Thinking About Drug Law Reform: Some Political Dynamics Of Medicalization, Fredrick Polak Jan 2000

Thinking About Drug Law Reform: Some Political Dynamics Of Medicalization, Fredrick Polak

Fordham Urban Law Journal

The article begins by stating that many people believe that medicalization offers the most reasonable approach to drug policy because it offers a dignified approach to treatment of addicts. However, it risks being a form of repression itself because it may define abstinence as the only acceptable treatment outcome. The article then explores the position of the medical profession in drug policy. It then looks at the negative political and social aspects and consequences of an abstinence-directed medicalization policy. The article concludes by stating that if abstinence is always the treatment goal then medicalization will be even less voluntary and …

State Government Cost Recovery For Electronic Information Dissemination: A Comparative Study, Donald R. Wismer Jan 2000

State Government Cost Recovery For Electronic Information Dissemination: A Comparative Study, Donald R. Wismer

CCAC Theses and Dissertations

Prior to this study, no paradigm common among state governments regarding public policy principles on cost recovery for the dissemination of public information had been described. The study revealed that U.S. federal government policy has served as a model from which a majority of the states have proceeded. This study has compared the states with the federal government and with themselves to determine the policy boundaries. Themes from in the literature were presented and summarized, and measurable elements were isolated. Data from statutory, regulatory, and case law, and from explicit policy statements, were gathered and compared within graphical formats. A …

Attention, Memory, And Self-Efficacy Differences Between Adhd And Aging Individuals, Douglas Lee Welsh Jan 2000

Attention, Memory, And Self-Efficacy Differences Between Adhd And Aging Individuals, Douglas Lee Welsh

Master's Theses

Attention and memory abilities decline with age. Although a similar pattern of attentional and memory decrement has been observed in individuals with Attention Deficit Hyperactivity Disorder (ADHD), these two populations have never been directly compared. The present study examined performance on attention, self-efficacy (SE), and memory tasks by ADHD young adults and non-ADHD younger and older adults. ADHD adults displayed lower attentional SE than both non-ADHD younger and older adults, but performed comparably to older adults on an attention task on which non-ADHD younger adults outperformed both groups. ADHD adults and older adults had lower memory SE than non-AD HD …

The Feasibility Of Developing A Computer Based Expert System To Mitigate Nuclear Power Plant Accidents, Jesse E. Smith Jan 2000

The Feasibility Of Developing A Computer Based Expert System To Mitigate Nuclear Power Plant Accidents, Jesse E. Smith

CCAC Theses and Dissertations

This study investigated the feasibility of developing a rule-based expert system to support nuclear plant operators in the mitigation of accidents. Human error in the use of Emergency Operating Procedures (EOPs) was the problem to be addressed. The goal was to determine if the Nuclear Plant Information System (NPIS) at one specific power plant would support development of an EOP operator aid to reduce the number of human errors.

A review of the literature confirmed that human error is a recurring problem. This is particularly evident during high stress situations, such as accidents. A rule-based operator aid can reduce human …

Corrective Justice And The Revival Of Judicial Virtue, Mark C. Modak-Truran Jan 2000

Corrective Justice And The Revival Of Judicial Virtue, Mark C. Modak-Truran

Journal Articles

Judges must be wise. Sound judicial reasoning requires moral virtue. These sentiments about judging have been lost. They apparently belong to a bygone era. While many advocate self-restraint or prudence as judicial virtues, moral virtue has been conspicuously absent from the list. Except for avoiding obvious vices such as bribery, favoritism, prejudice, sloth, and arbitrariness, conventional wisdom maintains that being a good judge does not require being a good person. Even theorists sympathetic to a relationship between law and morality balk at making moral virtue a prerequisite of judicial decision making. Rather, many contend that judicial decision making is a …

The Death Of Privacy, Darren W. Bax Jan 2000

The Death Of Privacy, Darren W. Bax

Theses

This thesis will focus on the issue of personal privacy and the growing threat to its existence in a technological society.

The areas most associated with privacy loss include increased government intrusions, legislation, workplace, healthcare industry, Internet, and identity theft. Chapter one provides a historical perspective beginning with primitive culture and their struggle to maintain privacy in the lives. Interesting enough, privacy protection was not mentioned by the judicial system until 1880 when privacy was defined as the "right to be left alone." To address concerns about privacy reform the Supreme Court cited this right of privacy as having " …

Deconstructing The Framers' Right To Property: Liberty's Daughters And Economic Rights, Barbara Stark Jan 2000

Deconstructing The Framers' Right To Property: Liberty's Daughters And Economic Rights, Barbara Stark

Hofstra Law Review

Deconstruction is a method for exposing hidden assumptions, that which is taken for granted, unquestioned. This Article draws on this method first to explain how the right to property, as understood by the Framers, became the hidden, unquestioned assumption of the Bill of Rights. Second, this Article draws on deconstruction to "unpack" the right to property to reveal the lesser-subsumed economic rights it takes for granted. It argues that the right to property and economic rights are iterations of the same rights, from the perspectives of the "haves" and the "have-nots," respectively. Recent work by women's historians makes it possible …

