Review Of Leaving The Bench: Supreme Court Justices At The End, By D. N. Atkinson, Richard D. Friedman Jan 2000

Review Of Leaving The Bench: Supreme Court Justices At The End, By D. N. Atkinson, Richard D. Friedman

Reviews

David Atkinson points out an interesting anomaly near the beginning of his book, Leaving the Bench: scholars have spent an enormous amount of energy studying entrance to the Supreme Court-how justices are chosen-but much less studying exit. It is indeed an important issue. Do justices stay too long (or perhaps leave too early)? What mechanisms are in place to induce them to leave the Court when the time has come, and passed? Are further mechanisms needed?

Cardozo The [Small R] Realist, Richard D. Friedman Jan 2000

Cardozo The [Small R] Realist, Richard D. Friedman

Reviews

In Part I of this Review, I will discuss aspects of Cardozo's life and character. In Part II, I will discuss Cardozo's jurisprudential theory as revealed in his lectures and essays. In Part IlI, I will suggest how we gain a better perspective on his judicial opinions by understanding not only that theory but also the man and his life.

Private Order And Public Institutions, Ellen D. Katz Jan 2000

Private Order And Public Institutions, Ellen D. Katz

Reviews

In Private Order Under Dysfunctional Public Order, John McMilan and Christopher Woodruff describe the private institutions that order commercial transactions in developing economies where commercial actors view the formal legal regime as unreliable. Presenting evidence from surveys of market participants in several Eastern European countries and in Vietnam, McMillan and Woodruff depict a system of private order that requires formal organization and the creation of institutions to share information and coordinate multiparty responses. These institutions do not simply offer a viable alternative to public procedures, but also enable commercial transactions to occur where the vacuum in public order would otherwise …

The Delimitation Of Pericopes: A Case Study In Matthew, Mark B. Regazzi Jan 2000

The Delimitation Of Pericopes: A Case Study In Matthew, Mark B. Regazzi

Dissertations

Problem . In Gospel studies the term "pericope" has been generally defined as a "unit," but there is no uniformity in the application of the term in either studies of the Gospels, or in harmonies, synopses, and gospel parallels ("comparators"). This present study was undertaken to determine what factors influence editors of comparators in determining the beginnings and ends of pericopes.

Method . A list was compiled of the major comparators of the twentieth century. The text references (e.g., Matt 1:1-17, 1:18-25, etc.) for the pericopes which contained passages from Matthew were entered into a computer for each comparator. The …

The Issue Of Antitrinitarianism In The Fifteenth-Century Novgorod-Moscow Movement: Analysis And Evaluation, Oleg Zhigankov Jan 2000

The Issue Of Antitrinitarianism In The Fifteenth-Century Novgorod-Moscow Movement: Analysis And Evaluation, Oleg Zhigankov

Dissertations

This study attempts to examine the trinitarian beliefs of the fifteenth-century Novgorod-Moscow movement, analyzing both their own writings and the polemical writings of those who considered their teaching antitrinitarian.

The main objective of the present research is to contribute to the restoration of the authentic theological identity of this movement. Chapter 1 defines the problem, which has already been raised by some nineteenth-century scholars who have pointed out that the allegedly antitrinitarian character of the Subbotniks' movement must be open for further discussion. It also shows that no systematic research on Subbotniks' theology has ever been produced.

The second chapter …

Religious Commitment As A Correlate Of Mental Health And Life Satisfaction Among Black American Families, Judith Bernard-Fisher Jan 2000

Religious Commitment As A Correlate Of Mental Health And Life Satisfaction Among Black American Families, Judith Bernard-Fisher

Dissertations

Problem. The salutary effect of religion is receiving greater acceptance among researchers, and its positive association with both physical and mental health has been increasingly examined in the scientific literature. Since religion has played a central role in the lives of Blacks, and since previous research has identified positive correlations between some religious attributes and individual well-being, it would seem that religious Black families would enjoy a greater degree of health.

