Weight Discrimination: A Multidisciplinary Analysis, Cheryl Maranto, Ann Fraedrich Stenoien
Management Faculty Research and Publications
Protection against obesity discrimination is extremely limited under the Americans with Disabilities Act (ADA). No obese plaintiff has won using the actual disability theory, but a few have won under the perceived disability theory. Weight-related appearance standards are legal. We estimate weight-based wage penalties for young men and women. We find that mildly obese (20% over standard weight) white women experience greater wage penalties than black men experience for weight that is 100% over standard weight. Men do not experience wage penalties until their weight exceeds standard weight by over 100 lb. A gender-plus analysis under Title VII is more …

Cytologic screening is an important diagnostic tool used to detect precancerous and cancerous lesions of the cervix. We studied the prevalence of cervical abnormalities, based on Pap smear results, in patients at the Outpatient Adolescent Clinic at West Virginia University. We found a high incidence of overall intraepithelial cell pathology (24%) in this group with 2.4% high grade and 9.9% low-grade lesions. These findings show that major cervical pathology is present in this age group. Furthermore, repeat smears at intervals of < one year were performed on 317 patients. Of these repeat smears, 7% changed from normal to abnormal in this period. Sexually active adolescent females should have Pap smears at least annually to detect abnormalities that may otherwise not be detected until they are more advanced and difficult to manage. Higher risk adolescents may need semiannual screening.
Insurance Unfair Trade Practices: Prohibit Discrimination Against Victims Of Family Violence In Insurance Coverage, Rates, And Claims, Rebecca Brannan
Insurance Unfair Trade Practices: Prohibit Discrimination Against Victims Of Family Violence In Insurance Coverage, Rates, And Claims, Rebecca Brannan
Georgia State University Law Review
The Act changes the Georgia Code section on unfair practices in the insurance industry by adding a prohibition on discrimination against victims of family violence. Specifically, it makes it unlawful in Georgia for an insurer to refuse applications from individuals, to refuse to insure them, to cancel or restrict existing coverage, to change a different rate or add a differential to premiums, or to limit or deny coverage or claims because the insurer believes an individual has or may be a victim of family violence. The Act further bans taking such adverse insurance actions against an individual or entity because …

Descriptive Analysis Of News Magazines’ Coverage Of John Glenn’S Return To Space, Michael L. Hilt
Communication Faculty Publications
This study examined issues of Time, Newsweek, and U.S. News & World Report for articles concerning John Glenn’s return to space and described their content. A review of pertinent literature found that little attention has been paid to how older adults are portrayed in magazine articles. Although comments were made concerning Glenn’s age and his role as a rookie payload specialist on the space shuttle Discovery, there were few comments considered ageist or demeaning to older adults.

Teaching And Learning Of Pharmacology In Medical Schools: From Canada To Southeast Asia, Chiu-Yin Kwan
Teaching And Learning Of Pharmacology In Medical Schools: From Canada To Southeast Asia, Chiu-Yin Kwan
Journal of Medical Education
Pharmacology in the traditional medical curriculum has been treated as a discrete”preclinical”discipline indentifying itself distinctly from other preclinical sciences or clinical subjects in its knowledge base as well as learning/teaching instructions. It isusually run in series with other pre-clinical courses(e.g.,anatomy,biochemistry,physiology),but in parallel with other para-clinical courses such as pathology, microbiology and community medicine.Clinical pharmacology was only introduced relativelyrecently and was designed to overcome the perceived deficiency in”preclinical”pharmacology” especially in terms of its therapeutic relevance and application to medicine. In many universities, both preclinical and clinical pharmacology courses co-exist,usually independently and are offered by two separate, sometimes non-interacting Departments of Pharmacology and Clinical Pharmacology. In recent years,problem-based …

Twenty-Five Years Of Black America: Two Steps Forward And One Step Back?, Glenn C. Loury
The Journal of Sociology & Social Welfare
The nature of social and economic inequality as it exists now between Blacks and Whites in the United States is explored in this paper. Summary statistics on education, earnings, employment, family structure, incarceration and life expectancy are presented by age, sex and race. It is suggested that, while progress has been made in narrowing the racial gap in social standing, there remains a significant disparity that warrants continuing concern.

Elderly Immigrants: Their Composition And Living Arrangements, Mary M. Kritz, Douglas T. Gurak, Likwang Chen
The Journal of Sociology & Social Welfare
This paper describes how the composition of elderly immigrants is changing and how elderly immigrants differ from natives in terms of living arrangement and demographic and socioeconomic characteristics. The determinants of living alone are investigated for 11 ethnic origin categories and natives. The analysis utilizes data from two samples of the 1990 U.S. Census: the PUMS-A 5% sample and an independent 3% sample of households containing at least one member 60 or more years of age. Between 1970 and 1990 immigrants from Asia and Latin America moved from forming a minor component of the elderly to being a significant and …
Rethinking The Concept Of "Minority": A Task For Social Scientists And Practitioners, Doris Wilkinson
Rethinking The Concept Of "Minority": A Task For Social Scientists And Practitioners, Doris Wilkinson
The Journal of Sociology & Social Welfare
Although sociologists have articulated the components and scope of the "minority" concept, many of the characteristics are no longer germane. Originally those placed in the category were viewed as subordinate and as possessing cultural or physical qualities not approved or preferred by the larger population. There has been no systematic questioning of ingrained seductive words and value-based constructions like "minority". This brief critique offers an evaluation of the "minority" conception that is so pervasive in the social and behavioral sciences, the print and broadcast media, politics, and the entire language system.

Modeling Emi Resulting From A Signal Via Transition Through Power/Ground Layers, Wei Cui, Xiaoning Ye, Bruce Archambeault, Doug White, Min Li, James L. Drewniak
Electrical and Computer Engineering Faculty Research & Creative Works
Signal transitioning through layers on vias are very common in multi-layer printed circuit board (PCB) design. For a signal via transitioning through the internal power and ground planes, the return current must switch from one reference plane to another reference plane. The discontinuity of the return current at the via excites the power and ground planes, and results in noise on the power bus that can lead to signal integrity, as well as EMI problems. Numerical methods, such as the finite-difference time-domain (FDTD), Moment of Methods (MoM), and partial element equivalent circuit (PEEC) method, were employed herein to study this …

Nondelegation Canons, Cass R. Sunstein
Nondelegation Canons, Cass R. Sunstein
University of Chicago Law Review
Reports of the death of the nondelegation doctrine have been greatly exaggerated. Rather than having been abandoned, the doctrine has merely been renamed and relocated. Its current home consists of a set of nondelegation canons, which forbid executive agencies from making certain decisions on their own. These canons forbid extraterritorial application of national law, intrusions on state sovereignty, decisions harmful to Native Americans, and absolutist approaches to health and safety. The nondelegation canons are far preferable to the old nondelegation doctrine, because they are subject to principled judicial application, and because they do not threaten to unsettle so much of …

“Mi Les Long Yupela Usim Flag Bilong Mi”:* Symbols And Identity In Papua New Guinea, Andrew J. Strathern, Pamela J. Stewart
Pacific Studies
In Papua New Guinea there is a constant interplay between senses of national identity and senses of local identity that is of particular relevance to debates in the contemporary Pacific. In the domain of symbols of identity there is also a two-way appropriation from the local to the national and from the national to the local. We argue that the latter process works most strongly and thereby modifies the process of creation of an overall national sense of identity. The incorporation of the national into the local in turn influences the process of the production of locality itself. Contemporary issues …
