Accounting Historians Notebook
St. Matthew is the patron saint of accountants, tax collectors, bankers, customs officers and security guards. He was originally called Levi; however, this follower of Jesus took the name Matthew-the gift of Yahweh-when called to be a disciple. St. Matthew's feast day is celebrated on September 21st.

The Faa: A Tombstone Agency? Putting The Nickname To The Test, Rebecca K. Lutte, Brent D. Bowen
Aviation Institute Faculty Publications
The purpose of this research was to investigate Federal Aviation Administration (FAA) activity before and after six catastrophic airline accidents to examine the alleged reactive policysetting reputation of the FAA. Actions reviewed were regulatory, inspection, and enforcement activities. The study revealed that change in agency activity does occur following an accident. The location of the event appears to influence the direction of change. When accidents occurred within the United States, FAA activity increased following the accident. The opposite occurred for airline accidents outside the U.S. The increase in FAA activity following U.S. based events, supports the reactive, tombstone agency reputation …

Putting Legislative History To A Vote: A Response To Professor Siegel, John F. Manning
Putting Legislative History To A Vote: A Response To Professor Siegel, John F. Manning
Vanderbilt Law Review
In a previous article, I argued that, properly understood, textualism implements a special form of the nondelegation doctrine, one that prohibits legislative self-delegation.' If the judiciary accepts certain types of legislative history (committee reports and sponsors' statements) as "authoritative" evidence of legislative in- tent in cases of ambiguity, then the particular legislators who write that history (the committees and sponsors) effectively settle statutory meaning for Congress as a whole. Against the background of such a judicially fashioned interpretive practice, when Congress passes a vague or ambiguous statute, it thereby implicitly delegates its law-elaboration authority to legislative agents, who effectively fashion …

The Demining Of Farmland - Cost/Benefit Analysis And Quality Control, Peter Schoeck
The Demining Of Farmland - Cost/Benefit Analysis And Quality Control, Peter Schoeck
The Journal of Conventional Weapons Destruction
The value gained by the demining of farmland is estimated and compared with the cost of demining for manual demining and mechanized demining. It is found that for farmland used for growing ordinary crops (as opposed to “luxury” crops yielding higher prices), the cost of demining and recultivation for reasons of economy is not to exceed 40 cents (U.S.)/m. To reach this target requires mechanized demining wherever possible, confining manual demining to areas not suitable for mechanized demining. A method is shown by which 100 percent safety of the demined area can be achieved and which facilitates quality control. The …

Mine Awareness At The Cambodian Mine Action Center, Tang Sun Hao
The Journal of Conventional Weapons Destruction
The mission of the Cambodian Mine Action Center (CMAC) Mine/UXO Awareness Branch is to reduce mine/UXO casualty rates by educating people about the nature of the danger and the appropriate steps to avoid the risk of accidents. The primary objective of CMAC Mine/UXO Awareness is no longer to teach people about the presence and dangers of landmines and unexploded ordnance, but rather, it is to ensure that people have the correct knowledge and make them more able and intent to avoid risk-behavior. In Cambodia, most communities have knowledge, sometimes gained in a tragic way, about landmines.
The Landmine Impact Survey Process, Richard Kidd
The Landmine Impact Survey Process, Richard Kidd
The Journal of Conventional Weapons Destruction
On August 22, the United Nations certified the process and the results of the Landmine Impact Survey conducted in Yemen. This survey is the first of its kind to be performed in accordance with international standards and marks a revolutionary event in the field of humanitarian mine action. The enhanced quality of information gained through the impact survey will change the way that resources are allocated and operational plans developed. Sophisticated analysis can now take place in support of decision-makers at all levels and progress measured in terms of real value to affected populations.
Mine Action In Cambodia, Tim Grant
Mine Action In Cambodia, Tim Grant
The Journal of Conventional Weapons Destruction
During the past five years, I have worked in four different mine awareness programs. The first was in 1990 with the Land Mine Awareness Programme (LMAP) whose mandate was to reach the Cambodian refugee camps on the Thai/Cambodian border. LMAP was the first mine awareness program to operate in the South East Asian region and was run through the International Rescue Committee (IRC) with funding by the Office of the U.N. Secretary General for the Coordination of Cambodian Humanitarian Assistance Programs.

Quality Of The Business Environment Versus Quality Of Life In A Dynamic Model Of Urban Composition And Growth Do Firms And Households Like The Same Cities?, Stuart S. Rosenthal, Stuart A. Gabriel
Quality Of The Business Environment Versus Quality Of Life In A Dynamic Model Of Urban Composition And Growth Do Firms And Households Like The Same Cities?, Stuart S. Rosenthal, Stuart A. Gabriel
Economics - All Scholarship
Appropriately constructed measures of the quality of life and the quality of the business environment should be important determinants of the growth and composition of population across urban areas. This paper examines that question by extending theoretical measures of household quality of life to construct the first ever measure of the quality of the business environment? the value that firms place on the basket of amenities in a metropolitan area. An annual panel of quality of life and quality of business environment values for 37 cities in the United States is then constructed for the 1977 to 1995 period.

Opting Out Of Regulation: A Public Choice Analysis Of Contractual Choice Of Law, Erin A. O'Hara
Opting Out Of Regulation: A Public Choice Analysis Of Contractual Choice Of Law, Erin A. O'Hara
Vanderbilt Law Review
This Article uses public choice theory to analyze the function of choice-of-law clauses in contracts. Choice-of-law clauses are now quite common and are increasingly enforced, especially with the proliferation of international and Internet transactions. Because these clauses can be used by parties to avoid regulation, academics are now vigorously debating the extent to which this contractual opt out should be permitted. The Article presents a positive political theory of the interplay of legislative action and the enforcement of choice of law. It demonstrates that the important normative debate over choice of law is somewhat misguided because both sides fail to …

After Drye: The Likely Attachment Of The Federal Tax Lien To Tenancy-By-The-Entireties, Steve R. Johnson
Scholarly Publications
On December 7, 1999, the United States Supreme Court unanimously decided Drye v. United States, a case likely to be a landmark in federal tax lien law. Drye clarified what had been muddied by previous Supreme Court and lower court decisions: the proper relation between state law and federal law in tax lien attachment cases. That clarification will permit-indeed, compel-greater analytical precision as future courts address tax lien cases. This Article discusses one such line of cases.
It has long been the rule that the federal tax lien does not attach to tenancy-by-the entireties interests when (1) only one of …

Kyojiro Someya, Professor emeritus of Waseda University, died suddenly before dawn on January 3, 2000, as he neared the age of 77. He had completed the correction of proofs of his last book, Accounting and Management of Cash Flow, on the day before, but to our regret could not write the preface. His academic achievements were his brilliant activities at home and abroad and his publication of over 90 books, including 24 coauthored, and more than 200 papers.
