Arbitration And Its Collateral Estoppel Effect On Third Parties - Vandenberg V. Superior Court, Thurston K. Cromwell
Journal of Dispute Resolution
This Note examines why California's supreme court chose not to allow judicially confirmed arbitration awards to apply to third parties. The court based its decision on the contract model of arbitration and determined that an agreement to arbitrate was not necessarily an agreement binding third parties. However, this decision undermines the credibility of the arbitration process and fails to consider the negative impact relitigation of issues will have on the California courts.

Emerging evidence suggests that transforming growth factor-(TGF-β) is an important mediator of diabetic nephropathy. We showed previously that short-term treatment with a neutralizing monoclonal anti-TGF-antibody (αT) in streptozotocin-diabetic mice prevents early changes of renal hypertrophy and increased matrix mRNA. To establish that overactivity of the renal TGF-system mediates the functional and structural changes of the more advanced stages of nephropathy, we tested whether chronic administration of αT prevents renal insufficiency and glomerulosclerosis in the db/db mouse, model of type 2 diabetes that develops overt nephropathy. The Article raises some questions for proponents of reviving civil society as a cure for many of our nation's political, civic, and moral ills (whom McClain and Fleming designate as "civil society-revivalists"). How does civil society serve as "seedbeds of virtue" and foster self-government? Have liberal conceptions of the person corroded civil society and undermined self-government? Does the revivalists' focus on the family focus on the right problems? Have gains in equality and liberty caused the decline of civil society? Should we revive civil society or "a civil society"? Would a revitalized civil society support democratic self-government or supplant it? …

Effects Of Estradiol And Progesterone On Susceptibility And Early Immune Responses To Chlamydia Trachomatis Infection In The Female Reproductive Tract, Charu Kaushic, Fan Zhou, Andrew D. Murdin, Charles R. Wira

We have used a previously described rodent model to examine the influence of hormonal environment on susceptibility and immune responses to genital Chlamydia infection. Ovariectomized rats were administered estradiol, progesterone, or a combination of both, infected with Chlamydia trachomatis via the intrauterine route, and sacrificed 5 days later. Histopathological examination showed severe inflammation in the uteri and vaginae of progesterone-treated animals, whereas animals receiving estradiol or a combination of both hormones showed no inflammation. Large numbers of chlamydiae were found in vaginal secretions of progesterone-treated and combination-treated animals, while estradiol-treated animals had none. School District Enrollment Forecast Reports
This report provides a school Enrollment Forecast, including demographic information, for Portland Public Schools. The report considers several factors that are likely to affect the school district's enrollments between the present and 2010, including the future number of births, net migrants, and the proportion of school-age children and youth enrolled in the public schools. To take into account a variety of demographic and enrollment possibilities, this report describes five different scenarios of housing, population, and enrollment changes for the ten years between 2000 to 2010.

My wife and I visited Brazil in December and January this past year, spending the Christmas and New Year’s holidays there. Since my wife is Brazilian, I have taken an interest in exploring Brazilian culture and history. This interest, and the fact that we were in Brazil for a month, prompted me to take a couple of days to visit various libraries and see how things are done there. Hyatt present a convincing argument in their Review "Emerging infectious diseases of wildlife-threats to biodiversity and human health" (Science's Compass, 21 Jan., p. 443) that emerging infectious diseases (EIDs) pose a risk to wildlife, and they suggest that EIDs most often result from a change in the ecology of the pathogen or the host (or both). A situation they did not mention is that in some cases, the protection of threatened species can increase the risk of an EID outbreak by allowing a close association between wildlife and domestic animals where one …

The precise mechanism whereby granulocytes proliferate when haematopoietic colony stimulating factors (CSFs) are used in neutropenic cancer patients is poorly understood. The purpose of this study was to investigate whether these cytokines bring about leucocyte proliferation by increasing the levels of multiple forms of dihydrofolate reductase (DHFR). Blood samples were collected from 36 cancer patients (25 males and 11 females) with chemotherapy-induced neutropenia. One sample of blood from each patient was obtained before therapy either with CSF, such as granulocyte colony stimulating factor (G-CSF) and granulocyte-macrophage colony stimulating factor (GM-CSF) or with placebo, and another one at the time of …

What Can't Public Relations Graduates Write? A Study And Evaluation Of Professional Writing Skills Lacked By Public Relations Graduates, Ginger Buganski

Through a survey of roughly 50 public relations practitioners, this study identified specific writing skills public relations graduates lack and compiled recommendations for improving public relations education.
The author sent double post-cards to 100 public relations professionals nationwide. The post-cards asked for participation in a public relations writing questionnaire. At the same time, the author posted the questionnaire to two professional listservs (e-mail groups). A total of 46 professionals completed the questionnaire.
Nearly 90 percent of respondents ranked writing as one of the top three skills essential for public relations success. However, 70 percent of the professionals rated recent graduates' …

Type 1 plasminogen activator inhibitor (PAI-1), the primary inhibitor of tissue-type plasminogen activator (t-PA), circulates as a complex with the abundant plasma glycoprotein, vitronectin. This interaction stabilizes the inhibitor in its active conformation. In this report, the effects of vitronectin on the interactions of PAI-1 with fibrin clots were studied. Confocal microscopic imaging of platelet-poor plasma clots reveals that essentially all fibrin-associated PAI-1 colocalizes with fibrin-bound vitronectin. Moreover, formation of platelet-poor plasma clots in the presence of polyclonal antibodies specific for vitronectin attenuated the inhibitory effects of PAI-1 on t-PA-mediated fibrinolysis. Digestibility, Nitrogen Excretion, And Mean Retention Time By North American Porcupines (Erethizon Dorsatum) Consuming Natural Forages, Laura A. Felicetti, Lisa A. Shipley, Gary W. Witmer, Charles T. Robbins

North American porcupines (Erethizon dorsatum) subsist predominantly on low-protein, high-fiber, high-tannin diets. Therefore, we measured the porcupine's ability to digest dry matter, fiber, and protein by conducting digestion trials on eight natural forages and one pelleted ration varying in concentration of fiber, nitrogen, and tannins. On these diets, dry matter intake ranged from 5 to 234 g/kg 0.75/d and dry matter digestibility ranged from 62% to 96%. Porcupines digested highly lignified fiber better than many large hindgut fermenters and ruminants. The porcupine's ability to digest fiber may be explained, in part, by their lengthy mean retention time …
