Corporate Governance In A Global Environment: The Search For The Best Of All Worlds, Timothy L. Fort, Cindy A. Schipani Jan 2000

Corporate Governance In A Global Environment: The Search For The Best Of All Worlds, Timothy L. Fort, Cindy A. Schipani

Vanderbilt Journal of Transnational Law

This Article reflects on the various visions of corporate governance. Initially, the Article reviews the contractarian and communitarian theories of the corporation. The communitarian theory views the corporation as a separate entity, with social responsibilities not only to the shareholders but to the firm's other stakeholders and society at large. On the other hand, the contractarian approach considers the firm's shareholders as the primary constituency to whom management is accountable. Voluntary contracting and market forces align the interests of management and shareholders. The Article next analyzes salient features of corporate governance in the United States, Japan, and Germany. The United …

Final Exit: Should The Double Effect Rule Regarding The Legality Of Euthanasia In The United Kingdom Be Laid To Rest?, Brendan A. Thompson Jan 2000

Final Exit: Should The Double Effect Rule Regarding The Legality Of Euthanasia In The United Kingdom Be Laid To Rest?, Brendan A. Thompson

Vanderbilt Journal of Transnational Law

This Note explores the double effect rule that currently governs physician-assisted suicide cases in the United Kingdom. Recent events in the British medical and legal community have raised serious questions about the rule's adequacy, and have arguably created an environment in which Parliament must reexamine the validity of both the double effect rule and the laws governing active euthanasia.

After providing some historical background regarding the origins and development of the double effect rule, this Note surveys recent developments such as changing attitudes towards euthanasia and the public reaction to the Moor verdict, both of which have created an environment …

Combating Copyright Infringement In Russia: A Comprehensive Approach For Western Plaintiffs, David E. Miller

Vanderbilt Journal of Transnational Law

This Article addresses several measures that U.S. and European firms can undertake to combat copyright infringing activities in Russia. First, the Article attempts to dispel the notion that Russian law and the Russian government are inadequate to deal with copyright and piracy problems. In fact, recent surveys suggest that foreign plaintffs have achieved some success in arbitrazh courts. Furthermore, Russian authorities have begun to take steps to ensure that these decisions will be enforced.

Second, the Author suggests that the United States and European nations can apply pressure on the Russian Federation to ensure compliance with copyright laws in the …

Fishing For The Smoking Gun, Y. Daphne Coelho-Adam Jan 2000

Fishing For The Smoking Gun, Y. Daphne Coelho-Adam

Vanderbilt Journal of Transnational Law

Industry-wide tort litigation, such as tobacco and gun litigation, poses a new problem for extraterritorial discovery. These suits allege conspiracies on the part of the tobacco and gun industries to conceal the dangers of their products from the public. Much of the evidence needed to prove the industries' knowledge is in their possession. These industries are international with companies located in the United Kingdom. Under U.S. discovery law the evidence is discoverable, but such is not the case under British discovery law. Therefore, the evidence and witnesses located in the United Kingdom are outside the grasp of U.S. plaintiffs. The …

The Market And Ethics: The Case Of The 1994 Decision By The Clinton Administration To Delink China's Human Rights Record From Most-Favored-Nation Status, Susan C. Morris Jan 2000

The Market And Ethics: The Case Of The 1994 Decision By The Clinton Administration To Delink China's Human Rights Record From Most-Favored-Nation Status, Susan C. Morris

Graduate Program in International Studies Theses & Dissertations

Amid the globalization of markets and the interdependence of states, human rights violations throughout the world still persist. The purpose of this study is to investigate the relationship between the economic interdependence of nations and the moral responsibilities of nations by examining the case of the 1994 decision by the Clinton administration to delink China's human rights practices from most-favored-nation status.

The annual 1997 Freedom House world survey of human rights rated China at its lowest point and quoted that “the regime continues to have one of the worst human rights records in the world.”1 Yet despite China's ongoing human …

Teaching Prayer: Pilot Survey Of Academic Courses On Personal Prayer, E. James Baesler Jan 2000

Teaching Prayer: Pilot Survey Of Academic Courses On Personal Prayer, E. James Baesler

Communication & Theatre Arts Faculty Publications

The practical concerns of an individual interested in learning about prayer in an academic context are interconnected with the practical concerns about teaching an academic course on prayer. A pilot study proposed to investigate and evaluate the context and content of academic courses on personal prayer from the perspective of teaching prayer, asking what proportion of institutions of higher education offer courses on prayer, in which department, and on what level. The search was limited to the Christian faith, and in particular to private colleges and universities of the Catholic denomination. An online Internet search yielded a sample of 126 …

