[Excerpt] "In the United States, as in other countries, public participation in environmental policy decisions has come a long way. In its infancy, it was limited to public hearings concerning decisions that were, for all practical purposes, "done deals." Overturning public agency decisions could be accomplished only through expensive, often protracted, usually futile court cases, and then only if the issue was justiciable and the plaintiff had the funds and standing to sue. In recent decades - especially since the 1960s - opportunities for public participation in the U.S. have been overhauled. Access to documents has been assured through federal …

Risk Equity, W. Kip Viscusi

Vanderbilt Law School Faculty Publications

Risk equity serves as the purported rationale for a wide range of inefficient policy practices, such as the concern that hypothetical individual risks not be too great. This paper proposes an alternative risk equity concept in terms of equitable tradeoffs rather than equity in risk levels. Equalizing the cost per life saved across policy contexts will save additional lives and will give fair treatment to risks arising in a variety of domains. Equitable tradeoffs will also benefit minorities who currently are disadvantaged by politically based inefficient policies.

Richmond Public Transportation Study Report, Lenahan O'Connell, Bruce Siria

Kentucky Transportation Center Research Report

This study looked at the possible costs and benefits associated with the creation of a small deviated fixed route bus service in Richmond. It concluded that the circumstances in Richmond favor the creation of such a system. It also concluded that only one route–operating one bus, twelve hours per day, Monday through Saturday–is needed at this time.

As the regulatory reform movement slows, a new strategy, focusing on the shortcomings of the basic regulatory statutes, is needed. Congress should establish an independent Congressional Office of Regulatory Analysis to credibly assess the costs and benefits of proposed congressional regulation legislation.

The Case Against Private Disparate Impact Suits, Thom Lambert

Faculty Publications

This article argues that the Third Circuit, and the courts that have implicitly approved private disparate impact suits, have erred in construing Title VI to permit private plaintiffs to sue federally funded entities for discrimination based on disparate impact alone. From a policy standpoint, permitting private disparate impact suits is a bad idea, for the threat of such suits will lead to deterrence of actions and decisions that have incidental disparate effects but are, on the whole, good.
