Conceptions Of Fairness And The Fair Labor Standards Act, Seth D. Harris Jan 2000

Conceptions Of Fairness And The Fair Labor Standards Act, Seth D. Harris

Hofstra Labor & Employment Law Journal

This article uses the history of the Fair Labor Standards Act's minimum wage provisions to examine how statutes that benefit interests that are comparatively weak in the political market become law. The article tracks the history of the American debate over fairness in wages beginning with the demise of slavery through the passage of the Fair Labor Standards Act in 1938 in search of an answer. The search yields two answers. The first answer is that bargaining power is dynamic, not static. The article discusses the socio-economic crises and effective political advocacy by living wage proponents that changed the political …

Examining Counseling Strategies For African American Adolescent Crack Abusers, Paula Reed Dorris

Graduate Research Papers

The author of this paper has addressed the significance of the development of treatment strategies to implement with African American adolescent crack addicts. An integral basis for tailoring culturally specific treatment approaches for African American adolescents relates to the unique circumstances, which may promote more extensive crack abuse by this group. Depression was the difficulty which the author chose to focus upon. Several different methods of helping these adolescents are discussed. The intervention strategies which show promise in helping African American adolescent crack addicts include: (a) Interpersonal Therapy; (b) psycho-educational programs; (c) involvement of family members in treatment; (d) use …

Existential Mental Health Implications For Kin-Caregivers Of Alzheimer's Victims, Brock K. Knoll Jan 2000

Existential Mental Health Implications For Kin-Caregivers Of Alzheimer's Victims, Brock K. Knoll

Graduate Research Papers

The purpose of this paper is to briefly outline assessment and progression of Alzheimer's disease (AD) in afflicted individuals (i.e., care recipients [CRs]) and review relevant research concerning the effects of AD progression on caregivers (CGs) as they care for loved ones. With this background, consideration will be made of how these findings suggest relevant tenets of Existential therapy. The author will also identify implications that could be meaningful to mental health professionals in their efforts to assist CGs as they attempt to cope with the emotional impact this disease has on them during caregiving and after the eventual death …

Labor Rights, Globalization And Institutions: The Role And Influence Of The Organization For Economic Cooperation And Development, James Salzman

Michigan Journal of International Law

This Article has four sections. The first recounts the history of the OECD, from its creation as the overseer of the Marshall Plan to its current prominence as global economic analyst, and explains its operations. The second section explores its influence on the development of labor rights, examining the well-known OECD Guidelines for Multinational Enterprises, publications on trade and labor by the Employment, Labor and Social Affairs Directorate, and the events surrounding South Korea's accession to the OECD. Each of these activities, though quite different from one another (and, in combination, very different from the activities of other IGOs), provided …

The Standard Pollution Exclusion Clause In Commercial General Liability Insurance Policies Bars Coverage For Personal Injuries Resulting From On-Site Exposure To Pollutants Discharged Within A Construction Envelope: Madison Construction Co. V. Harleysville Mutual Insurance Co., Bryan C. Devine Jan 2000

The Standard Pollution Exclusion Clause In Commercial General Liability Insurance Policies Bars Coverage For Personal Injuries Resulting From On-Site Exposure To Pollutants Discharged Within A Construction Envelope: Madison Construction Co. V. Harleysville Mutual Insurance Co., Bryan C. Devine

Duquesne Law Review

The Pennsylvania Supreme Court held that the standard pollution exclusion clause in commercial general liability policies, which bars coverage for the discharge of pollutants, is clear and unambiguous on its face, thereby requiring application of the clause's plain and ordinary meaning to bar coverage for personal injuries caused by exposure to fumes discharged by a useful product within a construction envelope.

Madison Construction Co. v. Harleysville Mutual Insurance Co., 735 A.2d 100 (Pa. 1999).

Modelling Professional Practice In Music Analysis With Computing, David Walker, William Renwick

Journal of Music Theory Pedagogy

The Problem - There is often a difficult and confusing gap between graduate school and beginning professional practice. After spending years in the culture of schooling, new graduates can find the challenges of the workplace baffling and stressful. University educators have begun to address this, forging links between the classroom and the "real" world. While many of these studies are exploratory in nature, Collins (1992) has pointed out that by sharing the results of such "design experiments" can we can begin to found a design science of education.

G00-1404 Radon In Nebraska Homes: Healthy Indoor Air For Healtlhy Nebraskans (Revised October 2003), Rebecca L. Versch, Shirley Niemeyer Jan 2000

G00-1404 Radon In Nebraska Homes: Healthy Indoor Air For Healtlhy Nebraskans (Revised October 2003), Rebecca L. Versch, Shirley Niemeyer

University of Nebraska-Lincoln Extension: Historical Materials

Radon is a colorless, odorless, radioactive gas emitted from uranium, a naturally occurring mineral in rocks and soil. Normally, radon rises up through the soil and then dissipates in the air outside. Radon becomes a concern, however, when it seeps in through openings such as cracks, loose-fitting pipes, sump pits, dirt floors, slab joints, or block walls and accumulates in the home.

This publication will help householders understand radon — what it is, its effect on heatlh, how to test for it, and some remodeling or new building techniques that can reduce radon levels in the home.

Saint Benedict’s Monastery Books

In With Lamps Burning, Sister Grace McDonald traced the growth of Saint Benedict’s Monastery from its establishment in Minnesota in 1857 to its centennial in 1957. It is the purpose of this sequel to capture the exciting and often troublesome challenges that faced this community in the last half of the twentieth century. It is a story of moving from a stable and predictable era to an explosive era of expanded knowledge, information, and communications that resulted in irreversible societal changes effected by such grassroots movements as civil rights, women’s rights, and environmental concerns, and by a Christian religious …
