Like all good scholarly work, good decision making by campus leadership begins with a base of scholarly knowledge generated and validated by higher education researchers.

Nativism, Terrorism, And Human Rights—The Global Wrongs Of Reno V. American-Arab Anti-Discrimination Committee, Berta E. Hernández-Truyol

UF Law Faculty Publications

The American-Arab Anti-Discrimination Committee decision (American-Arab or AADC) is the most recent U.S. Supreme Court pronouncement regarding the intersection of immigration regulations and fundamental constitutional rights enjoyed by foreign subjects present within the United States. In American-Arab, the U.S. government commenced deportation proceedings against two legal permanent residents and six temporary visa holders on the basis of an ideological bias: the plaintiffs were alleged to be members of the Popular Front for the Liberation of Palestine (Popular Front or PFLP) — a charge all the plaintiffs denied. The Supreme Court's ruling endorsing the legality of the government's …

Mail-Order Gun Kits And Fingerprint-Resistant Pistols: Why Washington Courts Should Impose A Duty On Gun Manufacturers To Market Firearms Responsibly, Amy Edwards Jul 2000

Mail-Order Gun Kits And Fingerprint-Resistant Pistols: Why Washington Courts Should Impose A Duty On Gun Manufacturers To Market Firearms Responsibly, Amy Edwards

Washington Law Review

Plaintiffs have historically been unsuccessful in suing gun manufacturers for injuries inflicted by the criminal acts of third parties. Until recently, with one exception, courts uniformly found no basis for liability under either strict liability or general negligence claims. In three recent cases, however, courts have imposed a duty under negligent-marketing theories. These theories have yet to be tested in Washington. This Comment examines the potential viability of a lawsuit by victims of gun violence against gun manufacturers for negligent marketing in Washington. It ultimately concludes that Washington courts can and should impose a duty on gun manufacturers to refrain …

The Myth Of Property Absolutism And Modern Government: The Interacation Of Police Power And Property Rights, Philip A. Talmadge Jul 2000

The Myth Of Property Absolutism And Modern Government: The Interacation Of Police Power And Property Rights, Philip A. Talmadge

Washington Law Review

A new movement in America espousing a novel doctrine, property-rights absolutism, has gained some popular and political appeal. But the property rights absolutists tend to ignore the societal foundations of property, and especially de-emphasize the responsibilities property owners have to the community in which they live. They fail to consider properly the significance of the police power and its vital role in the American and Washington State constitutional systems. This Article debunks the newly minted mythology of the property-rights absolutists and places the police power and property rights in their proper historical perspective.

Economic Currents: The State Of The State Economy, Alan Clayton-Matthews Jul 2000

Economic Currents: The State Of The State Economy, Alan Clayton-Matthews

Public Policy and Public Affairs Faculty Publication Series

The Massachusetts economy has not fully caught up with the news that labor shortages are constraining growth. Real gross state product (GSP), as proxied by the Massachusetts Current Economic Index, grew at an annualized rate of 4.3 percent in the first quarter of 2000, only moderately below the 5.4 percent pace of U.S. gross domestic product (GDP). Employment-related measures over the twelve-month period ending in April bear this out. The number of employed Massachusetts residents increased by 1.3 percent, and the number of jobs in the state grew by 2.1 percent, matching the expansion-average annual rate of job growth. Employment …

Assets As A Measure Of Household Welfare In Developing Countries, David E. Sahn, David Stifel Jul 2000

Assets As A Measure Of Household Welfare In Developing Countries, David E. Sahn, David Stifel

Center for Social Development Research

This paper was commissioned for Inclusion in Asset Building: Research and Policy Symposium, an event hosted in September 2000 by the Center for Social Development at Washington University in St. Louis. The paper identifies and explores the use of an asset-based metric of welfare. The metric relies on assets data that are easy to collect and analyze. The authors demonstrate that the asset index functions well in identifying and profiling the poor, in targeting transfers, and even in estimating demand or production functions for outcomes that are useful for designing programs and policy.