A religious commitment model encompassing affiliation, participation, devotional intensity, and practices was used in the investigation of Black families' mental health and life satisfaction. As the first study of …

A Study Of The Out-Of-Class Experiences Of Saint Mary's College Students Studying In Maynooth, Ireland, Carolyn S. Langley Jan 2000

A Study Of The Out-Of-Class Experiences Of Saint Mary's College Students Studying In Maynooth, Ireland, Carolyn S. Langley

Dissertations

Problem Statement. The purpose of this study is to describe the out-of-class experiences of 21 students who studied in the Saint Mary's College Ireland Program in Maynooth, Ireland, during the 1998-1999 academic year. It examines (1) how the program orientation influenced students' desire to become involved in out-of-class activities, (2) how out-of-class experiences fostered students' learning of the Irish culture, and (3) how the experiences influenced students' attitudes toward cultures other than their own.

Methodology. This study employed descriptive qualitative research. Focus groups were conducted to gather data used in developing questions for long interviews, and these long interviews …

The Clinton Administration And War Powers, Lori Fisler Damrosch Jan 2000

The Clinton Administration And War Powers, Lori Fisler Damrosch

Faculty Scholarship

The strongest of all governmental powers is the power to engage in war; and the strongest challenge for constitutionalism is to bring the war power of the state under meaningful control. The 1787 Constitution allocated some military powers to the Congress and others to the President as part of the scheme of constitutional checks and balances. To this day, however, the distribution of authority between the branches remains contested and uncertain.

The Clinton Administration has had substantial opportunity to contribute to the evolution of constitutional practice concerning war powers, by virtue of numerous occasions of combat deployments, cruise missile strikes, …

Survey Of Nigerian University Student Affairs Services: A Comparison Of Students' Perceived Service Importance And The Students' Level Of Satisfaction, Michael Adewale Adeniyi Jan 2000

Survey Of Nigerian University Student Affairs Services: A Comparison Of Students' Perceived Service Importance And The Students' Level Of Satisfaction, Michael Adewale Adeniyi

Dissertations

Problem. Nigerian university student-affairs serviceshave been characterized by negative campus activism, violent demonstrations, and the destruction of lives and properties, the result of which led to the closing down of many Nigerian universities. Thus far, little empirical data exist regarding the student personnel servicesavailable to students at Nigerian universities, the importance of student-affairs services, or the level of student satisfaction with these services.

Methods. A quantitative survey methodology was used to assess 35 student-affairs services. A developed and validated survey instrument, the Student ServicesQuestionnaire (SSQ), was administered to collect data from currently registered undergraduate and graduate students of …

Poison Pills And The European Case, Jeffrey N. Gordon Jan 2000

Poison Pills And The European Case, Jeffrey N. Gordon

Faculty Scholarship

Professor Coates has given us a welcome opportunity to revisit the question of shareholder rights plans, or poison pills. It is interesting to evaluate a revisionist's view of an important empirical debate – but less because of the role that empirical evidence may have played in the evolution of U.S. corporate law doctrine and more because of the relevance of that debate to a world, especially Europe, that is waking up to the vigorous market in corporate control. If contested takeovers involving target firms such as Gucci, Telecom Italia, Paribas, and Mannesman are headline grabbing events in 1999 and 2000, …

The Landscape Of Constitutional Property, Thomas W. Merrill Jan 2000

The Landscape Of Constitutional Property, Thomas W. Merrill

Faculty Scholarship

The Constitution contains two clauses that protect persons against governmental interference with their property. The Due Process Clause provides that "No person shall ... be deprived of life, liberty, or property, without due process of law." The Takings Clause adds, "nor shall private property be taken for public use, without just compensation." Both provisions appear to impose a threshold condition that a claimant have some "property" at stake before the protections associated with the Clause apply. Thus, under the Due Process Clause, it would seem that a claimant must have an interest in "property" (or in "life" or "liberty") before …

Around The World In Eight Days, Leanne Hardy

The Christian Librarian

Theological schools in the two-thirds world struggle with untrained staff and inadequate resources. On-site evaluations, training workshops, automation projects and blitz cataloging are four ways Christian librarians can assist through short visits overseas. Good communication and preparation are essential for a successful visit. Follow-up communication can tum a short visit into a long-term partnership.