Doctrinal And Applied Tqm In Relation To Dominant Models Of Organisation: A Comparative Study, Brad J. Moore Jan 2000

Doctrinal And Applied Tqm In Relation To Dominant Models Of Organisation: A Comparative Study, Brad J. Moore

Theses : Honours

Total Quality Management (TQM) is examined in five organisations in light of the assumption that its implementation is an ongoing negotiated order rather than an objective reality as often accepted by the literature. Guided by a theoretical framework identified by Spencer (1994) and a qualitative methodology suggested by Miles and Huberman (1994), the perceptions of a cross section of organisational members in five organisations are used to establish the nature of applied TQM in terms of mechanistic and organismic 'mental models' of organisation and the degree to which applied TQM varies from the basic doctrine. It is argued that both …

Mothers, Gaze And Rape : Almodóvar's Cinema And The Construction Of Gender, Gorana Mlinarevic Jan 2000

Mothers, Gaze And Rape : Almodóvar's Cinema And The Construction Of Gender, Gorana Mlinarevic

Theses : Honours

Although often named a 'women's director': Pedro Almodóvar has frequently been attacked by feminist, mainly Anglo-Saxon, film critics. Most of them have found his portrayals of women to be very humiliating. On the other hand, Spanish heterosexual, mainly male, film critics have attacked him for focusing only on portrayals of marginal genders and sexualities. Nevertheless, he has become one of the most, if not the most, commercially successful Spanish film directors. The intention of this project is not just to analyse Almodóvar's cinema and the critics' acceptance/rejection of the same. Rather, the project is intending, through use of 'Ia politique …

Jack Maggs : A Differend Convict(Ion) By Peter Carey, Timothy D. Langley Jan 2000

Jack Maggs : A Differend Convict(Ion) By Peter Carey, Timothy D. Langley

Theses : Honours

This thesis is an analysis of Peter Carey's novel Jack Maggs and its attempt at writing back to Charles Dickens' Great Expectations. I will analyse the (de)construction of language games between Jack Maggs and Great Expectations; show how Carey as a post-colonial settler writer writes back to the centre, to Dickens' text as a canonical Victorian novel, through intergrating the very notion of the Victorian novel, and in his own terms giving the convict a "history". I will explore how Carey writes competing language games of "science" and "narrative" (as identified by Lyotard) within Jack Maggs and how they produce …

Understanding My Work : Reflections On Implementing A Season Of Sepep, Kevin Black Jan 2000

Understanding My Work : Reflections On Implementing A Season Of Sepep, Kevin Black

Theses : Honours

Implementing new curriculum models for the first time can be difficult for teachers, especially those recently graduated. This study captured some of these challenges and difficulties, and the substantial rewards, through recording the teacher's reactions and reflections as he implemented his first season of SEPEP. The perceptions of the students involved in the season were recorded as a way of validating the teacher's reflections. SEPEP is a student centered physical education program which seeks to capture the positive aspects of community sport, and allows students the opportunity to be involved as players, in team roles such as captain, coach and …

Study Of Fermion Pair Production In E+E- Collisions At 130-183 Gev, R. Barate, M. Thulasidas

Research Collection School Of Computing and Information Systems

The cross sections and forward-backward asymmetries of hadronic and leptonic events produced in e+e−e+e− collisions at centre-of-mass energies from 130 to 183 GeV are presented. Results for e+e−e+e−, μ+μ−μ+μ−, τ+τ−τ+τ−, qq¯qq¯, bb¯bb¯ and cc¯cc¯ production show no significant deviation from the Standard Model predictions. This enables constraints to be set upon physics beyond the Standard Model such as four-fermion contact interactions, leptoquarks, Z′Z′ bosons and R-parity violating squarks and sneutrinos. Limits on the energy scale ΛΛ of e+e−ff¯e+e−ff¯ contact interactions are typically in the range from 2 to 10 TeV. Limits on R-parity violating sneutrinos reach masses of a few …

Software Piracy: Attitudes & Opinions Of Computer Users And Implications For Software Manufacturers & Consumers, Bharath Pola Jan 2000

Software Piracy: Attitudes & Opinions Of Computer Users And Implications For Software Manufacturers & Consumers, Bharath Pola

