Drug Treatment Courts And Emergent Experimentalist Government, Michael C. Dorf, Charles Frederick Sabel Apr 2000

Drug Treatment Courts And Emergent Experimentalist Government, Michael C. Dorf, Charles Frederick Sabel

Cornell Law Faculty Publications

Despite the continuing "war on drugs," the last decade has witnessed the creation and nationwide spread of a remarkable set of institutions, drug treatment courts. In drug treatment court, a criminal defendant pleads guilty or otherwise accepts responsibility for a charged offense and accepts placement in a court-mandated program of drug treatment. The judge and court personnel closely monitor the defendant's performance in the program and the program's capacity to serve the mandated client. The federal government and national associations in turn monitor the local drug treatment courts and disseminate successful practices. The ensemble of institutions, monitoring, and pooling exemplifies …

Ruling Sexuality: The Political Legitimacy Of Isabel Of Castile, Elizabeth Lehfeldt Apr 2000

Ruling Sexuality: The Political Legitimacy Of Isabel Of Castile, Elizabeth Lehfeldt

History Faculty Publications

This article examines the gendered construction of power during the reign of Isabel of Castile (1474-1504). The construction of her political legitimacy was based on her manipulation of her gender and sexuality intended to contrast with the perceived shortcomings of her brother, Enrique IV. Enrique's critics had impugned his sexuality and attacked his inability to deliver Spain into a golden age. By aligning Isabel with sexually chaste models and emphasizing her ability to redeem Spain both because of and despite her gender, Isabel's partisans crafted an image that allowed her to transcend the misogynist tropes that attacked female rule.

“Waive” Goodbye To Tort Liability: A Proposal To Remove Paternalism From Product Sales Transactions, Richard C. Ausness Apr 2000

“Waive” Goodbye To Tort Liability: A Proposal To Remove Paternalism From Product Sales Transactions, Richard C. Ausness

Law Faculty Scholarly Articles

This Article argues that waivers of tort liability should be permitted in connection with product sales. Currently, sellers cannot limit their liability under tort law for personal injuries caused by defective products even though such waivers are allowed, albeit reluctantly, under principles of negligence and warranty law. Existing principles of products liability law should be modified, either by legislation or by court action, to allow at least limited use of these waivers.

Crime And Community Policing In South Africa, Berhanu Mengistu, Wolfgang Pindur, Marius Leibold

African Social Science Review

This analysis examines the concept of community policing in the context of new South African disposition. With the radical change in social order that accompanied the fall of apartheid, many aspects of South African administration are shifting focus to more community- and citizen-centered ideals. The article first analyzes the qualitative and quantitative nature of crime in South Africa in order to identify the practicality and possible effectiveness of community policing. With this in mind, the concept of community policing as philosophy and practical application is then addressed, citing modern examples of its use. The particulars of current South African culture …

Relationship Between Reported Childhood And Adult Physical Activity, Kipp Ryan Kissinger Apr 2000

Relationship Between Reported Childhood And Adult Physical Activity, Kipp Ryan Kissinger

Student Work

It was the purpose of this research to examine the relationship between reported childhood and adult physical activity (PA), with special regards to the types of activities that correlate with habitual activity. Subjects were 249 male and female students age 19 to 30 years (M = 21.9 years) enrolled at the University of Nebraska at Omaha. Subjects were surveyed from all departments on campus. Subjects were asked to complete a survey instrument that assessed past and present PA. The results o f the current study reported that there is a significant positive correlation (r = 0.284, p < 0.05) between the total score of past childhood PA and present adult PA. When past PA was divided into preteen and adolescent periods, there were also significant relationships (p < 0.05) with all of the four indices of present PA (work, sport, leisure and total). Regression analysis explained 17.6 % of the variance in exercise when predicting adult PA from the total score of past PA. The prediction equation is as follows: Y ' = 27.761 + 0.775 (Xi) + 0.276 ( X 2 ) + 0.945 ( X 3 ) + 1.787 (3Ct) - 1.254 ( X 5 ) ; where Xi = number o f varsity athletic letters received as an adolescent, X 2 = informal activities as a preteen, X 3 = level of athletic ability or coordination in favorite sport as an adolescent, X* = P.F.. classes as an adolescent, and X5 = activity level compared to peers as a preteen. It was concluded that there was a significant positive correlation (p < 0.05) between the total score of past PA and each of the four indices of present PA.

