Crossing The River Of Blood Between Us: Lynching, Violence, Beauty, And The Paradox Of Feminist History, Emma Coleman Jordan
Crossing The River Of Blood Between Us: Lynching, Violence, Beauty, And The Paradox Of Feminist History, Emma Coleman Jordan
Georgetown Law Faculty Publications and Other Works
Understandably, early feminist legal theory and history focused almost exclusively on establishing white women's autonomy against white male dominance. The vehicles of nineteenth century women's liberation included elements of public equality such as ownership of property, the right to vote, access to male dominated occupations, equal education and employment opportunity. Twentieth century feminists extended the equality project by penetrating the "private" sphere and attacking the very notion of a separate zone of family relations which was immune from government intervention to protect women from male abuse. Cultural feminists like Carol Gilligan took another approach, arguing that women's experiences as sexual …
Escaping The Expression-Equality Conundrum: Toward Anti-Orthodoxy And Inclusion, Nan D. Hunter
Escaping The Expression-Equality Conundrum: Toward Anti-Orthodoxy And Inclusion, Nan D. Hunter
Georgetown Law Faculty Publications and Other Works
In this article, Professor Hunter questions the naturalness and inevitability of the dichotomy in constitutional law between freedom of expression and the right to equality. She places the origin of this doctrinal divergence in the history of American social protest movements in the first half of the twentieth century, which began with ideologically-based claims and shifted to a primary emphasis on identity-based equality claims. During the interim period between World War I and World War I, the wave of seminal First Amendment cases was ebbing and the wave of equality claims was beginning to swell. Close examination of the constitutional …

Evidence Issues In Domestic Violence Civil Cases, Jane H. Aiken, Jane C. Murphy
Georgetown Law Faculty Publications and Other Works
This article is intended to assist practitioners in anticipating and responding to some of the evidentiary challenges in civil cases in which relief is sought for the victims of domestic violence. First, expert testimony is often necessary to dispel common myths about battered women and to educate judges and juries about the dynamics of domestic violence. Recent case law, however, has limited the admissibility of "non-scientific" expert testimony and may make it difficult for practitioners to use experts in their cases. In addition, particular evidentiary issues arise when victims are pursuing both criminal and civil remedies against the batterer. This …

This paper explores the relationship between corporate R&D spending and growth in stockholder value. corporate R&D, at the macroeconomic level, mounts to controllable, discriminate, elective spending with the management intent of creating future revenue and profit opportunities for the firm. It is firmly established that different industries tend to have different levels of R&D investments as a percentage of revenue. Researchers have used R&D expenditures and their various measurable effects as proxies for inventive output in attempts to correlate current R&D &om to future results of the firms within an industry. Other studies have significantly related announced increases in firm …

Plastic Manufacturing Process Selection Methodology Using Self-Organizing Map (Som)/Fuzzy Analysis, R. Raviwongse, Venkat Allada, T. Sandidge
Engineering Management and Systems Engineering Faculty Research & Creative Works
For plastic products, one of the crucial decisions made during the preliminary design stage is the selection of an appropriate manufacturing process. In many industries, the selection of the manufacturing process is primarily based on the empirical knowledge and past experience of the manufacturing personnel. This selection procedure may result in inconsistent or poor choices if the manufacturing personnel fail to map correctly the product characteristics with the manufacturing efficacy of various manufacturing processes. This paper presents an intelligent self-organizing map (SOM)/fuzzy-based model to aid designers in the selection of an appropriate plastic manufacturing process. The plastic part attributes are …

Large Machine-Part Family Formation Utilizing A Parallel Art1 Neural Network, David Lee Enke, Kanchitpol Ratanapan, Cihan H. Dagli
Engineering Management and Systems Engineering Faculty Research & Creative Works
The binary adaptive resonance (ART1) neural network algorithm has been successfully implemented in the past for the classifying and grouping of similar vectors from a machine-part matrix. A modified ART1 paradigm which reorders the input vectors, along with a modified procedure for storing a group's representation vectors, has proven successful in both speed and functionality in comparison to former technique. This paradigm has been adapted and implemented on a neurocomputer utilizing 256 processors which allows the computer to take advantage of the inherent parallelism of the ART1 algorithm. The parallel implementation results in tremendous improvements in the speed of the …

