Multidisciplinary practices (MDPs) are a big item in legal news. State and national professional associations as well as scholars are preoccupied with the challenges to traditional legal practice. The push to revise legal institutions to allow expansion of lawyer-nonlawyer practices stems from the rapid growth and importance of large business consultancies. MDPs, however, are also an important development in reenvisioning legal practice for low and moderate income people. We are in a period of experimentation on how to provide assistance to people in dealing with law and legal institutions. Restoring What’S Environmental About Environmental Law In The Supreme Court, Richard J. Lazarus

In this Article, Professor Richard Lazarus examines the votes of the individual Justices who have decided environmental law cases before the United States Supreme Court during the past three decades. The Article reports on a number of interesting statistics regarding the identity of those Justices who have most influenced the Court's environmental law jurisprudence and the sometimes curious patterns in voting exhibited by individual Justices. Lazarus's thesis is that the Supreme Court's apparent apathy or even antipathy towards environmental law during that time results from the Justices' failure to appreciate environmental law as a distinct area of law. The constitutionality of affirmative action has now become one of the central topics in the politics of race. Ironically, the United States Constitution says absolutely nothing about affirmative action. The text never mentions the term, and the equal protection language in the Fourteenth Amendment simply begs the question of whether equality requires or precludes the use of affirmative action. The intent of the Framers is similarly unhelpful. We know that the drafters of the Fifth Amendment owned slaves, and the drafters of the Fourteenth Amendment envisioned a racially stratified society. But the Fourteenth Amendment was itself an affirmative action measure, …

Lawyers working in low income and poorly resourced communities as well as teachers and law students working in clinical programs engage, from time to time, in a style of practice known as community lawyering. The practice is premised upon the belief that one way to remedy certain types of problems in poor communities is for the community to be an integral part of the development and implementation of the solutions to those problems. "Journal Of The Branch Of The Church Of Christ In Pontiac,…1834": Hyrum Smith's Division Of Zion's Camp, Craig K. Manscill

On April 21, 1834, Hyrum Smith and Lyman Wight set out from Kirtland, Ohio, for Pontiac, Michigan, to recruit volunteers for the march of Zion's Camp. Their objective was to lead their recruits on a six-hundred-mile march to a prearranged rendezvous with Joseph Smith's Kirtland division in Missouri. Typically, scholarly treatments of the march of Zion's Camp have focused on the accounts of the Kirtland, Ohio, legion while overlooking the Hyrum Smith-Lyman Wight division of Zion's Camp. Yet Hyrum's group, when compared with Joseph's command, demonstrated a similarly significant commitment to addressing the needs of their fellow Saints in Missouri. …

The origins of accreditation in higher education began at the turn of this century, resulting from the rapid growth in number and variety of educational institutions. One of the key concerns of accreditation has been to address quality in educational experiences. Specialized accreditation of higher education programs in recreation, park resources, and leisure services has evolved over the past 20 years; however; concerns can be raised regarding the ability of the current process to adequately measure quality. A Normative Analysis Of New Financially Engineered Derivatives, Peter H. Huang

This Article analyzes whether the introduction of new derivative assets makes a society better or worse off. Because trading such non-redundant derivatives produces new distributions of income across time and over possible future contingencies, individuals can utilize such financial instruments to hedge risks not possible before the introduction of these assets. Thus, it may seem that new derivatives unambiguously benefit society. In fact, introducing sufficiently many new derivatives completes asset markets. Asset markets are complete if trading on them can attain every possible payoff pattern of wealth across time and over possible future contingencies. The first fundamental theorem of welfare …

The Spirit Of 76: Does President Clinton's Roadless Lands Directive Violate The Spirit Of The National Forest Management Act Of 1976?, Jennifer Sullivan

This Article explores the competing resource protection and production interests surrounding President Clinton's proposal to ban new road building in areas of the Tongass National Forest. The Tongass is currently exempted from a temporary moratorium on road building while the Forest Service determines whether to include the Tongass in the roadless ban. This Article analyses the current legislative framework that guides Forest System management of the Tongass and legal challenges to the roadless ban's application to the Tongass. Finally, the Author suggests a potential compromise that balances commercial and production interests.

It was the goal of the current study to investigate one debiasing technique and its ability to reduce judgmental errors. In addition, a rival hypothesis of demand characteristics was examined as a possible explanation of any findings of the reduction of judgmental errors. Participants were randomly assigned to either a control group or a debiasing group and asked to rate the likelihood of several hypothetical events in a 2 x 2 x 2 x 2 (Gender x Anxiety Group x Treatment Group x Repeated Measure) repeated measures experimental design. For a Whiteheadian such as me, Steven Goldberg's Seduced by Science: How American Religion Has Lost Its Way starts with some correct and some incorrect premises and ends, not surprisingly, with some apposite and some inapposite conclusions. The burden of Goldberg's book is to argue that American religion, rather than making the distinctive contribution to American political and social life that it can and should, has instead been derailed into addressing questions on the terms of and with the language or methods of modern science. Over the course of the last decade, the provision of health care in the United States has been undergoing a radical transformation. The days when an insurer, such as Blue Cross and Blue Shield, paid a standard fee to a physician who provided a specified service to an individual patient are passing rapidly. This fee-for-service concept, which characterized American health care from the end of World War II until the 1990s, is being supplanted by a variety of arrangements that fall under the general rubric of "managed care."
