We Also Marched: The Women And Children Of Zion's Camp, 1834, Andrea G. Radke
BYU Studies
"All victory and glory is brought to pass unto you through your diligence, faithfulness, and prayers of faith" (D&C 103:36). On February 24, 1834, Joseph Smith received this promise for the members of the Zion's Camp expedition. Further, the assurance came that "my [the Lord's] presence shall be with you.... Let no man be afraid to lay down his life for my sake; for whoso layeth down his life for my sake shall find it again" (D&C 103:26-27). Certainly the expedition to Missouri in 1834 held terrible possibilities for danger, sickness, and violence. Nevertheless, spiritual blessings were promised to those …

The effect of the intravenous injection of amitraz (0.1 mg/kg) to horses on cardiac activity, respiratory rate, intestinal motor activity, rectal temperature, sweating and masticating was evaluated and compared to the effect of intravenous administration of xylazine (1mg/kg, iv) on heart rate, respiratory rate and intestinal activity. Amitraz caused a significant decrease in heart activity, respiratory rate and intestinal movements, but these effects were not as pronounced as those caused by xylazine. Amitraz also caused a significant relaxation of the rectal smooth muscle, and an apparent increase in sweating and in the frequency of horses found masticating hay. Rectal temperature …
A First Amendment Compass: Navigating The Speech Clause With A Five-Step Analytical Framework, Kevin F. O'Neill
A First Amendment Compass: Navigating The Speech Clause With A Five-Step Analytical Framework, Kevin F. O'Neill
Law Faculty Articles and Essays
This Article is designed to serve as a First Amendment “compass,” explaining the Speech Clause while offering a systematic method for analyzing any claim asserted under it. The need for this Article stems from the fact that First Amendment law is more than ever a labyrinth. For students, lawyers, and judges alike, it is difficult even to identify--much less to distinguish and apply-- the various strands of applicable precedent. This is because the Supreme Court has developed a dense mass of overlapping doctrines: drawing distinctions between content-based1 and content-neutral restrictions; drawing further distinctions between fully-protected and “low-level” categories of expression; …
Princes Of Darkness And Angels Of Light: The Soul Of The American Lawyer, David R. Barnhizer
Princes Of Darkness And Angels Of Light: The Soul Of The American Lawyer, David R. Barnhizer
Law Faculty Articles and Essays
The increasing belief among many lawyers that life is comprised of "fear and greed and money" has altered the legal profession and helped make lawyers into one of the most feared and powerful groups in American society - and one of the most scorned. In the midst of the widespread contempt American society is showing lawyers, this article seeks to explain the special role the legal profession serves in our complex democracy. At the same time it condemns attitudes such as those reflected in Fritts' statement. The belief that life is driven by fear, greed, and money has created a …
The Dilemma Of Old, Urban Neighborhoods, W Dennis Keating
The Dilemma Of Old, Urban Neighborhoods, W Dennis Keating
Law Faculty Articles and Essays
In his recounting of the suburban migration from America's cities, journalist and broadcaster Ray Suarez laments the loss of the "old neighborhood". He extols its virtues while explaining its decline. Suarez's nostalgic examples recall the virtues of the extended family kinship, neighborliness, and other features of the "urban village." These are often associated with those urban neighborhoods populated by recent immigratns. These urban villages were thought to have peaked in the decades between the American Civil War and the onset of the First World War, when many U.S. cities industrialized and grew very rapidly. However, a continuing movement of migrants …
Extending Copyright And The Constitution: "Have I Stayed Too Long", Michael H. Davis
Extending Copyright And The Constitution: "Have I Stayed Too Long", Michael H. Davis
Law Faculty Articles and Essays
On October 27, 1998, President Clinton signed into law the Sonny Bono Copyright Term Extension Act of 1998, Pub. L. No. 105-298, 112 Stat. 2827 (hereinafter the “Bono Law”). The Bono Law extended the term of copyright protection by an additional twenty years, both prospectively and retrospectively. The former is probably constitutionally proper; the latter is almost certainly forbidden by the Constitution's copyright clause. But most criticism5 has not forcefully distinguished between retrospective as opposed to prospective extension and so far has failed to convince either Congress or the courts of any constitutional infirmity. This is because most critics agree-or …
Sexual Harassment In The Workplace: How Arbitrators Decide , Mollie H. Bowers, E. Patrick Mcdermott
Sexual Harassment In The Workplace: How Arbitrators Decide , Mollie H. Bowers, E. Patrick Mcdermott
Cleveland State Law Review
For thirty years courts and labor arbitrators have grappled with what constitutes sexual harassment and how to remedy such behavior. The Federal judiciary has developed case law on sexual harassment under Title VII of the Civil Rights Act of 1964. However, arbitrators addressing this issue under collective bargaining agreements have often treated similar fact patterns differently than jurists. In contrast, labor arbitrators decide culpability first, and then consider the appropriate remedy. In reconciling these separate paths for establishing standards of workplace conduct, the authors will provide a model that explains how arbitrators decide sexual harassment cases and how this model …
Death Taxes: A Critique From The Margin, Patricia A. Cain
Death Taxes: A Critique From The Margin, Patricia A. Cain
Cleveland State Law Review
The proper taxation of the family under both the income tax and the estate tax has been debated for ages. It is an old issue. My purpose, however, is to consider the issue from a perspective somewhat different from that of those who have debated the issue over the years. My perspective is the perspective of the marginalized taxpayer. I critique from this perspective to see if it can tell us anything new about the old debate and to ensure that the ultimate tax treatment is just as to all taxpayers. The estate tax is supposed to be a tax …

