Property Ownership By Married Women In Victorian Ontario, Susan Ingram, Kris Inwood Oct 2000

Property Ownership By Married Women In Victorian Ontario, Susan Ingram, Kris Inwood

Dalhousie Law Journal

This paper reports patterns of property holding by women and men in late nineteenth-century Ontario. We focus on the town of Guelph immediately before and after legislation in 1872 and 1884 which permitted married women to hold property in their own name. The female-held share of all property and the female share of all owners in the town increased sharply. The gains were made by married women, and even more strongly by single women and widows. However, there was little or no shift of property in nearby rural townships. We argue that an induced change in inheritance practice amplified the …

Victims Confront Offenders: An Exploratory Study Of Victim Satisfaction During Mediation, Krystal C. Walton Oct 2000

Victims Confront Offenders: An Exploratory Study Of Victim Satisfaction During Mediation, Krystal C. Walton

Sociology & Criminal Justice Theses & Dissertations

The purpose of this study was to determine if age, race, and gender were related to victim satisfaction during mediation while controlling for the type of offense. Satisfaction with the mediator's attitude, the session itself, the mediator, and the outcome were assessed to measure the victim's level of satisfaction with the various components of the mediation process. Data was collected from questionnaires mailed to crime victims' who had completed the mediation process through the Juvenile and Domestic Relations Court in Norfolk, Virginia. This thesis looks at the relationship of age, race, and gender to victim satisfaction with mediation. Cross-tabulations were …

A Study For An Optimal Delivery Sequence Of A Bowling Pinspotter Distributor Mechanism, David Michael Burt Oct 2000

A Study For An Optimal Delivery Sequence Of A Bowling Pinspotter Distributor Mechanism, David Michael Burt

Mechanical & Aerospace Engineering Theses & Dissertations

The two major competitors in bowling sports equipment are Brunswick, Inc., and AMF Bowling Co. The latest version of a piece of bowling equipment machinery is called a Pinspotter, the design of which has been in existence since the 1950's. With the exception of electronic scoring systems, much of the original design is still being implemented in this model. It is the desire to eliminate undesirable traits in the original Pinspotter model design. Commercial Bowling observations have detected flaws found in a piece of machinery known as the Distributor. The flaws attributed to the Distributor are believed to be sources …

An Analysis Of Migratory Behavior Physiological Condition And Life History Strategy In The Salamanders Ambystoma Mabeei And A. Opacum In Southeastern Virginia, Michael W. Mccoy

Biological Sciences Theses & Dissertations

Ambystoma mabeei is listed as threatened in Virginia due to its rarity and susceptibility to urbanization and poor forestry practices. The goal of this study was to identify factors that may affect the persistence of A. mabeei in Virginia by studying the life history and ecology of A. mabeei and its syntopic congener A. opacum. This information will contribute to the knowledge of life history variation within Ambystomatidae and will be critical for the development of a comprehensive management plan for A. mabeei. Population sizes of the two species and the proximate factors responsible for initiating breeding migrations were determined …

Biological And Physical Observations On Larval Spot (Leiostomus Xanthurus) Recruiting To Oregon And Ocracoke Inlets North Carolina, Thomas R. Wasaff Oct 2000

Biological And Physical Observations On Larval Spot (Leiostomus Xanthurus) Recruiting To Oregon And Ocracoke Inlets North Carolina, Thomas R. Wasaff

Biological Sciences Theses & Dissertations

Patterns of abundance, length, age, and growth of larval spot (Leiostomus xanthurus) were compared to assess the variability between spot larvae ingressing to two North Carolina inlets. The source of variability for the recruitment of larval fishes to estuarine nurseries has been linked to environmental stochasticity. Wind data and seasurface temperature satellite images were analyzed as two influential environmental variables that may help explain recruitment variability. As part of the South Atlantic Bight Recruitment Experiment (SABRE), spot larvae were collected between October 1994 and April 1995 as they recruited to Pamlico Sound through Oregon Inlet, located north of Cape Hatteras, …

Fabrication And Characterization Of Silicon Field Emitter Arrays, Aaron M. Brock Oct 2000

