Reforming State Brownfield Programs To Comply With Title Vi, Bradford Mank

Many states have adopted voluntary action programs to encourage developers to clean up and redevelop brownfields, former industrial or commercial facilities that have some environmental contamination. While brownfields redevelopment often has important benefits, states often allow cleanups that are less stringent than would otherwise be required and that raises the possibility that redevelopment could pose health risks to neighboring residents. Because many brownfield sites are located in areas with significant minority populastions, there is the potential for disproportionate impacts against these groups. If disparate impacts occur, states are arguably liable under Title VI of the 1964 Civil Rights Act. The …

Back To The Garden: The Redemptive Promise Of Sustainable Forestry, 1893-2000, Char Miller

As we struggle at the turn of the century to define and implement “sustainable forestry”— the next stage in the evolution of forest management in North America and the world—it is important to realize that its components have strong roots in the forestry profession. This article examines the relationship of forests and forestry with social equity issues during the last century. In the end, the author leaves us with a question: can sustainable forestry as we understand it today lead to conflict resolution? If not, what lies beyond sustainable forestry?

International Human Rights, International Humanitarian Law, And Environmental Security: Can The International Criminal Court Bridge The Gaps?, Mark A. Drumbl

The gap between international humanitarian law and environmental security should trouble international lawyers. Just as armed conflict often creates a context in which the most serious human rights abuses occur, so too, does it create a similar context for the infliction of wanton and extensive destruction to the environment. This destruction creates profound environmental insecurity. Part (II) of this Article explores the insecurities caused by the environmental consequences of armed conflict. Although the international community has shown considerable concern for the humanitarian consequences of war, it has been significantly more hesitant in accounting for war's environmental consequences. This Final Environmental Impact Statement (EIS) assesses the environmental consequences of a federal decision to offer a federal coal tract located in southeastern Campbell County and northeastern Converse County, Wyoming for lease at a competitive, sealed bid sale, subject to standard and special lease stipulations. The Horse Creek Lease By Application (LBA) Tract as applied for by Antelope Coal Company includes approximately 2,840 acres containing approximately 356.5 million tons of federal coal. Antelope Coal Company operates the adjacent Antelope Mine and proposes to mine the Horse Creek LBA Tract as a maintenance tract for the existing mine, if a lease …

Both the Pinedale Resource Area Resource Management Plan and the Green River Resource Area Resource Management Plan provide for the use of these public lands for oil and natural gas development. The Proposed Action would be in conformance with these land use plans, and no amendments to the RMPs would be necessary to implement the Proposed Action.

Vincent Saldanha thanked the participants for attending the conference. He noted that it is also an uncomfortable situation to presume to speak on behalf of the poor, as the poor are neither voiceless nor invisible. He noted, however, that the discussions over the previous days were devoid of arrogance and patronage. He went on to note that, despite the many international perspectives presented at the conference, there were a great deal of commonalities between the issues facing those who provide legal services for indigent populations. Toward The Restorative Constitution: A Restorative Justice Critique Of Anti-Gang Public Nuisance Injunctions, Joan W. Howarth
UC Law Constitutional Quarterly
The use of public nuisance injunctions against gangs and suspected gang members is an aggressive prosecutorial strategy upheld and even endorsed by a majority of the California Supreme Court in 1997 in People ex rel. Gallo v. Acuna. This Article critiques these injunctions through the lens of restorative justice principles. Restorative justice rests on the tenet that any crime is injurious, and that the best response is one that heals injuries caused to the victim, the community, and the offender. The Article argues that although anti-gang public nuisance injunctions share significant similarities with some restorative justice programs, the injunctions undermine …

Crafting Multicultural Science Education With Preservice Teachers Through Service-Learning, Angela Calabrese Barton
Higher Education
Many science educators, in the US and elsewhere, support the idea that all students should have fair and equal opportunities to become scientifically literate through authentic, real problem-based science education. However, this challenge requires teachers to find ways to help all students feel comfortable with, and connected to, science. Despite the general consensus around the ideal of science for all, science teacher education programmes have had little or no impact on pre-service teachers’ philosophies of teaching and learning, especially as it relates to serving under-served populations in science. In this paper, I explore community service-learning as one way of addressing …
