Josiah Quincy's 1844 Visit With Joseph Smith, Jed L. Woodworth Oct 2000

Josiah Quincy's 1844 Visit With Joseph Smith, Jed L. Woodworth

BYU Studies

A prophet's claims have always invited attention. The Prophet Joseph Smith took calls from an array of personalities who would not be satisfied without seeing this curiosity in the flesh. The visitors came from near and far and from every walk and station of life: politicians and priests, paupers and pundits, charlatans and seekers, and almost everything in between. Arriving first in a trickle and then in a stream, they found the Prophet wherever he had gathered the Saints. Some of the travelers left accounts of their visits, and from these sketches later generations came to know Joseph, too.

Puerto Rico: Cultural Nation, American Colony, Pedro A. Malavet Oct 2000

Puerto Rico: Cultural Nation, American Colony, Pedro A. Malavet

UF Law Faculty Publications

As a matter of law, Puerto Rico has been a colony for an uninterrupted period of over five hundred years. In modern times, colonialism—the status of a polity with a definable territory that lacks sovereignty because legal/political authority is exercised by a peoples distinguishable from the inhabitants of the colonized region—is the only legal status that the isla (island) has known. This Article posits that Puerto Rico's colonial status—particularly its intrinsic legal and social constructs of second-class citizenship for Puerto Ricans—is incompatible with contemporary law or a sensible theory of justice and morality.

Long Live The Dead Hand: A Case For Repeal Of The Rule Against Perpetuities In Washington, Keith L. Butler Oct 2000

Long Live The Dead Hand: A Case For Repeal Of The Rule Against Perpetuities In Washington, Keith L. Butler

Washington Law Review

The common law rule against perpetuities has had a storied career spanning several centuries and two legal systems. The rule developed to curb the concentration of wealth in the hands of a few, and to limit the control of property by those no longer alive to use it. Legendary for its complexity, the rule has undergone statutory reform in many states; some states have gone so fara s to repeal the rule outright. Washington has embraced two of the major reforms of the rule and is considering repeal. This Comment argues that the rule, even with reform, no longer serves …

Ex Parte Young And Federal Remedies For Human Rights Treaty Violations, David Sloss Oct 2000

Ex Parte Young And Federal Remedies For Human Rights Treaty Violations, David Sloss

Washington Law Review

The doctrine of Ex parte Young is typically described as an exception to the immunity granted by the Eleventh Amendment of the U.S. Constitution. This Article contends that the Young doctrine also stands for the proposition that the Supremacy Clause creates an implied right of action for injunctive relief against state and local government officers who violate federal statutes or treaties. That right of action is available to plaintiffs who seek to enforce federal statutes or treaties against government officers unless Congress foreclosed the availability of a Young remedy when it enacted the statute, or the treaty makers foreclosed the …

Lincoln And The Abolitionists, Allen C. Guelzo Oct 2000

Lincoln And The Abolitionists, Allen C. Guelzo

History Faculty Publications

It has always been one of the ironies of the era of the Civil War and the end of slavery in the United States that the man who played the role of Great Emancipator of the slaves was so hugely mistrusted and so energetically vilified by the party of abolition. Abraham Lincoln, whatever his larger reputation as the liberator of more than three million black slaves in the Emancipation Proclamation, has never entirely shaken off the reputation of being something of a half-heart about it.