Fabrication And Characterization Of Silicon Field Emitter Arrays, Aaron M. Brock

Electrical & Computer Engineering Theses & Dissertations

Field emission is a process through which the application of a large electric field to the surface of a material causes electron emission into vacuum. The electron emission current is a strong function of the geometry of the emitting material. The focus of this thesis is to investigate the effect of geometry on the emission current. Specifically, silicon field emitter arrays were fabricated using two separate fabrication processes termed the standard process and the new process. The uniformity of the arrays was measured experimentally. The arrays were used in field emission tests from which parameters controlling field emission were extracted. …

The Anticompetitive Effect Of Passive Investment, David Gilo Oct 2000

The Anticompetitive Effect Of Passive Investment, David Gilo

Michigan Law Review

There are many cases in which a firm passively invests in its competitor. For example, Microsoft passively invested in $150 million worth of the nonvoting stock of Apple, its historic rival in the operating systems market. Also, in November 1998, Northwest Airlines, the nation's fourth-largest airline, purchased 14% of the common stock of Continental Airlines Inc., the nation's fifth-largest (and fastest growing) airline. Northwest competes with Continental on seven routes, serving 3.6 million passengers per year. In another example, TCI, the nation's largest cable operator, became a passive investor with a 9% stake (which can be increased, under the terms …

The Racial Origins Of Modern Criminal Procedure, Michael J. Klarman Oct 2000

The Racial Origins Of Modern Criminal Procedure, Michael J. Klarman

Michigan Law Review

The constitutional law of state criminal procedure was born between the First and Second World Wars. Prior to 1920, the Supreme Court had upset the results of the state criminal justice system in just a handful of cases, all involving race discrimination in jury selection. By 1940, however, the Court had interpreted the Due Process Clause of the Fourteenth Amendment to invalidate state criminal convictions in a wide variety of settings: mob-dominated trials, violation of the right to counsel, coerced confessions, financially-biased judges, and knowingly perjured testimony by prosecution witnesses. In addition, the Court had broadened its earlier decisions forbidding …

The Treaty Power And American Federalism, Part Ii, Curtis A. Bradley Oct 2000

The Treaty Power And American Federalism, Part Ii, Curtis A. Bradley

Michigan Law Review

In an article published in this Review two years ago, I described and critiqued what I called the "nationalist view" of the treaty power. Under this view, the national government has the constitutional power to enter into treaties, and thereby create binding national law by virtue of the Supremacy Clause, without regard to either subject matter or federalism limitations. This view is reflected in the writings of a number of prominent foreign affairs law scholars, as well as in the American Law Institute's Restatement (Third) of Foreign Relations Law of the United States. In my article, I argued that this …

Just Compensation, Incentives, And Social Meanings, Hanoch Dagan Oct 2000

Just Compensation, Incentives, And Social Meanings, Hanoch Dagan

Michigan Law Review

In Takings and Distributive Justice, I proposed a progressive interpretation of the Compensation Clause. In his response, published in this issue, Professor Lunney challenges the plausibility and the desirability of my interpretation and proposes an alternative. This Essay compares our approaches. It concludes that Professor Lunney's careful examination of the public choice analysis of takings does refine my theory. Contrary to Professor Lunney's claims, however, these refinements reinforce - rather than undermine - the viability of a progressive takings doctrine. Parts I and II set the stage by summarizing the principal claims made, respectively, in my original Article and in …

Establishing Inevitability Without Active Pursuit: Defining The Inevitable Discovery Exception To The Fourth Amendment Exclusionary Rule, Stephen E. Hessler Oct 2000

Establishing Inevitability Without Active Pursuit: Defining The Inevitable Discovery Exception To The Fourth Amendment Exclusionary Rule, Stephen E. Hessler

Michigan Law Review

Few doctrines of constitutional criminal procedure generate as much controversy as the Fourth Amendment exclusionary rule. Beyond the basic mandate of the rule - that evidence obtained in violation of an individual's right to be secure against unreasonable search and seizure is inadmissible in a criminal proceeding - little else is agreed upon. The precise date of the exclusionary rule's inception is uncertain, but it has been applied by the judiciary for over eight decades. While the Supreme Court has emphasized that the rule is a "judicially created remedy," and not a "personal constitutional right," this characterization provokes argument as …

