Currencies And The Commodification Of Environmental Law, J.B. Ruhl, James Salzman
Vanderbilt Law School Faculty Publications
The success of several environmental trading markets (ETMs) has led to proposals for broader use of ETMs in environmental and resource management policy. The successful ETMs all share a basic feature-they exchange units of trade that are fungible, such as tons of sulfur dioxide or kilos of fish. This feature of trading promotes resource allocation efficiency while advancing environmental protection. But most commodities exchanged in current and proposed ETMs, such as wetlands and endangered species habitat, exhibit nonfungibilities across the dimensions of type, time, and space. Using ETMs to trade these commodities is no longer trading "environmental apples for apples," …

The this report addresses the feasibility of developing an Eco-Industrial Park (EIP) on the Pier 90-94 Baeklands site adjacent to the Bay View Hunters Point area of San Francisco. The Eco-Industrial Park concept is a new paradigm of Industrial Ecology, in which, an industrial system of planned materials and energy exchanges occurs, creating sustainable economic, ecological and social relationships. Communities like Hunters Point suffering from severe economic distress and Environmental Justice issues can potentially alleviate environmental and economic degradation through the development of an EIP. Expanding The Use Of Environmental Trading Programs Into New Areas Of Environmental Regulation, Richard E. Ayres

This article identifies the fundamental policy issues that must be dealt with in designing market-based pollution control systems. Market- based pollution control systems are now well established in America air and water pollution control programs. So far, however, the benefits of such systems have been limited by the unease of regulators and others about quality assurance, environmental justice, and other design issues. In order to realize the full potential benefits of market-based programs these issues must be addressed as part of the program design.

The Surface water treatment rule of the Safe Drinking Water Act has threatened to impose the burden of costly filtration plants on New York City for several years. It is now a reality, with multi-billion dollar filtration projects planned in the Croton System and threatened in the Catskill and Delaware Systems. Compounding this problem is the fierce opposition to siting a filtration plant in the densely populated low-income communities of the Bronx. This Comment explores the history of the filtration mandate and the litigation that has swirled around the decision to site the plant in the Bronx.