Presidential Scholars Theses (1990 – 2006)

Computer software became registered as a form of literary expression by the United States Copyright Office in 1964. By 1980, the Copyright Act was amended to explicitly include software applications. Today, it is illegal to create copies of original program disks without express permission from the manufacturer (Microsoft 1994). The Software and Information Industry Association (SIIA) states that $2.4 billion worth of copyrighted software was pirated in 1990. This figure represents almost one-half of the total revenue of the software industry for that year. An additional $10 to $12 billion was lost to pirates overseas. However, such statistics maintained by …

Fit To Print: A Content Analysis Of The Regent Universities' Student Papers, Ivy A. Sprague Jan 2000

Fit To Print: A Content Analysis Of The Regent Universities' Student Papers, Ivy A. Sprague

Presidential Scholars Theses (1990 – 2006)

To the best of my knowledge, this is the first comparative study conducted regarding the student publications for the three Iowa Regents' universities. The data collected shows that the three publications are not as different in terms of content as many of their readers seem to believe. As the data reflects, the Northern Iowan is significantly more campus-centered in its coverage. However, the difference is not so significant that the staff of the Northern Iowan could not increase its national and international coverage to make it more comparable to the other two newspapers. I hope this research can be of …

Health Care Divided: Race And Healing A Nation, Sidney D. Watson Jan 2000

Health Care Divided: Race And Healing A Nation, Sidney D. Watson

All Faculty Scholarship

Race matters. Race—particularly racial segregation—casts a pervasive shadow over the organization of American health care. It influences the ownership and governance of institutional providers. It helps account for the high cost of health care in the United States. It contributes to America’s abysmal health status, among the worst of the industrialized world. It is reflected, in part, in the lack of national health insurance. So David Barton Smith begins this book, a book he describes as the story of “a divided nation, a divided health care system, and the uncompleted journey to heal both.”[1]

Most of us are not comfortable …

The Urban Housing Issues Symposium: Interdisciplinary Study In A Clinical Law & Policy, Peter W. Salsich Jan 2000

The Urban Housing Issues Symposium: Interdisciplinary Study In A Clinical Law & Policy, Peter W. Salsich

All Faculty Scholarship

This article describes the Urban Housing Issues Symposium, an interdisciplinary program that began in 1992 as a cooperative experiment between the Saint Louis University School of Law and the Washington School of Architecture. The program, which soon expanded to include social work and public policy students, used hypothetical problems, and later real life problems, as a way of demonstrating the importance of interdisciplinary relationships that the professions have in the context of real estate development. By giving the students the chance to interact, the students learned a greater appreciation for the variety of disciplines that are involved in the development …

solid solutions were synthesized for the first time by the hydrothermal method. The electrical properties of the solid solutions have been studied in air and under reducing conditions. Solid solutions with the fluorite structure were formed in all of the studied range of substitution after calcination at 1500°C. With increasing substitution up to 30 mol %, the electronic conductivity increases under a reducing atmosphere. The solid solution has good mixed electronic and ionic conductivity; the total conductivity is 0.42 S/cm at and 700°C with an estimated ionic conductivity of ca. .

A Content Analysis Of Advertising In Magazines Directed At United States And United Kingdom Seniors, Ray Markham Smith Jan 2000

A Content Analysis Of Advertising In Magazines Directed At United States And United Kingdom Seniors, Ray Markham Smith

Theses and Dissertations in Business Administration

The seniors (55+) market is a growing, attractive market. While this market represents almost one-fourth of the total population in the United States and is slightly higher in the United Kingdom today, this segment is projected to grow to approximately one-third of the population over the next quarter century.

Relative to their proportion of the total population, seniors, and especially women, have historically been underrepresented as general advertising models. When seniors are portrayed, they are often used in supporting roles or in a negatively stereotyped manner. While the aging process is associated with declines in mental and physical capabilities, and …

The Inherent Limits Of Judicial Control Of Agency Discretion: The D.C. Circuit And The Nondelegation Doctrine, Richard J. Pierce Jr Jan 2000

The Inherent Limits Of Judicial Control Of Agency Discretion: The D.C. Circuit And The Nondelegation Doctrine, Richard J. Pierce Jr

GW Law Faculty Publications & Other Works

The article discusses American Trucking Associations v EPA, in which a two-judge majority of a DC Circuit panel held that the section of the Clean Air Act that authorizes EPA to set primary air quality standards applicable to criteria pollutants is unconstitutional as interpreted by EPA. The court held the EPA interpretation unconstitutional because it provides no criteria for determining how much pollution is too much. The court remanded to allow EPA the opportunity to adopt a saving interpretation of the statute by adopting a binding determinate decision making standard that EPA and a court can apply to determine how …

