Judicial Reform In China: New Regulations For A Lay Assessor System, Di Jiang

Washington International Law Journal

After a long history of the "rule of social rituals" and the "rule under man," China is reforming its legal structures, trying to achieve the rule of law. To realize this goal, China needs a more effective judicial deliberative body. To help define a system that is compatible with China's practical needs and promotes its social modernization, this Article examines the western jury and assessor systems and compares them to China's lay assessor system.

Primus Inter Pares: Is The Singapore Judiciary First Among Equals?, Karen Blőchlinger

Washington International Law Journal

Chief Justice Yong Pung How has implemented many changes in the Singapore judicial system since his appointment to the post in 1990. The reforms have concentrated on active case management, providing mediation as an alternative mechanism to resolve disputes, and implementing information technology in the courtroom. One of the results of these reforms is that the backlog of cases has been eliminated and the judicial system has become dramatically more efficient. However, an increased efficiency in judicial administration cannot be justified if it is attained at the expense of restricting access to justice. This Comment reviews the judicial reforms in …

Dotcom: Classifying The New Animal, D Sampath

IIMB Management Review

During the 70s, computer communication technology was transformed by desktop computing and distributed capacity. Networks
based on the TCP/IP protocol (transmission control protocol and Internet protocol) started communicating with one another.
Internet control message protocol, a mechanism to transfer control messages between nodes, was developed to manage ARPANET (the US government's advanced research project networks). ARPANET started in 1969 and developed into the Internet in 1984 with the advent of UNIX and client/ server architecture. Data was transferred between networks in packet form through  switches, routers, bridges, and gateways. From defence, the Internet found its application in educational institutions. Usenet …

From Politics To Efficiency In Choice Of Law, Erin A. O'Hara, Larry E. Ribstein Sep 2000

From Politics To Efficiency In Choice Of Law, Erin A. O'Hara, Larry E. Ribstein

University of Chicago Law Review

This Article proposes a comprehensive system for choice of law that is designed to enhance social wealth by focusing on individual rather than governmental interests. To the extent practicable, parties should be able to choose their governing law, subject to possible procedural protections designed to ensure that the choice is real. In the absence of an explicit agreement, courts should apply rules that facilitate party choice or that select the law the parties likely would have contracted for -- that is, the law of the state with the comparative regulatory advantage. The system relies on clear rules that enable the …

Annotating Mr. Fitzgerald, James L.W. West Iii

Documentary Editing: Journal of the Association for Documentary Editing (1979–2011)

Anyone who has written historical notes for a scholarly edition has learned to spot "glossable" references in contemporary texts. Philip Roth's Zuckerman Unbound, for example, will s0meday need annotations about the quiz-show scandals of the 1950s and about Charles Van Doren and Herbert Stempel, contestants whose lives were ruined by the disclosures. Don DeLillo's Underworld will require a description of Truman Capote's Black and White Ball, along with some information about]. Edgar Hoover's cross-dressing and his liaison with Clyde Tolson. Lee Smith's novels will need identifications of Post Toasties and of Maurice Williams and the Zodiacs (whose big hit song …

Anglo-I Atin's Scholarlyeolleagues: Editing The Oxford Medieval Texts: Review Of The Book Of The Foundation Of Walden Monastery. Diana Greenway And Leslie Watkiss, Ed. And Trans., Elaine E. Whitaker

Documentary Editing: Journal of the Association for Documentary Editing (1979–2011)

The Book of the Foundation of Walden Monastery contains at least two stories. The overt story is of marginalized medieval monks trying to secure their assets. This story--told in Latin with a translation on facing pages, normalized spelling, and twentieth-century punctuation-makes a lively read for anyone interested in human behavior. It concerns a twe1fthcentuty nobleman who founds an abbey using some of his least promising land, subsequently gets himself excommunicated and then killed in a pique over injustices done to him, and is succeeded by an array of kin, including a presumed bastard (Geoffrey fitz Peter), who allegedly subtract rather …

Dealing With Internet Hate, John A. Drobnicki

Publications and Research

The Internet offers a degree of anonymity whereby people can say things electronically that they often would not have the courage to say face-to-face, including racist rants and anti-Semitic lies. Beginning in 1998, Dr. David Maddison, an Australian scientist, began to post carefully researched replies to - and refutations of - anti-Semitic postings.

