Articles

The Amateur Sky Survey (TASS) is a loose confederation of amateur and professional astronomers. We describe the design and construction of our Mark III system, a set of wide-field drift-scan CCD cameras which monitor the celestial equator down to thirteenth magnitude in several passbands. We explain the methods by which images are gathered, processed, and reduced into lists of stellar positions and magnitudes. Over the period October, 1996, to November, 1998, we compiled a large database of photometric measurements. One of our results is the tenxcat catalog, which contains measurements on the standard Johnson-Cousins system for 367,241 stars; it contains …

Faculty Diversity As A Clinical Legal Education Imperative, Jon C. Dubin Jan 2000

Faculty Diversity As A Clinical Legal Education Imperative, Jon C. Dubin

UC Law Journal

Clinical legal education has rapidly evolved from a novelty or boutique offering in law school curricula to a relatively settled and accepted component of the academy. Much has been written about the composition of law and university faculties, the value of faculty diversity in university and traditional law school educational settings, and proposals for reform. However, scant attention has been paid to the composition of the increasingly significant cadre of law professors engaging in clinical teaching and scholarship and the educational and social consequences of the demographic distribution of clinical faculty positions. In this article, Professor Dubin examines and analyzes …

Republican Mothers, Bastards' Fathers And Good Victims: Discarding Citizens And Equal Protection Through The Failures Of Legal Images, Linda Kelly Jan 2000

Republican Mothers, Bastards' Fathers And Good Victims: Discarding Citizens And Equal Protection Through The Failures Of Legal Images, Linda Kelly

UC Law Journal

In Republican Mothers, Bastards' Fathers and Good Victims: Discarding Citizens and Equal Protection Through the Failures of Legal Images, Professor Linda Kelly uncovers the influence of gender images in immigration law. While in many areas of law gender perceptions have been exposed, in immigration law legal images of gender remain unspoken and unchallenged. In the recent decision of Miller v. Albright, the Supreme Court declared that while a woman becomes a parent immediately upon the birth of her child, a man is not legally considered a parent until he assumes post-birth responsibility for his child. Miller challenged a provision of …

Monstrous Offenders And The Search For Solidarity Through Modern Punishment, Joseph E. Kennedy Jan 2000

Monstrous Offenders And The Search For Solidarity Through Modern Punishment, Joseph E. Kennedy

UC Law Journal

In this article, Professor Kennedy examines the tremendous increase in the severity of punishment in America in recent decades. He posits that criminal punishment has come to serve as a new civic religion of sorts for a society worried about its ability to cohere. The depth of our anxieties about our social solidarity, Kennedy argues, expresses itself in our monstrous conceptions of crime and in the corresponding severity of our punishment. His conclusion is that crime has come to serve as a rallying cry for a divided and insecure society, and that individuals and groups try to use punishment and …

Taking Trips To The Eleventh Amendment: The Aftermath Of The College Savings Cases, John O'Connor Jan 2000

Taking Trips To The Eleventh Amendment: The Aftermath Of The College Savings Cases, John O'Connor

UC Law Journal

This note examines the conflict between Eleventh Amendmentbased state sovereign immunity and Fourteenth Amendment-based congressional power to abrogate that immunity. In 1999, the Supreme Court handed down two opinions that dramatically redefined the relationship between federal government and the states. In the companion intellectual property cases, College Savings Bank v. Florida Prepaid Postsecondary Education Expense Board and Florida Prepaid Postsecondary Education Expense Board v. College Savings Bank, the Supreme Court held that Congress had improperly attempted to abrogate the states' sovereign immunity, overruling aspects of the Trademark Remedy Act and Patent Remedy Acts respectively. As a result of these cases, …

The Keepers Of The Gates: Intellectual Property, Antitrust, And The Regulatory Implications Of Systems Technology, Dana R. Wagner Jan 2000

The Keepers Of The Gates: Intellectual Property, Antitrust, And The Regulatory Implications Of Systems Technology, Dana R. Wagner

UC Law Journal

This Article identifies and analyzes an emerging trend in the legal regulation of high-technology industries. The Article begins by distinguishing between conventional forms of computer technology and "systems technology," the architectural technology that defines computing environments and determines the products with which they can interface. It argues that a doctrinal shift is occurring in the laws that regulate the competitive behavior of systems-technology innovators: a shift away from exclusionary entitlements and towards a system of liability-rule protections. As evidence of this shift, the Article examines recent legal disputes involving microprocessor technology and computer bus design.

The Article then argues that …

Beyond Relevant Conduct--The Federal Sentencing Commission's (In)Discretion: How U.S.S.G. Section 2g2.2(B)(4) Illustrates The Future Of The Sentencing Guidelines, Rebecca Poate Jan 2000

Beyond Relevant Conduct--The Federal Sentencing Commission's (In)Discretion: How U.S.S.G. Section 2g2.2(B)(4) Illustrates The Future Of The Sentencing Guidelines, Rebecca Poate

UC Law Journal

This Note explores the aftermath of the creation of the Federal Sentencing Guidelines and the choice to include relevant conduct as a sentencing criteria. It argues that peculiar, unintended consequences have largely been the result of this attempted reform. The inclusion of relevant conduct, despite its debatable connection to congressional intent, combined with a statute left over from pre- Guideline sentencing that mandates rampant judicial discretion at sentencing, has allowed the disparity-producing sentencing of old to creep back into the post-Guideline world. This time, however, the wide-ranging discretion to consider virtually any conduct at sentencing is comfortably hidden behind the …

An Electromagnetic Field Model For The Design Of Rf Reed Relays, Robert Anthony Harrison Jan 2000

