More Sorry Than Safe: Assessing The Precautionary Principle And The Proposed International Biosafety Protocol, Jonathan H. Adler

Part I of this paper provides a brief overview of the development of biotechnology, its regulation and its use, with a particular emphasis on agricultural biotechnology. Part II outlines the United Nations Convention on Biological Diversity, which provides an international legal framework for a biosafety protocol and summarizes the results of recent protocol negotiations, such as those conducted in Cartagena, Colombia in February 1999, which continued in Montreal in January 2000. Part III explains why the proposed protocol embodies a variant of the precautionary principle and why such policies may do more harm than good. This paper concludes with some …

Subjects include environmental justice, 20th century Georgia politics, civil rights, and race relations.
The Patrick Novotny papers formerly consisted of three separate collections titled “Patrick Novotny: Where We Live, Work, and Play, Research Materials, 1973-1979,”“20th Century Georgia Politics Research Materials,” and “Contemporary Sources on the case of U.S. vs. Darby Lumber Co.” Each former collection is now listed as a series here.

Enhancing The Use Of Emergency Contraception In A Refugee Setting: Findings From A Baseline Survey In Kakuma Refugee Camps, Kenya, Esther G. Muia, Joyce Olenja
Reproductive Health
In August 1992, the International Rescue Committee (IRC) at the request of the United Nations, the United Nations High Commission for Refugees, and the Kenyan Government, initiated a primary health care program in the Kakuma Refugee Camp. Since then, the population of the camp has continued to grow, and activities have moved from a crisis to a maintenance phase. In January 1997, IRC assumed the additional responsibility of the camp hospital, bringing the entire health sector under their management. IRC's programs focus on maintaining and improving public health and promoting self-reliance, particularly of the most vulnerable communities. This project focuses …

Putting Gilmer Where It Belongs: The Faa's Labor Exemption, David E. Feller

Relying on the Federal Arbitration Act, the Supreme Court in Gilmer v. Interstate/Johnson-Lane Corp. enforced an agreement to arbitrate all disputes to prevent judicial adjudication of a claim under the Americans With Disabilities Act. That decision has led employers of millions of workers to require an agreement to arbitrate future claims of violations of all statutes protecting employment rights as a condition of getting or keeping a job. This article argues that the exemption in Section 1 of the Act of "contracts of employment of seamen, railroad employees, or any other class of workers engaged in foreign or interstate commerce" …

Duty To Rescue Through The Lens Of Multiple-Party Sexual Assault, Renu Mandhane

The lack of culpability for bystanders fails to capture the reality of the situation for sexual assault victims. It is probable that the presence of bystanders causes further psychological harm to the victim. Yet, the law allows bystanders to watch as a woman is dehumanized free from any obligation to help the victim. The lack of culpability for voyeurs is morally reprehensible and suggests that traditional sexual assault analysis is inadequate for dealing with cases of multiple-party sexual assault. It is submitted that reform within the Criminal Code is necessary to ensure culpability for such morally repugnant acts. One solution …

Community of inquiry is a ''whole" pedagogy, in that it recognizes the systemic nature of group process, the congruence of personal and social systems, and the identity-in-difference of thought and feeling, self and other, and individual and group. Above all it recognizes the fundamental urge-however tortuous and conflicted in its outworking-of both individual and social systems for self-actualizing transformation; for the chaotic passage to higher, both more inclusive and more diversified, levels of integration. Homosexuality As Contagion: From The Well Of Loneliness To The Boy Scouts, Nancy J. Knauer

In the political arena, there are currently two central and competing views of homosexuality. Pro-family organizations, working from a contagion model of homosexuality, contend that homosexuality is an immoral, unhealthy, and freely chosen vice. Many pro-gay organizations espouse an identity model of homosexuality under which sexual orientation is an immutable, unchosen, and benign characteristic. Both pro-family and pro-gay organizations believe that to define homosexuality is to control its legal and political status.
This sometimes bitter debate regarding the nature of same-sex desire might seem like an exceedingly contemporary development. However, the ex-gay media blitz of 2000 represents only the latest …