The Health Belief Model And Self Breast Examination In Nurses, Valerie L. Holwerda Jan 2000

The Health Belief Model And Self Breast Examination In Nurses, Valerie L. Holwerda

Masters Theses

The relationship between frequency of self breast examination and health belief model variables was assessed using a convenience sample of nurses. The self-administered survey measured perceived susceptibility, perceived seriousness, perceived benefits, perceived barriers, health motivation, and confidence on 5-point Likert-type scales previously developed by Champion (1993). Individual items measured the frequency of self breast examination and demographic variables. Correlational statistics were used to determine relationships. The results of the data analysis using the Spearman correlation found that perceived benefits (p=.027), health motivation (p=.0289) and confidence (p=.008) were positively correlated with frequency of self breast examination. Perceived barriers (p=.0002) were negatively …

Role Stress And Career Satisfaction Among Registered Nurses By Work Shift Patterns, Amy Jude Hoffman Jan 2000

Role Stress And Career Satisfaction Among Registered Nurses By Work Shift Patterns, Amy Jude Hoffman

Masters Theses

In today’s health care climate, the need to understand the effects of work shift patterns on role stress and career satisfaction of registered nurses (RNs) has never been greater. Therefore, the purpose of this descriptive study was to examine differences in the level of role stress and career satisfaction among hospital-based RNs by shift length. Data were collected through the use of standardized questionnaires from a probability sample of 208 RNs.

The results indicated that RNs practicing in 12-hour work shift patterns experienced significantly higher stress levels that RNs working 8-hour shifts. Additionally, workload issues and dealing with death and …

The Lived Experience Of Student Nurses Providing Health Care Relief To Hurricane Mitch Victims In Nicaragua, Marci Jo Holstege Jan 2000

The Lived Experience Of Student Nurses Providing Health Care Relief To Hurricane Mitch Victims In Nicaragua, Marci Jo Holstege

Masters Theses

International exchange and cultural immersion is becoming a favored way to educate nursing students on cultural diversity and cultural sensitivity. There is no research literature about student nurses rendering health care in a third world country after the turmoil of a natural disaster.

The purpose of this phenomenological study was to discover the lived experience of student nurses who provided health care relief to victims of Hurricane Mitch in Nicaragua. Their oral descriptions were tape recorded and transcribed verbatim. These descriptions were then analyzed using the Giorgi method. Four focal meanings emerged: a) culture shock, b) adjustments, c) lessons learned, …

The Needs Of Family Members In Crisis, Melanie A. Burghgraef Jan 2000

The Needs Of Family Members In Crisis, Melanie A. Burghgraef

Masters Theses

The needs of family members of patients with severe brain injury were investigated using a descriptive-correlational design. A convenience sample of family members (N = 23) were surveyed with the Critical Care Family Needs Inventory (CCFNI). Need statements from the CCFNI were rank ordered, and a total score for the CCFNI was calculated. The majority of the top ranked needs consisted of assurance and information needs, which is consistent with other research using the CCFNI. Descriptive statistics were used to compare the results from this study with Lorenz’s study (1995).

Furthermore, this investigation attempted to reveal a relationship between family …

Carbonate Deposition And Sequence Stratigraphy Of The Terminal Cambrian Grand Cycle In The Southern Appalachians, U.S.A, Bosiljka Glumac, Kenneth R. Walker Jan 2000

Carbonate Deposition And Sequence Stratigraphy Of The Terminal Cambrian Grand Cycle In The Southern Appalachians, U.S.A, Bosiljka Glumac, Kenneth R. Walker

Geosciences: Faculty Publications

The cessation of shale and carbonate deposition of the Conasauga Group grand cycles (Middle to Upper Cambrian) and the establishment of the widespread peritidal carbonate deposition of the Knox Group (Upper Cambrian to Lower Ordovician) represent a prominent change in sedimentation along the early Paleozoic passive continental margin in the southern Appalachians. To evaluate the causes for this change, this study focuses on the Maynardville Formation, which is the uppermost carbonate unit of the Conasauga Group. The Maynardville consists of: (1) a lower subtidal faciès succession, which is underlain by the Nolichucky Shale and resembles the rest of the Conasauga …