Critical Approaches To Property Institutions, Michael A. Heller Jan 2000

Critical Approaches To Property Institutions, Michael A. Heller

Faculty Scholarship

Private property is a rather elusive concept. Any kid knows what it means for something to be mine or yours, but grownup legal theorists get flustered when they try to pin down the term. Typically they, actually we, turn to a familiar analytic toolkit: including, for example, Blackstone's image of private property as "sole and despotic dominion"; Hardin's metaphor of the "tragedy of the commons"; and, more generally, the division of ownership into a trilogy of private, commons, and state forms. While each analytic tool has a distinguished pedigree and certain present usefulness, each also imposes a cost because it …

Europe's Evolving Regulatory Strategy For Gmos – The Issue Of Consistency With Wto Law: Of Kine And Brine, Robert Howse, Petros C. Mavroidis Jan 2000

Europe's Evolving Regulatory Strategy For Gmos – The Issue Of Consistency With Wto Law: Of Kine And Brine, Robert Howse, Petros C. Mavroidis

Faculty Scholarship

This Essay deals with one question: If challenged, how would regulatory restrictions on genetically modified organisms ("GMOs") be judged by a World Trade Organization ("WTO") adjudicating body. Many of the controversies about the effect of WTO law on domestic regulation have been influenced by the view that the law as it stands may well impede the ability of governments to regulate new and uncertain risks to health and the environment. The result in the Beef Hormones case ("Hormones case") is often cited for this proposition. In this Essay we aim to show that, contrary to an increasingly widespread popular …

The Uses Of History In Struggles For Racial Justice: Colonizing The Past And Managing Memory, Katherine M. Franke Jan 2000

The Uses Of History In Struggles For Racial Justice: Colonizing The Past And Managing Memory, Katherine M. Franke

Faculty Scholarship

In this Commentary, Professor Katherine Franke offers an analysis on Richard Delgado and Jean Stefancic's California's Racial History and Constitutional Rationales for Race-Conscious Decision Making in Higher Education and Rebecca Tsosie's Sacred Obligations: Intercultural Justice and the Discourse of Treaty Rights. These two Articles, she observes, deploy history for the purposes of justifying certain contemporary normative claims on behalf of peoples of color: affirmative action in higher education for Delgado and Stefancic, and sovereignty rights for native peoples in Tsosie's case. Franke explores the manner in which stories of past conquest and discrimination contribute to contemporary conceptions of racial …

M-Mode And Two-Dimensional (2-D) Echocardiographic Studies On Racing, Untrained And Show-Jumping Horses, Tarik Bi̇lal, Abdulkadi̇r Uysal, Yücel Meral, Abdullah Kayar

Turkish Journal of Veterinary & Animal Sciences

In this study, M-Mode and 2-D echocardiographic analysis was performed to investigate the heart structure of 90 English breed horses used for different purposes. The horses were divided into 3 groups: racing horses (Group I), untrained horses (Group II) and show-jumping horses (Group III). M-Mode sections in the fourth right intercostal space were taken from the musculus papillaris, chordae tendinei, mitral valves and aortic root using 2-D, and the measurements were made in four standard transudcer positions. The movement of the left ventrical, right ventrical, left atrium, aortic root, interventricular septum, left ventricular posterior wall and heart walls were analysed, …

Euphemistic Codes And Tell-Tale Hearts: Human Assistance In End-Of-Life Cases, George P. Smith Ii Jan 2000

Euphemistic Codes And Tell-Tale Hearts: Human Assistance In End-Of-Life Cases, George P. Smith Ii

Scholarly Articles

A euphemism is defined as the substitution of an agreeable or inoffensive word or expression for one that is harsh, indelicate, or otherwise unpleasant taboo; allusion to an offensive thing by an inoffensive expression. This article deals with medical euphemisms used commonly through medical codes in hospitals for end-of-life patient care. It examines the extent to which fear shapes decision making in critical care units - fear of medical failure, and fear of litigation if not "everything" is done to prolong life, no matter how agonizing. Furthermore, being trained to save lives, health care providers often lack the courage to …

Ideaconsciousness Networks, Wendy Angel

SWITCH

In this article, the author utilizes a theoretical approach to discuss the complexity of digital networks and the necessary cognitive adaptations humans need to process the amount of information shared over them. Several propositions are discussed including fuzziness, conscious Ideation, knowledge networks, idea structures, and idea coercion. It is theorized that ideas make up our consciousness and provide a more open definition to the experiences that combine the cognitive process. However, the fuzziness of uncertainty also raises ideas of its essential factor in our conscious exploration and that fuzziness of knowledge does not make knowledge obsolete. This posits that there …
