Chinese Privatization: Between Plan And Market, Lan Cao

Law and Contemporary Problems

Since 1978, when China adopted its open-door policy and allowed its economy to be exposed to the international market, it has produced an economy with one of the most rapid growth rates in the world. Cao examines the general framework and other related issues associated with the privatization debate of the Chinese economy.

Book Review: Sabine Lardon. L’Écriture De La Méditation Chez Jean De Sponde., Russell J. Ganim Oct 2000

Book Review: Sabine Lardon. L’Écriture De La Méditation Chez Jean De Sponde., Russell J. Ganim

Department of Modern Languages and Literatures: Faculty Publications

Sabine Lardon’s monograph commands attention for the precision with which it analyses Sponde’s rhetorical tech¬nique in his Méditations sur les Pseaumes. Basing the need for her book on the critics’ preference for writing about Sponde’s lyric offerings rather than his prose, Lardon pro¬duces a study that yields great insight into Sponde’s ad¬ap¬tation of language and form within the context of bibli¬cal exegesis. Lardon’s work makes a valuable contribution to Spondian studies, and will no doubt help renew interest in baroque devotional literature.

Blood Lead Level In The Jordanian Population, Malek A. Dabbas, Mohammad A. Al-Zoubi Oct 2000

Blood Lead Level In The Jordanian Population, Malek A. Dabbas, Mohammad A. Al-Zoubi

Saudi Medical Journal

OBJECTIVE: To determine the blood lead level in the non-occupationally exposed Jordanian population as a baseline for comparative studies. METHODS: Seven hundred and forty six blood samples were collected and analyzed using Graphic Furnace Atomic Absorption Spectrophotometry. A representative sample for the Jordanian community was selected. RESULTS: The arithmetic mean for blood lead level in the whole sample was 1.96 µg/d1 which was lower than the other means determined by international studies. CONCLUSION: The blood lead level among the Jordanian population was found to be less than the levels in other countries, this may be partly explained by the low …

Disentangling Deregulatory Takings, Jim Rossi, Susan G. Rose-Ackerman Oct 2000

Disentangling Deregulatory Takings, Jim Rossi, Susan G. Rose-Ackerman

Vanderbilt Law School Faculty Publications

Constitutional takings protections, such as those in the Fifth Amendment of the United States Constitution, create a potential for state liability for changes in regulatory policy by governments. This Article critiques takings jurisprudence in the context of two infrastructure investment issues: the stranded cost problem facing United States utility industries, which has given rise to claims of compensation for deregulatory takings; and the development of standards to protect direct foreign investment in developing countries. In both contexts, traditional legal doctrines do not adequately provide for the type of remedy sought so courts are in need of standards to assist them …

Design And Rule Base Reduction Of A Fuzzy Filter For The Estimation Of Motor Currents, Daniel J. Simon Oct 2000

Design And Rule Base Reduction Of A Fuzzy Filter For The Estimation Of Motor Currents, Daniel J. Simon

Electrical and Computer Engineering Faculty Publications

Fuzzy systems have been used extensively and successfully in control systems over the past few decades, but have been applied much less often to filtering problems. This is somewhat surprising in view of the dual relationship between control and estimation. This paper discusses and demonstrates the application of fuzzy filtering to motor winding current estimation in permanent magnet synchronous motors. Motor winding current estimation is an important problem because in order to implement effective closed-loop control, a good estimation of the current is needed. Motor winding currents are notoriously noisy because of electrical noise in the motor drive. We use …

Schechter Poultry At The Millennium: A Delegation Doctrine For The Administrative State, Lisa Schultz Bressman Oct 2000

Schechter Poultry At The Millennium: A Delegation Doctrine For The Administrative State, Lisa Schultz Bressman

Vanderbilt Law School Faculty Publications

The new delegation doctrine might seem perplexing to both sides of the current delegation debate. Either it is too intrusive on administrative prerogatives or it is not nearly intrusive enough. The new delegation doctrine is difficult to comprehend only because it evinces a different focus. While the debate concentrates primarily on the legitimacy of lawmaking by administrative agencies, the new doctrine speaks more to the goal of promoting the legitimacy of law made by administrative agencies. It might even be fair to say that, in this regard, the new doctrine moves beyond the academic debate. Moreover, the new doctrine neither …

Household Specialization And The Male Marriage Wage Premium, Joni Hersch, Leslie S. Stratton Oct 2000

