attempts to capture the bifurcated sense of rhetorical invention: The immediate rhetorical situation, and the cultural grammar that constrains the rhetor performatively. The author illustrates how the relevant rhetorical strategies/gestures within each text and the text's textual context pointed to a certain conception of prudence. Despite all that has been written in recent years on the subject of literary postmodernism, theorists and critics have yet to arrive at a consensus about the meaning of the term. In the context of Latin America, the theoretical disagreement is given an added dimension by an ongoing debate over whether the notion of postmodernism, in any of its manifestations, is relevant to contemporary Latin American letters. Problem. Since 1995, with the realization that by 2005 more than 61% of executives in the senior ranks of the Canadian Public Service would be eligible for retirement (La Releve, 1998), the need to recruit and develop competent leaders has become a matter of urgent attention.

Method. Public sector leaders were surveyed by mail-in questionnaires as to their ratings of a set of leadership competencies. Analogue research for private sector leaders, conducted by a colleague, was incorporated for some analysis. A stratified sample of the general public was also surveyed by telephone regarding a subset of the same competencies. …

The Issue Of Antitrinitarianism In The Fifteenth-Century Novgorod-Moscow Movement: Analysis And Evaluation, Oleg Zhigankov

This study attempts to examine the trinitarian beliefs of the fifteenth-century Novgorod-Moscow movement, analyzing both their own writings and the polemical writings of those who considered their teaching antitrinitarian.

The main objective of the present research is to contribute to the restoration of the authentic theological identity of this movement. Chapter 1 defines the problem, which has already been raised by some nineteenth-century scholars who have pointed out that the allegedly antitrinitarian character of the Subbotniks' movement must be open for further discussion. It also shows that no systematic research on Subbotniks' theology has ever been produced.

In this Commentary, Professor Katherine Franke offers an analysis on Richard Delgado and Jean Stefancic's California's Racial History and Constitutional Rationales for Race-Conscious Decision Making in Higher Education and Rebecca Tsosie's Sacred Obligations: Intercultural Justice and the Discourse of Treaty Rights. These two Articles, she observes, deploy history for the purposes of justifying certain contemporary normative claims on behalf of peoples of color: affirmative action in higher education for Delgado and Stefancic, and sovereignty rights for native peoples in Tsosie's case.
