Decius S. Wade's Necessity For Codification, Andrew P. Morriss Jan 2000

Decius S. Wade's Necessity For Codification, Andrew P. Morriss

Faculty Scholarship

Decius S. Wade, former Montana Territorial Supreme Court Justice and Code Commissioner, delivered this address to the Helena Bar Association on April 5, 1894. The address came slightly more than two years after Wade, as one of the three Code Commissioners, had reported draft Civil, Political, Penal, and Procedural Codes to the State Auditor and slightly less than one year before Governor John E. Rickards signed the four codes as passed by the Fourth Legislature. Wade's address came just after the Third Legislature, split three ways among the Democrats, Republicans, and Populists and unable to settle on United States Senators, …

Denying Access To Legal Representation: The Attack On The Tulane Environmental Law Clinic, Robert R. Kuehn Jan 2000

Denying Access To Legal Representation: The Attack On The Tulane Environmental Law Clinic, Robert R. Kuehn

Scholarship@WashULaw

When people require assistance to advance public interests, rather than private interests, the lack of legal representation is even more severe—less than .001% of lawyers in the legal profession are public interest lawyers. “Although recent data are unavailable, the best available estimates suggest that the number of full-time public interest lawyers is less than one attorney for every 240,000 Americans.” Citizens advancing issues of public concern often have no choice but to turn for free assistance from law school professors or one of the nation’s law school clinics.

Clinical Education For This Millennium: The Third Wave, Peter A. Joy, Margaret Martin Barry, Jon C. Dubin

Scholarship@WashULaw

This article focuses on the continuing transformation of legal education and the role of clinical legal education in training competent, ethical practitioners. Part I examines the primary challenges that clinicians confronted in the past: to create a clinical legal education teaching methodology and to establish viable, enduring clinical programs in law schools throughout the country. Part II discusses a variety of different models for integrating clinical methodology either throughout the curriculum or as a core feature of the curriculum. Part III analyzes a variety of the most pressing challenges and opportunities for clinical legal education and the larger enterprise of …

An Empirical Study Of Sample-Selection Bias In Indices Of Commercial Real Estate, Henry J. Munneke, Barrett A. Slade Jan 2000

An Empirical Study Of Sample-Selection Bias In Indices Of Commercial Real Estate, Henry J. Munneke, Barrett A. Slade

Faculty Publications

Real estate price indices based solely on samples of sold properties may not accurately represent the population of properties due to potential sample-selection bias. This study addresses this potential for sample-selection bias in the construction of commercial price indices within the context of the Phoenix area of®ce market. The empirical analysis con®rms the presence of sample-selection bias in the estimation of the total price equation. However, within this sample, the price indices generated after correcting for sample-selection bias do not appear signi®cantly different from those that do not consider selectivity bias.

The Missionary Presence And Influences In Maryland In Liberia, 1834-1842., Eugene S. Vansickle Jan 2000

The Missionary Presence And Influences In Maryland In Liberia, 1834-1842., Eugene S. Vansickle

Graduate Theses, Dissertations, and Problem Reports (ETD)

In 1831 Maryland colonizationists broke away from the American Colonization Society (ACS) and formed the Maryland State Colonization Society (MSCS) in an effort to control the colonization movement in Maryland. This was done in response to pressure to colonize Maryland’s rapidly increasing free African-American population in “Maryland in Africa.” The MSCS took deliberate steps to avoid the problems faced by the ACS and its colonists. These steps were not successful and actually led to conflicts between Maryland colonists and missionaries. This study examines how the policies of the MSCS and the interpretation and subsequent enforcement of them by the missionaries …

Teacher Training Through Literature: Building Teacher Awareness On The Process Of Shift In Identity On Esl Learners., Luis Ruiz J. Vazquez Jan 2000

Teacher Training Through Literature: Building Teacher Awareness On The Process Of Shift In Identity On Esl Learners., Luis Ruiz J. Vazquez

Graduate Theses, Dissertations, and Problem Reports (ETD)

In this work I defend the notion of the necessity for ESL learners to undergo some sort of identity shift process. This process would be a smooth and gradual evolution by reason of which ESL learners (and, by extension, learners of any foreign language) would develop a second identity that would encompass all the aspects associated to the L2 of their choice, apart from its exclusively linguistic and structural components. I introduce mainly the necessity of building awareness among teachers, especially—but not exclusively—among monolingual foreign language instructors. The strategy that I propose to promote this awareness is the guided reading …

The Columbia River's Fate In The Twentieth Century, William L. Lang Jan 2000

The Columbia River's Fate In The Twentieth Century, William L. Lang

History Faculty Publications and Presentations

Discusses the history of the Columbia River during the 20th century, emphasizing the image of the river as both a source of industry and an example of wild natural beauty. In 1933 the river was dammed to harness its power for hydroelectricity and control its unpredictable flooding. With the completion of the dams in the 1970's, however, came problems with the edenic vision of the river, especially with the annual salmon run. By the late 20th century, the salmon had all but disappeared, leading to an ongoing conflict between supporters of the dams and conservationists.

Perturbative Quantum Chromodynamics Predictions For Very High Energy Atmospheric Neutrinos And Muons, Gabriele U. Varieschi Jan 2000

Perturbative Quantum Chromodynamics Predictions For Very High Energy Atmospheric Neutrinos And Muons, Gabriele U. Varieschi

Physics Faculty Works

We compare the leading and next-to-leading order Quantum Chromodynamics predictions for the flux of atmospheric muons and neutrinos from decays of charmed particles. We then compute this flux for different Partonic Distribution Functions (PDF's) and different extrapolations of these at small partonic momentum fraction x. We find that the predicted fluxes vary up to almost two orders of magnitude at the largest energies studied, depending on the chosen extrapolation of the PDF's. We show that the spectral index of the atmospheric leptonic fluxes depends linearly on the slope of the gluon distribution function at very small x. Finally, we analyze …

Computer Science Faculty Works

An effective, integrated telemedicine system has been developed that allows (a) teleconsultation between local primary health care providers (primary care physicians and general radiologists) and remote imaging subspecialists and (b) active patient participation related to his or her medical condition and patient education. The initial stage of system development was a traditional teleradiology consultation service between general radiologists and specialists; this established system was expanded to include primary care physicians and patients. The system was developed by using a well-defined process model, resulting in three integrated modules: a patient module, a primary health care provider module, and a specialist module. …

Blood Glucose Estimation Accuracy In Children With Diabetes: An Investigation Of Repeated Practice With Latent Growth Curve Modeling, Julie Ann Wagner Jan 2000

Blood Glucose Estimation Accuracy In Children With Diabetes: An Investigation Of Repeated Practice With Latent Growth Curve Modeling, Julie Ann Wagner

Open Access Dissertations

Blood glucose (BG) estimation is an important part of maintaining euglycemia in individuals with diabetes. Interventions to increase accuracy were designed without taking into account the natural effects of practice. The current study investigated the effects of naturalistic practice on BG estimation accuracy. Latent growth curve modeling (LGCM) was used to analyze data from 43 children with insulin dependent diabetes. LGCM consists of two stages. In the first stage, a growth curve was fit to the repeated measures of each individual in the sample. Results indicated that the true growth trajectory was curvilinear, and best represented by a quadratic function. …