Scenario Building: A Suitable Method For Strategic Construction Industry Planning?, John Ratcliffe
Articles
This paper is primarily about the Scenario Method. How scenario building, planning or learning exercises can profitably be used to identify, develop and test alternative plans, policies and practices that might be proposed in exploring and preparing for strategic decision-making in the construction industry. The method has been widely used in business, industry and government for over thirty years as an unrivalled technique to learn about the future before it happens. The paper examines the principles, practice and pitfalls of Scenario Building with the prime aim of presenting the technique as one singularly relevant to the study of the construction …

Scenario Building: A Suitable Method For Strategic Property Planning?, John Ratcliffe
Articles
The scenario method has been widely used by decision-makers in business, industry and government for over thirty years as an unrivalled technique to learn about the future before it happens. This paper examines the principles, practice and pitfalls of scenario building with the prime aim of presenting the technique as one singularly relevant to the study of future property investment, development and management decisions and land use policy formulation. The origins of the approach from its military based beginnings, through the popularised global environmental applications to the current widescale use by industry and commerce are traced. Some definitions are advanced …

A Different Kind Of Sameness: Beyond Formal Equality And Antisubordination Strategies In Gay Legal Theory, Nancy Levit
A Different Kind Of Sameness: Beyond Formal Equality And Antisubordination Strategies In Gay Legal Theory, Nancy Levit
Faculty Works
Gay legal theory is at a crossroads reminiscent of the sameness/difference debate in feminist circles and the integrationist debate in critical race theory. Formal equality theorists take the heterosexual model as the norm and then seek to show that gays, lesbians, bisexuals, and transsexuals - except for their choice of partners - are just like heterosexuals. Antisubordination theorists attack the heterosexual model itself and seek to show that a society that insists on such a model is unjust. Neither of these strategies is wholly satisfactory. The formal equality model will fail to bring about fundamental reforms as long as sexual …
Concluding Thoughts: Bioethics In The Language Of The Law, Carl E. Schneider
Concluding Thoughts: Bioethics In The Language Of The Law, Carl E. Schneider
Book Chapters
What happens when the language of the law becomes a vulgar tongue? What happens, more particularly, when parties to bioethical disputes are obliged to borrow in their daily controversies, the ideas, and even the language, peculiar to judicial proceedings? How suited are the habits and tastes and thus the language of the judicial magistrate to the political, and more particularly, the bioethical, questions of our time? We must ask these questions because, as the incomparable Tocqueville foresaw, it has become American practice to resolve political—and moral—questions into judicial questions. We now reverently refer to the Supreme Court as the great …
Information, Decisions, And The Limits Of Informed Consent, Carl E. Scheider, Michael H. Farrell
Information, Decisions, And The Limits Of Informed Consent, Carl E. Scheider, Michael H. Farrell
Book Chapters
For many years, the heart's wish of bioethics has been to confide medical decisions to patients and not to doctors. The favoured key to doing so has been the doctrine of informed consent. The theory of and hopes for that doctrine are well captured in the influential case of Caterbury v. Spence: '[t]rue consent to what happens to one's self is the informed exercise of a choice, and that entails an opportunity to evaluate knoledgeably the options available and the risks attendant upon each'.
The Financial And Operational Performance Implications Of Compensation Practices: A Study Of Relative Wage Practices And Pay Structures., Mark Patton Brown
The Financial And Operational Performance Implications Of Compensation Practices: A Study Of Relative Wage Practices And Pay Structures., Mark Patton Brown
LSU Historical Dissertations and Theses
This research examines the organizational performance implications of relative wage strategies and pay structures. Organizations' relative wage strategies and pay structures are key characteristics useful in describing and delimiting various compensation systems, and are therefore particularly relevant for evaluation at the organizational level. The organizational performance implications of organizations' relative wage strategies and pay structures are investigated in terms of both operational and financial indicators of organizational performance. Initially, relevant theory and past research on relative wage strategies and pay structures are discussed. Following this, hypotheses are developed that predict the operational and financial performance implications of pay structures and …

LSU Historical Dissertations and Theses
The main research focus of this study was on the regional differences in understanding of two groups of high school science students for a complex environmental scientific phenomenon known as the Dead Zone of the Gulf of Mexico. Participating high school students were drawn from Dead Zone source and effect areas---Iowa chemistry students and Louisiana environmental science students. Students were given a pre- and postinstructional survey concerning environmental issues---including the issue of the Dead Zone or hypoxia of the Gulf of Mexico. The treatment group visited a web site on the Dead Zone constructed for this study, and interacted with …

On The Meaning And Impact Of The Physician-Assisted Suicide Cases, Yale Kamisar
Book Chapters
I read every newspaper article I could find on the meaning and impact of the U.S. Supreme Court's June 1997 decisions in Washington v Glucksberg and Vacco v Quill. I came away with the impression that some proponents of physician-assisted suicide (PAS) were unable or unwilling publicly to recognize the magnitude of the setback they suffered when the Court handed down its rulings in the PAS cases.