Case Study Of A Cognitive Behavioral Intervention For The Problem Of Marital Division Of Labor, Lily Woo Bollinger
Case Study Of A Cognitive Behavioral Intervention For The Problem Of Marital Division Of Labor, Lily Woo Bollinger
PCOM Psychology Dissertations
This clinical dissertation concerns an evaluation of a Cognitive-Behavioral Marital Therapy intervention designed to help resolve the issue of division of household labor and thereby increase marital satisfaction. There were six ninety-minute group marital sessions. There were 3 couples in the group. The sessions contained interventions to increase communication skills, problem-solving skills and raise empathy for the spouse who did more chores. The case study couple's score indicated that the husband had a higher level of marital satisfaction. The wife's final score indicated a small increase in marital satisfaction. Both had an increased score in being more self-centered.

Analysis Of A Novel Four-Level Dc/Dc Boost Converter, Keith Corzine, Sonal K. Majeethia
Analysis Of A Novel Four-Level Dc/Dc Boost Converter, Keith Corzine, Sonal K. Majeethia
Electrical and Computer Engineering Faculty Research & Creative Works
In this paper, novel two-quadrant buck/boost and one-quadrant boost four-level DC/DC power converters are introduced. The primary application for these converters is that of interfacing a low-voltage DC source, such as a fuel cell or battery, to a high-voltage four-level inverter. One important feature of the four-level DC/DC power converters proposed is the ability to perform the power conversion and balance the inverter capacitor voltages simultaneously. With the capacitor voltage balancing, it is possible to obtain the full voltage from the inverter. For the boost converter, the steady-state and nonlinear average-value (NLAM) models are developed. The NLAM is verified against …
A Report Card On The Impeachment: Judging The Institutions That Judged President Clinton, Susan Low Bloch
A Report Card On The Impeachment: Judging The Institutions That Judged President Clinton, Susan Low Bloch
Georgetown Law Faculty Publications and Other Works
Now that we have lived through one of the most unusual events in American history-the impeachment and trial of the President of the United States-it is appropriate, indeed essential, that we assess how the process worked and learn what we can from it. Specifically, I want to address two questions: First, how well did the impeachment process work? In good academic fashion, I will grade each of the governmental institutions involved – giving them, if you will, a report card. Second, what did we learn from the experience to guide us if, in the future, we face the impeachment of …

Annual Survey Of Virginia Law: Wills, Trusts, And Estates, J. Rodney Johnson
University of Richmond Law Review
In its 2000 Session, the General Assembly enacted legislation dealing with wills, trusts, and estates that added, amended, or repealed a number of sections of the Virginia Code. It also carried over one significant bill to the 2001 Session. In addition, there were nine Supreme Court of Virginia opinions, one United States District Court opinion, two Virginia Circuit Court opinions, and one Attorney General's opinion raising issues of interest to the general practitioner as well as the specialist in wills, trusts, and estates during the period covered by this review. This article reports on all ofthese legislative and judicial developments.
Trial Participants In The Newsgathering Process, C. Thomas Dienes
Trial Participants In The Newsgathering Process, C. Thomas Dienes
University of Richmond Law Review
The 1990s produced a number of sensational criminal and civil trials. The media and public avidly followed the murder trials of O.J. Simpson and the Menendez brothers, the Oklahoma City bombing trials of Timothy McVeigh and Terry Nichols, and the trial of those charged in the World Trade Center bombing. Civil trials involving products liability, medical malpractice, environmental pollution; the civil trial of O.J. Simpson; Paula Jones's sexual harassment action against President Clinton; and the notorious antitrust case against Microsoft similarly captured the public's attention. Also, as might be expected, trial judges and the legal system generally grappled with questions …