The Legal Construction Of Adolescence, Elizabeth S. Scott Jan 2000

The Legal Construction Of Adolescence, Elizabeth S. Scott

Hofstra Law Review

Two features of the legal regulation of childhood seem troublesome, but ultimately contribute to sensible policies in most contexts. First, the boundary between childhood and adulthood varies in different policy domains, through a regime of age grading under which elementary school students are deemed adults for some legal purposes, while, for other purposes, college students are children. Second, the transitional stage of adolescence is virtually invisible, because, for most purposes, law makers employ binary categories, classifying adolescents as either children or as adults. This framework - a series of legislative bright line rules, arrayed around a presumptive age of majority …

Rising Wage Inequality: The 1980s Experience In Urban Labor Markets, Thomas Hyclak Jan 2000

Rising Wage Inequality: The 1980s Experience In Urban Labor Markets, Thomas Hyclak

Upjohn Press

Hyclak analyzes information not utilized in previous studies of wage inequality. Whereas researchers previously relied on data derived from the national labor market, Hyclak draws on data from the Area Wage Surveys (AWS), which allows him to focus on changes in the wage structure in a sample of 20 local labor markets for the period of 1974 to 1991. This source also allows him to examine changes in the structure of wages paid for some 40 different jobs found in four different occupational groups. In addition, Hyclak is able to concentrate on jobs and the skills required as the primary …

Gender Politics In Global Governance (Mary K. Meyer & Elisabeth Prügl Eds., 1999), Berta E. Hernández-Truyol Jan 2000

Gender Politics In Global Governance (Mary K. Meyer & Elisabeth Prügl Eds., 1999), Berta E. Hernández-Truyol

UF Law Faculty Publications

Prof. Hernández-Truyol reviews the book Gender Politics in Global Governance from editors Mary K. Meyer and Elisabeth Prügl. Given the emergence of multilateral institutions in this century, the mobilization of women against "male supremacy" has taken an internationalist turn; it seeks to shape "the agendas of international organizations and the normative practices of global governance." In an effort to understand and analyze this movement and its impact, the editors have compiled a volume drawing new research together exploring gender politics in global governance that is also "attentive to historical and contemporary modes of women's organizing from the local to the …

Lawsuits Against The Gun Industry: A Comparative Institutional Analysis, Timothy D. Lytton Jan 2000

Lawsuits Against The Gun Industry: A Comparative Institutional Analysis, Timothy D. Lytton

Faculty Publications By Year

I argue that the tort system can complement the efforts of either institutions such as markets, legislatures and administrative agencies to make public policy. Solving complex social problems typically requires the cooperation of several policymaking institutions, each with its own strengths and weaknesses. My examination of lawsuits against the gun industry reveals that the tort system can and should play an active policymaking role in reducing gun violence.

Informed Consent Law And The Forgotten Duty Of Physician Inquiry, Robert Gatter Jan 2000

Informed Consent Law And The Forgotten Duty Of Physician Inquiry, Robert Gatter

All Faculty Scholarship

Courts and commentators have forgotten that embedded in the duty of physicians to obtain a patient's informed consent is a prior obligation for physicians to get to know that patient. This is most clear in jurisdictions employing the reasonable person standard of disclosure. That standard requires physicians to disclose to a patient information that a reasonable person would want to know if that person were in the patient's position or, more precisely, if that person were "in what the physician should know to be the patient's position." Thus, a physician must learn some minimal information about each patient's "position." An …

Case Studies Of Children's Social And Emotional Adjustment At School After The Permanent Separation Of Their Parents, Gillian Kirk

Theses : Honours

The number of children who have experienced the separation of their parents is constantly rising. An increasing amount of children arc entering classrooms contending with their day-to-day stressors as well as the stress originating from then home lives. Many of these children are not prepared with the knowledge or understanding of their stressor, nor are they equipped with strategies that would help them deal with stress. Observations and interviews were conducted with four children who had experienced the separation and divorce of their parents over a period of six months. As the data for this study needed to be rich …

The Changing American Family: A Reevaluation Of The Rights Of Foster Parents When Biological Parental Rights Have Been Terminated, Cassandra S. Haury Jan 2000

The Changing American Family: A Reevaluation Of The Rights Of Foster Parents When Biological Parental Rights Have Been Terminated, Cassandra S. Haury

Georgia Law Review

During the past twenty years, the American ideal of the traditional nuclear family made up of heterosexual parents and their children has been increasingly replaced by a number of new and unconventional family systems. Although many of these novel family systems have received recognition by the courts, foster families have been consistently denied legal rights to the children that they raise. Due to the reality of changing dynamics in family systems in the United States, and the failure of the present foster care system, the judicial system needs to reevaluate its denial of foster parents' due process rights. This Note …

Implementing A Virtual Reality Paradigm In Human Anatomy/Physiology College Curricula, Helen St. Aubin

CCAC Theses and Dissertations

Modes of instruction in the college course called Human Anatomy/Physiology are changing. Due to ethical concerns and the ever-increasing source of new physiological data, there is a need for enhancements to assist the instructor and student. The computer science of virtual reality (VR) provides a method to electronically educate, train, prototype, and test and evaluate new enhancements to the college curricula. This study detailed the modeling and simulation of a skeletal human hand with degrees of freedom of movement, which provided the students with a physiological representation of some of the movements of the hand. The primary objectives of the …