The Political Economy Of Global Multilateralism, John O. Mcginnis Oct 2000

The Political Economy Of Global Multilateralism, John O. Mcginnis

Articles

Many conservatives (at the least the subset who are classical liberals) approve of global multilateral trade agreements and allied agreements that keep global capital markets open. Conservatives, however, tend to be openly skeptical of other global multilateral agreements, be they environmental accords, human rights conventions, military pacts, or an agreement on an international criminal court. In this paper I offer the beginnings of a framework of sound political economy that justifies these divergent intuitions and shows that they are rooted in more than just a reflexive liking for trade combined with a disdain for the environment, human rights, criminal justice, …

Using Gis To Evaluate The Effects Of Flood Risk On Residential Property Values, Alena Bartosova, David E. Clark, Vladimir Novotny, Kyra S. Taylor Oct 2000

Using Gis To Evaluate The Effects Of Flood Risk On Residential Property Values, Alena Bartosova, David E. Clark, Vladimir Novotny, Kyra S. Taylor

Economics Faculty Research and Publications

Annually, flooding causes more property damage in the United States than any other type of natural disaster. One of the consequences of continued urbanization is the tendency for floodplains to expand, increasing flood risks in the areas around urban streams and rivers. Hedonic modeling techniques can be used to estimate the relationship between residential housing prices and flood risks. One weakness of hedonic modeling has been incomplete controls for locational characteristics influencing a given property. In addition, relatively primitive assumptions have been employed in modeling flood risk exposures.

We use GIS tools to provide more accurate measures of flood risks, …

Reinventing Structural Reform Litigation: Deputizing Private Citizens In The Enforcement Of Civil Rights, Myriam E. Gilles Oct 2000

Reinventing Structural Reform Litigation: Deputizing Private Citizens In The Enforcement Of Civil Rights, Myriam E. Gilles

Articles

The aim of this Article is to explore the possibility of constructing a model that harnesses the power of private citizens to reform unconstitutional practices, particularly in the critical area of police-related rights violations. I seek here to reintegrate private citizens into the enforcement of public laws; to tap the private experiential and financial resources that were a necessary condition of the great structural reform efforts of the civil rights movement of the 1950s and 1960s.

The vehicle by which I propose to accomplish these ends is a simple, yet novel, amendment to 42 U.S.C. § 14141, the statute which …

Is Reproduction By Tree Swallows (Tachycineta Bicolor) Cost-Free?, Michael T. Murphy Oct 2000

Is Reproduction By Tree Swallows (Tachycineta Bicolor) Cost-Free?, Michael T. Murphy

Biology Faculty Publications and Presentations

We manipulated brood sizes of Tree Swallows (Tachycineta bicolor) in 1996 and 1997 to test for the existence of intra- and intergenerational costs of reproduction. Modal clutch size was six eggs, but experimental brood sizes ranged from two to nine young. Nestling starvation was higher in 1996 (and dependent on brood size) than in 1997, but in both years enlargement of brood size resulted in increased productivity. Nestling mass near fledging was negatively correlated with brood size, but tarsus length and wing chord were not. Food deliveries by parents increased steadily between broods of two to six young but then …

Small Claims Reform: A Means Of Expanding Access To The American Civil Justice System, James C. Turner, Joyce A. Mcgee Sep 2000

Small Claims Reform: A Means Of Expanding Access To The American Civil Justice System, James C. Turner, Joyce A. Mcgee

University of the District of Columbia Law Review

Every American should enjoy full access to the protections offered by the U.S. civil justice system. Unfortunately, this basic right is often denied to millions by civil court procedures and practices that are costly, Byzantine and hostile to ordinary citizens who need legal help. In fact, according to the American Bar Association, tens of millions of American households that need legal help are denied access to the civil justice system every year.' One key method of improving citizen access to the civil justice system is through small claims courts. These courts - which use simplified procedures, require plain English, provide …

Report On The Minors’ Abortion Rights Project, J. Shoshanna Ehrlich, Carol Hardy-Fanta, Jamie Ann Sabino Sep 2000

Report On The Minors’ Abortion Rights Project, J. Shoshanna Ehrlich, Carol Hardy-Fanta, Jamie Ann Sabino

Publications from the Center for Women in Politics and Public Policy

The goal of this study was to learn more about the experience of minors in states with parental involvement laws who do not involve their parents in their abortion decision, and must therefore seek judicial authorization for an abortion, and to use this knowledge to explore ways to minimize the burden of these laws. At the outset, it should be made clear that having this goal does not indicate that we support imposing third-party involvement requirements on teens seeking to abort. Our research, as well as the work of others (much of which is cited in this report), raises serious …
