Competition, Cooperation Or Cartel: A National Law School Accreditation Process For Canada?, Alvin Esau
Competition, Cooperation Or Cartel: A National Law School Accreditation Process For Canada?, Alvin Esau
Dalhousie Law Journal
Law schools in Canada are engaged in increased competition with one another and significant disparities in resources and reputations have developed. The author argues that this competitive context may be a threat to the maintenance in some schools of the broader mission of the law school to teach and produce contextual and critical perspectives on law. It is suggested that Canadian law schools should cooperate with each other and that various initiatives could be taken which would help all schools. Beyond cooperation on specific projects, the authorraises the question of whetherlawschools should set up theirown national accreditation scheme. He suggests …

A Brief Intervention For Promoting Health And Wellness: A Holistic (Multidimensional) Approach Based Upon Principles Of Individual Systems Theory, Wayne Chappelle
Doctor of Psychology (PsyD)
This study examined the effects of a 12-week holistic (mult1dimensional) group intervention for promoting health and wellness. A total of 42 young adults (21 males and 21 females) with an average of 18.63 (ill= 1.03) years of age participated in the study. Participants were from a private university in the Pacific Northwest and randomly assigned to: a health-wellness group, a self-help group, and a no-treatment control group. Participants in the self-help group were encouraged to monitor and improve their health in various life dimensions on their own, utilize existing health care resources if necessary, and to report to the researcher …

Reconciling Trade And Environment: A Legal Analysis Of European And North American Approaches, Bradly J. Condon
Reconciling Trade And Environment: A Legal Analysis Of European And North American Approaches, Bradly J. Condon
Cardozo Journal of International and Comparative Law
The article examines the differing approaches of the European Union (EU) and the North American Free Trade Agreement (NAFTA) in reconciling trade liberalization with environmental protection. While the EU employs a proportionality principle that prioritizes environmental protection over trade in cases of conflict, NAFTA uses a least-trade-restrictive principle to balance these interests. The analysis highlights that both systems reflect distinct political, economic, and legal frameworks but could benefit from learning each other's strengths and addressing their respective weaknesses.

Culture, Nationhood, And The Human Rights Ideal, Berta Esperanza Hernández-Truyol, Sharon Elizabeth Rush
Culture, Nationhood, And The Human Rights Ideal, Berta Esperanza Hernández-Truyol, Sharon Elizabeth Rush
University of Michigan Journal of Law Reform
This Symposium on nation and culture illustrates these LatCrit goals and advances them. The two main works and the commentaries on them are rich explorations and representations of the voices and concerns of LatCrit theory. This Foreword engages all the works by focusing on the concept of voice and silence. Part I locates the works in the axis of silence and power. Part II explores how critical theory and international human rights norms can be used to develop a progressive methodology to analyze and detect the exclusion or silencing of myriad voices. This Part develops a LatCritical Human Rights paradigm …
Social Factors Related To Recovery After Hip Fracture, Debra Lindstrom Hazel
Social Factors Related To Recovery After Hip Fracture, Debra Lindstrom Hazel
Dissertations
Objectives. The relationship between social variables and performance of instrumental activities of daily living (IADL) was examined in participants three to nine months after they experienced a hip fracture. All participants were over the age of 60 and living in their own homes before and after their hip fractures.
Method. This study employed both qualitative and quantitative methods. There were 19 participants in the quantitative portion of the study that compared three subjectively rated questionnaires with an objectively rated IADL scale. The independent variable, subjective scales were: (1) Antonovsky’s “Orientation to Life” Scale, which measures the sense of coherence, (2) …
Molecular Taxonomy Of The Lichen Genus Heterodermia, Linda Hirschberger
Molecular Taxonomy Of The Lichen Genus Heterodermia, Linda Hirschberger
Seton Hall University Dissertations and Theses (ETDs)
Heterodermia is lichen consisting of a fungus and algae. Morphology and chemistry cannot provide definitive evidence for the identity of Heterodermia because various species have very similar morphologies that cannot always be distinguished. Other species only differ by the presence or absence of secondary chemicals detected. by specific chemical tests, which makes distinguishing between two species difficult. The objective of this project is to use Restriction Fragment Length Polymorphisms (RFLPs) to determine how closely related each Heterodermia species is to one another. RFLPs will also be used to determine how closely related a species is to its equal in another …