Georgetown Law Faculty Publications and Other Works
Review of The New Chemical Weapons Convention: Implementation and Prospects by Michael Bothe, Natalino Ronzitti, and Allan Rosas (1998).
This book, a fine-grained, expert-level analysis of several of the most intricate legal and policy issues arising in connection with the 1993 Chemical Weapons Convention (CWC), also serves as a vivid symbol of the "coming of age" of arms control. For all their strategic significance and political innovation, earlier generations of arms control treaties--bilateral or multilateral, concerning nuclear, chemical, biological, or other weapons--could not plausibly have spawned this type of 600-page exegesis or inspired the painstaking, inch-by-inch explorations presented in its …
Damage Control? A Comment On Professor Neuman’S Reading Of Reno V. Aadc, David Cole
Damage Control? A Comment On Professor Neuman’S Reading Of Reno V. Aadc, David Cole
Georgetown Law Faculty Publications and Other Works
This comment responds to an article by Professor Gerald Neuman on the Supreme Court's recent decision in Reno v. American-Arab Anti-Discrimination Committee (AADC). The Court in AADC rejected a selective prosecution claim by immigrants targeted for deportation based on First Amendment-protected activities, finding that Congress had stripped the federal courts of jurisdiction over such claims, and that in any event the Constitution does not recognize a selective prosecution objection to a deportation proceeding. Professor Neuman argues that the decision should not be read as implying that aliens have less First Amendment protection than citizens, and that the decision can …

Localism, Self-Interest, And The Tyranny Of The Favored Quarter: Addressing The Barriers To New Regionalism, Sheryll Cashin
Georgetown Law Faculty Publications and Other Works
This article argues that our nation's ideological commitment to decentralized local governance has helped to create the phenomenon of the favored quarter. Localism, or the ideological commitment to local governance, has helped to produce fragmented metropolitan regions stratified by race and income. This fragmentation produces a collective action problem or regional prisoner's dilemma that is well-known in the local governance literature.
The Public And Private Lives Of Presidents, Neal K. Katyal
The Public And Private Lives Of Presidents, Neal K. Katyal
Georgetown Law Faculty Publications and Other Works
Focusing on a frequent theme in the executive privilege arguments advanced by the Clinton Administration, Neal Kumar Katyal explores the distinction drawn between the public and private lives of the President, particularly in the Paula Jones and Monica Lewinsky cases. He argues that the Administration's difficulties in asserting executive privilege claims following these cases demonstrate that the public/private distinction is not entirely valid He asserts that, unlike members of Congress who have time when they are not in session, the President is unique in that he is in office twenty-four hours a day. He argues that this special constitutional status …
Deconstructing Section 11: Public Offering Liability In A Continuous Disclosure Environment, Donald C. Langevoort
Deconstructing Section 11: Public Offering Liability In A Continuous Disclosure Environment, Donald C. Langevoort
Georgetown Law Faculty Publications and Other Works
This article is an effort to rethink civil liability in capital-raising transactions by large capitalization issuers. After a brief digression about who should set liability standards, the article then addresses two related questions. The first deals with a natural question: Should not the primary regulatory effort for large issuers be to assure continuous disclosure in the secondary marketplace, given the far larger volume of such trading in that market compared to that in primary transactions? Second, if we have developed a satisfactory regime of disclosure responsibilities for this setting, what more, if anything, in terms of liability protection, is needed …
Cross-Border Insider Trading, Donald C. Langevoort
Cross-Border Insider Trading, Donald C. Langevoort
Georgetown Law Faculty Publications and Other Works
Currently, there is no formal SEC policy on when U.S. insider trading rules (or indeed Rule l0b-5 generally) will be applied extraterritorially. If one can glean anything from SEC action during the last twenty years, it is that the trading site - the use of U.S. market mechanisms - that counts most. Certainly, neither the trader nor the issuer need be U.S.-based. What I wish to do in this paper is articulate what I think is sensible enforcement policy for a nation - whether the U.S. or any other - to adopt. By this, I do not want to focus …

Telling Stories In School: Using Case Studies And Stories To Teach Legal Ethics, Carrie Menkel-Meadow
Georgetown Law Faculty Publications and Other Works
In this Foreword I will explore why we use stories and case studies (and whether stories and case studies are equal to the task) to examine ethical and moral issues in the practice of law and provide an introduction to the interesting tales which will enfold in this Symposium issue. I conclude with some thoughts about how stories and cases should be used to teach legal ethics.