Household Specialization And The Male Marriage Wage Premium, Joni Hersch, Leslie S. Stratton

Vanderbilt Law School Faculty Publications

Empirical research has consistently shown that married men have substantially higher wages, on average, than otherwise similar unmarried men. One commonly cited hypothesis to explain this pattern is that marriage allows one spouse to specialize in market production and the other to specialize in home production, enabling the former - usually the husband - to acquire more market-specific human capital and, ultimately, earn higher wages. The authors test this hypothesis using panel data from the National Survey of Families and Households. The data reveal that married men spent virtually the same amount of time on home production as did single …

Using Bargaining For Advantage In Law School Negotiation Courses, Chris Guthrie Oct 2000

Using Bargaining For Advantage In Law School Negotiation Courses, Chris Guthrie

Vanderbilt Law School Faculty Publications

Options, options, options ....The Negotiation literature-at least the "problem-solving" or "interestbased" or "principled" negotiation literature'repeats this mantra over and over and over. It seems self-evident that having lots of options is a good idea because more options means more to choose from. The more options there are to choose from, however, the more difficult choosing can be. Options, in short, may increase the likelihood that one will make an optimal decision, but they impose added "decision costs" on the decision maker. Law professors now face this happy dilemma when choosing materials for their Negotiation courses. Options abound-including the negotiation chapters …

Affirmative Actions, William W. Van Alstyne Oct 2000

Affirmative Actions, William W. Van Alstyne

Faculty Publications

Liberals and progressives have been slow to realize that their preferred vocabulary has been hijacked and that when they respond to once hallowed phrases they are responding to a ghost now animated by a new machme. The point is not a small one, for in any debate, especially one fought in the arena of public opinion, the battle is won not by knock-down arguments but by the party that succeeds in placing its own spin on the terms presiding over the discussion.

This paper examines three e-journals and one paper journal begun in the 1990s within the information science genre. In addition, these journals are compared to what is perhaps the leading information science journal, one that has been published continuously for fifty years.  The journals we examine are CyberMetrics, Information Research, the Journal of Internet Cataloging, Libres, and the Journal of the American Society for Information Science. We find that there are a number of important differences among the journals. These include frequency of publication, publication size, number of authors, and the funding status of articles. We also …

Eliminating Consideration Of Parental Wealth In Post-Divorce Child Custody Disputes, Carolyn J. Frantz Oct 2000

Eliminating Consideration Of Parental Wealth In Post-Divorce Child Custody Disputes, Carolyn J. Frantz

Michigan Law Review

There may be no story as old as that of the child of privilege, spoiled in the things of the world, who finally achieves happiness through coming to appreciate the simple charms of working-class life. But equal in strength are the real life stories of American parents: their drive for the accumulation of personal wealth, so frequently justified as "for the children." The place of wealth in the good life of a child is deeply controversial, and it should surprise no one to see it played out in child custody law. Under the statutes of almost all states, custody disputes …

Wrong Turn In Cyberspace: Using Icann To Route Around The Apa And The Constitution, A. Michael Froomkin Oct 2000

Wrong Turn In Cyberspace: Using Icann To Route Around The Apa And The Constitution, A. Michael Froomkin

Duke Law Journal

The Internet relies on an underlying centralized hierarchy built into the domain name system (DNS) to control the routing for the vast majority of Internet traffic. At its heart is a single data file, known as the "root." Control of the root provides singular power in cyberspace. This Article first describes how the United States government found itself in control of the root. It then describes how, in an attempt to meet concerns that the United States could so dominate an Internet chokepoint, the U. S. Department of Commerce (DoC) summoned into being the Internet Corporation for Assigned Names and …

Icann And The Problem Of Legitimacy, Jonathan Weinberg Oct 2000

Icann And The Problem Of Legitimacy, Jonathan Weinberg

Duke Law Journal

Two years ago, an entity called the Internet Corporation for Assigned Names and Numbers (ICANN) was formed to take control of the Internet's infrastructure of domain name and IP address identifiers. Private parties formed ICANN at the behest of the U. S. government; the government is currently using its considerable resources to cement ICANN's authority over the domain name space. ICANN's role is one generally played in our society by public entities. It is setting rules for an international communications medium of surpassing importance. That task had historically been performed by a U. S. government contractor in an explicitly public-regarding …