Wavelength Modulation Spectroscopy Of Water Vapor And Line Center Stabilization At 1.462 Μm For Lidar Applications, Colleen Marie Fitzgerald
Wavelength Modulation Spectroscopy Of Water Vapor And Line Center Stabilization At 1.462 Μm For Lidar Applications, Colleen Marie Fitzgerald
Electrical & Computer Engineering Theses & Dissertations
Wavelength modulation spectroscopy was employed to investigate water vapor absorption lines in the 1.462 µm wavelength region using an external-cavity diode laser. These measurements were necessary in the development of a lidar (light detection and ranging) instrument for differential absorption measurement of the concentration and movement of water vapor in the Earth's atmosphere. Differential absorption measurements require that the laser frequency remain stable throughout the duration of the measurement. To ensure this stability, the laser output wavelength is monitored and a feedback control loop set up to minimize laser line drift. Three lines were investigated in the 1.462 µm region. …

Textualism's Failures: A Study Of Overruled Bankruptcy Decisions, Daniel J. Bussel
Textualism's Failures: A Study Of Overruled Bankruptcy Decisions, Daniel J. Bussel
Vanderbilt Law Review
Judges and legal scholars are engaged in a contentious, wide- ranging, and long-running debate over methods of statutory interpretation. Stripping the debate of some of its nuance without misrepresenting its essence, there are two camps: the "textualists" and the "pragmatists." Cass Sunstein recently argued that the question of interpretive method should be considered in light of evidence whether textualist methods work better or worse than pragmatic ones. To date, however, only limited empirical evidence has been systematically brought to bear on this question.
This Article presents new empirical evidence gleaned from twenty years of interpretation of the United States Bankruptcy …

Multiple Source Pools And Dispersal Barriers For Galápagos Plant Species Distribution, J. Alan Yeakley, John F. Weishampel
Multiple Source Pools And Dispersal Barriers For Galápagos Plant Species Distribution, J. Alan Yeakley, John F. Weishampel
Environmental Science and Management Faculty Publications and Presentations
We reexamined geographic factors explaining the number of plant species on islands in the Galápagos Archipelago. We hypothesized that plant species richness (S) was related to the number of source pools and that plant species dispersal preferentially followed direct, oceanic pathways. To test different dispersal pathways from multiple source pools, the total number of islands within a given dispersal radius (i) was posed as the sum of the number of line-of-sight islands (Ci) and of the number of islands without line-of sight connection (Bi). In partial regression analyses, controlling for nearest island area (A2) …

Literary And Poetic Performance In Plato's Laws, Gerard Naddaf
Literary And Poetic Performance In Plato's Laws, Gerard Naddaf
The Society for Ancient Greek Philosophy Newsletter
Plato’s evaluations of the written and spoken word are complex, even ambiguous. On the one hand, he clearly privileges the give-and-take oral conversation as the paradigm for philosophical discussion, and on the basis of this paradigm he offers strong critiques of the written word, notably in the Phaedrus and Letter 7. On the other hand, he is a most famous enemy of the oral performance of poetry − notwithstanding the fact that in the Republic he gives ‘music’ a prominent place in education. When we turn to the Laws, we encounter another aspect or dimension of Plato’s thinking about the …

Effects Of The Zebra Mussel On Nitrogen Dynamics And The Microbial Community At The Sediment-Water Interface, Peter J. Lavrentyev, Wayne S. Gardner, Longyuan Yang
Biology Faculty Research
A flow-through experiment was conducted on intact cores of sediments from Saginaw Bay, Lake Huron, to examine how trophic interactions between filter-feeding bivalve mussels and microbial populations could affect nitrogen dynamics at the sediment-water interface. The zebra mussels used in this experiment removed a large proportion of protozoa and phytoplankton from the overlying water, particularly heterotrophic nanoplankton (up to 82%), while bacterial populations showed less change. A 3-fold decrease in the protozoan to bacterial carbon ratio corresponded to a 2.5-fold increase in relative ammonium removal rates as estimated from the dark loss of N-15-ammonium. Excretion by the bivalves also increased …