Bullion

The paper examines data collection activities of the statistical services division in collaboration with its Lagos liaison office as well as the zonal research units. The paper analyzes the survey methods applied by them. The task of easing data collection should be regarded as a continuous process. This is relevant even to the most developed economies with sophisticated technology for data collection and processing. Finally, with an improvement in the literacy level and overall appreciation of the role of reliable statistics in the country, it is believed that the public would embrace data generation and availability of relevant statistics will …

What Kind Of Citizen? The Politics Of Assessing Democratic Values, Joel Westheimer, Joesph Kahne, Bethany Rogers Apr 2000

What Kind Of Citizen? The Politics Of Assessing Democratic Values, Joel Westheimer, Joesph Kahne, Bethany Rogers

Civic Engagement

I was visiting a middle school the other day and saw a sign on a teacher's classroom wall that said "Assessment is your friend." It had a picture of a cuddly looking puppy on it. There was no explanation for the puppy, so I'm not sure why it was there. But it was cute and the message seemed to be saying that "assessment" if perhaps not man or woman's best friend, is, at the very least, something you need not fear. Now we are living in an era of high stakes testing and standards, so many would believe that there …

Du Dialogue Au Monologue - Un Commentaire Sur I'Arrêt R. V. Marshall, Nathalie Des Rosiers Apr 2000

Du Dialogue Au Monologue - Un Commentaire Sur I'Arrêt R. V. Marshall, Nathalie Des Rosiers

Dalhousie Law Journal

The author develops a model of constitutional dialogue which aims at helping the resolution of majority-minority conflicts. The model is applied to the aboriginal rights context. The author concludes that because of the ambivalences expressed by the Supreme Court of Canada in the Van der Peet case in particular, the federal government has not incorporated the Sparrow-Badger approach in its litigation and has failed even to attempt to comply with the justification requirements. This failure of the federal government to endorse the Sparrow-Badger approach in its continuing litigation strategy is the real tragedy in the Marshall case.

The study consisted of 20 female physical education majors grouped as skilled or unskilled. Temporal and EMG data were collected for (a) the duration of time spent in …

Vertical Coordination, Antitrust Law, And International Trade, Stephen F. Hamilton, Kyle Stiegert Apr 2000

Vertical Coordination, Antitrust Law, And International Trade, Stephen F. Hamilton, Kyle Stiegert

Economics

This paper demonstrates that vertically aligned private or public organizations are capable of generating strategic trade advantage similar to that acquired through direct government export subsidization. The model considers two forms of vertical coordination that lead to advantageous trade positions in international markets: upstream vertical restraint and downstream equity sharing. Such practices are commonly employed both by state trading agencies and by private firms in nations with lenient antitrust laws. The finding has important implications under new World Trade Organization (WTO) rules intended to reduce government intervention in international transactions. Recent reforms in the WTO favor nations that sanction highly …

Parental Death And The Impact On Grieving Children: A Comparison Of Homicide Or Suicide And Natural Or Accidental Deaths, Brandy Liebscher Apr 2000

Parental Death And The Impact On Grieving Children: A Comparison Of Homicide Or Suicide And Natural Or Accidental Deaths, Brandy Liebscher

Doctor of Psychology (PsyD)

This study examined the impact of parental death by homicide or suicide on child survivors. Two groups representing grieving children who experienced a parental death by homicide or suicide (N = 19) and children who experienced a natural or accidental parental death (N = 19) were compared. Children in the two groups were matched for age and gender. Scores from a screening instrument, developed by William Worden (1996) to identify grieving children at risk for emotional and behavioral difficulties, were used to compare these groups. No significant differences were found between the two groups for the total screener score and …
