Proposals for public service programs have long had currency in America, and may be gaining a certain millennium momentum in current public debate. While proposals for national public service programs of varying ambition and scope continue to be debated, at the local level a growing number of U.S. public school districts are implementing community service programs for high school students. Community service programs generally require students to complete a specified number of hours of service as a condition for graduation. In a typical program, a student may be required to complete forty to sixty hours of community service with organizations …

All students at the University of Richmond School of Law are required to complete a first-year course in Environmental Law, as an introduction to the strategies and technicalities of statutory and regulatory regimes. This requirement poses special pedagogical challenges for the instructors. How, for example, is the class to address pollution questions regarding diverse media? Which of the many federal and nonfederal statutory provisions deserve the most (and least attention)? Fit To Print: A Content Analysis Of The Regent Universities' Student Papers, Ivy A. Sprague

Presidential Scholars Theses (1990 – 2006)

To the best of my knowledge, this is the first comparative study conducted regarding the student publications for the three Iowa Regents' universities. The data collected shows that the three publications are not as different in terms of content as many of their readers seem to believe. As the data reflects, the Northern Iowan is significantly more campus-centered in its coverage. However, the difference is not so significant that the staff of the Northern Iowan could not increase its national and international coverage to make it more comparable to the other two newspapers. Evidence Issues In Domestic Violence Civil Cases, Jane H. Aiken, Jane C. Murphy

This article is intended to assist practitioners in anticipating and responding to some of the evidentiary challenges in civil cases in which relief is sought for the victims of domestic violence. First, expert testimony is often necessary to dispel common myths about battered women and to educate judges and juries about the dynamics of domestic violence. Recent case law, however, has limited the admissibility of "non-scientific" expert testimony and may make it difficult for practitioners to use experts in their cases. In addition, particular evidentiary issues arise when victims are pursuing both criminal and civil remedies against the batterer. This …

In this Article, we present the findings of our study on the improvement of public health law in Alaska. We examine and analyze the public health laws supporting the state's public health system. The fact that Alaska has attained statehood comparatively recently, and has a governing structure involving state, municipal, rural, and tribal entities presents unique opportunities for the State to improve its public health system and its supporting legal infrastructure

On Causation, Mari J. Matsuda

In this Essay, Professor Matsuda argues that the narrow dyadic focus of tort law perpetuates very real, and remediable, social harms. Using tort causation doctrine as her starting point, Professor Matsuda demonstrates how the tort system sacrifices human bodies to maintain the smooth flow of the economic system. Time after time, tragedies occur: school systems fail, first graders shoot each other, women live in constant fear of rape. Yet each tragedy is met with the same systematic response: those without resources, those least able to correct the harm, are considered the legal cause of the harm. The economic and corporate …

Advances in biotechnology over the last decade have created a demand for biological resources by transnational corporations. The search for biological resources has primarily focused on acquiring these resources from indigenous communities and countries of the South. However, the means by which these biological resources are obtained is exploitative and often tantamount to theft (or, as it is commonly known, biopiracy). As a result of communities attempting to prevent this theft and corporations seeking more international legitimacy for their "bioprospecting", "bioprospecting contracts" are more frequently being concluded between governments and corporations. A Study In Double Standards, Discipline, And The Disabled Student, Anne Proffitt Dupre

School violence and other school discipline issues erode trust and confidence in our public schools and inhibit students from obtaining the education necessary to participate meaningfully in our nation's democratic and political institutions. This Article examines an issue of school law that appears almost insoluble-what one judge has called the "exquisitely difficult" issue of school discipline and the disabled student. The issue is governed by the Individuals with Disabilities Education Act (IDEA, enacted in 1975), which imposes significant constraints on school authorities who wish to discipline disruptive or violent disabled students.