Effects Of Entomopathonogenic Fungus Beauveria Bassiana On Plutella Xylostella And Nymphalidae Larvae, September 2000, Kari L. Simmelink Sep 2000

Effects Of Entomopathonogenic Fungus Beauveria Bassiana On Plutella Xylostella And Nymphalidae Larvae, September 2000, Kari L. Simmelink

Monteverde Institute: Tropical Ecology and Conservation

This study examined the use of the fungus Beauveria bassiana as a biological alternative to chemical insecticides for the cauliflower pest Plutella xylostella. Potential secondary effects of B. bassiana on several local wild butterfly pollinators in Monteverde, Costa Rica were also investigated. Larvae of P. xylostella (Plutellidae), Actinote leucomeles (Acraeinae), Pteronymia notilla (Ithomiinae) and a morpho species of Nymphalidae were collected and treated with the same concentration of B. bassiana fungus used on cauliflower crops in the Estación Biológica Monteverde greenhouse. Mortality of treated larvae was significantly higher than untreated larvae for P. xylostella (Chi-squared p < 0.001), while no difference was found for the three species of treated Nymphalidae larvae. These results support the idea that the use of biological alternatives such as B. bassiana may have fewer adverse secondary effects on the environment than chemical insecticides.

Impatiens Walleriana (Balsaminaceae): Its Effects On Plant Diversity And Its Abiotic Habitat Characteristics, September 2000, Angela Braun

Monteverde Institute: Tropical Ecology and Conservation

Non-native species tend to proliferate in disturbed areas and may be well-suited to the conditions found there (Noss and Csuti, 1997). The effect of an exotic species, Impatiens walleriana, on plant species diversity at path edges was examined in the San Luis Valley, Monteverde, Costa Rica. Morphospecies of plants in 1m x 1m plots were collected and abundances for each recorded for 19 paired plots (38 total) with and without I. walleriana. Shannon-Wiener Diversity Indices were calculated twice for the plots with I. walleriana (accounting and discounting for the presence of I. walleriana) and once without I. walleriana (mean H’ …

Vesicular-Arbuscular Mycorrhizae On Sapium Glandulosum In Pastures And Light Gaps, September 2000, Karen Leigh Sonnenblick Sep 2000

Vesicular-Arbuscular Mycorrhizae On Sapium Glandulosum In Pastures And Light Gaps, September 2000, Karen Leigh Sonnenblick

Monteverde Institute: Tropical Ecology and Conservation

The purpose of this study was to look at the frequency of infection and percent root infection of vesiculararbuscular mycorrhizae present in saplings of Sapium glandulosum in pasture and gaps. Saplings in the pasture had a significantly higher frequency of infection than saplings in the gaps (Two-by-two contingency table, X² = 27.855, p < 0.0001). Saplings in the pasture also had a significantly higher mean percent infection than saplings in the gaps (Mann-Whitney U test, U = 370.00, tied p-value = 0.0013). These findings indicated that the amount of disturbance that an area has been subjected to strongly influences the levels of VAM growth on S. glandulosum.

More Effective Communication: A Manual For Professionals By Vilanilam J V; Response Books, New Delhi, 2000, Pp 238, Price: Rs 175., Asha Kaul

IIMB Management Review

An understanding of the "concepts of professionalism, organisational communication and theories applicable to managerial communication" is mandatory for professionals and students alike. Dr J V Vilanilam uses this as a premise to propound his ideas on communication in his book, More Effective Communication. The author is ex-Vice Chancellor of the University of Kerala and also served as Professor and Head of the Department of Communication and Journalism at the same university.