An Electromagnetic Field Model For The Design Of Rf Reed Relays, Robert Anthony Harrison

School of Engineering, Computing and Mathematics Theses

A model of the electromechanical characteristics, electrostatic characteristics and coil eddy current losses of a reed relay was developed. These characteristics were returned from reed and coil dimensions. The model was intended as an aid to the design of reed relays for Radio Frequency (RF) and high voltage applications. An electromechanical model of a reed switch and coil was developed using a combination of an axisymmetric finite element model and analytical methods. The characteristics returned from this model were operate, release and differential amp turns, contact gap and contact force. Inclusion of results for contact resistance against contact force yielded …

From Warriors To Wingtips: The Leadership Transition Of Retired Officers Into The Public Sector, Lynn M. Eldred Edd

Dissertations

For personal and financial reasons some retired military officers seek second careers in the public sector. In entering local government, they are leaving a unique organization, and encountering a very different organizational culture. This study used grounded theory methodology to identify the key military leadership strategies and behaviors learned by military officers and to examine their applicability to local government. It focused on eleven retired naval and marine officers who served twenty or more years, attained a rank of lieutenant commander or major and above, and had worked in local San Diego government at the mid-management or executive level less …

On The Edge Of The Envelope. A Case Study Of The Children's Initiative: An Inquiry Into Collaboration And Shared Vision, Laurie Coskey Edd

Dissertations

While there are many collaborative efforts throughout the country, few have the breadth or the scope of the San Diego Children's Initiative. The general purpose of this research study was to analyze and develop an interpretive case study describing the initial collaborative process of the Strategic Action Committee of the San Diego Children's Initiative. The study focused on the initial phase of the collaboration which took place from November of 1993 through April of 1995. This study sought to determine some factors that may influence the potential success of a large-scale, multi-sector, private-public collaborative effort. The research analyzed the success …

A Comparative Study Of Leadership Characteristics Of Principals In Charter Schools And Traditional Schools, Roger M. Mestinsek Edd Jan 2000

A Comparative Study Of Leadership Characteristics Of Principals In Charter Schools And Traditional Schools, Roger M. Mestinsek Edd

Dissertations

The purpose of this study was to examine the similarities and differences in preferred leadership qualities among a random sample of principals of traditional elementary schools in California, traditional elementary schools in Alberta, Canada, and selected charter schools in the United States. The intent of the research was to identify the preferred leadership practices of each study group to determine and report significant differences and similarities. Seventy-five principals were randomly selected, 25 from each of the three study groups, to complete the survey. Forty-two principals (56%) returned surveys. Of the surveys returned, 40 were usable for the study. The theoretical …

A Cross-Case Study Of Teacher Perceptions Of Program Design And Teaching Efficacy: The Seaview Reading Support Program, Susan L. Bowers Smith Edd Jan 2000

A Cross-Case Study Of Teacher Perceptions Of Program Design And Teaching Efficacy: The Seaview Reading Support Program, Susan L. Bowers Smith Edd

Dissertations

Teachers at Seaview Elementary School developed an innovative reading support program delivered by classroom teachers to increase the achievement of children who struggled to read literature in the district's core curriculum. Although studies of the program's impact on student achievement indicated that many of the children who received services in the classroom were able to fluently read grade level materials and improve their scores on standardized tests, issues created by the additional burden of this instruction on some teachers prevented the integration of the program into other grade levels and schools in the Seaview School District and Seaview Elementary School. …

Physics Faculty Publications and Presentations

Emissions from household stoves, especially those using solid fuels, can contribute significantly to greenhouse gas (GHG) inventories and have adverse health impacts. Few data are available on emissions from the numerous types of cookstoves used in developing countries. We have systematically measured emissions from 56 fuel/stove combinations in India and China, a large fraction of the combinations in use world-wide. A database was generated containing emission factors of direct and indirect GHGs and other airborne pollutants such as CO2, CO, CH4, TNMHC, N2O, SO2, NOx, TSP, etc. In this paper, we report on the 28 fuel/stove combinations tested …

Estimation Of A Monotone Mean Residual Life, Subhash C. Kochar, Hari Mukerjee, Francisco J. Samaniego Jan 2000

Estimation Of A Monotone Mean Residual Life, Subhash C. Kochar, Hari Mukerjee, Francisco J. Samaniego

Mathematics and Statistics Faculty Publications and Presentations

In survival analysis and in the analysis of life tables an important biometric function of interest is the life expectancy at age x,M(x), defined by M(x)=E[X?x|X>x], where X is a lifetime. M is called the mean residual life function. In many applications it is reasonable to assume that M is decreasing (DMRL) or increasing (IMRL); we write decreasing (increasing) for nonincreasing (non-decreasing). There is some literature on empirical estimators of M and their properties. Although tests for a monotone M are discussed in the literature, we are not aware of any estimators of M under these order restrictions. In …

The Pursuit Of The Hunt, Interrupted: Changing Literary Image Of Law, William J. Wagner Jan 2000

The Pursuit Of The Hunt, Interrupted: Changing Literary Image Of Law, William J. Wagner

Scholarly Articles

In the course of reaching its substantive conclusions, this article seeks to shed light on the theoretical and methodological requisites of a valid and fruitful application of literary sources in jurisprudence.

The article begins by explicating the original literary image of the pursuit of the hunt interrupted, within its thematic setting in Aeschylus. It then offers theoretical and methodological postulates for drawing out the fuller meaning for law and legal studies of the image. It explores variations on the same pattern of imagery in subsequent works of Western literature, and offers reflections on how these variations can enrich our understanding …

Augmentative Communication Devices In The Classroom And Community, Matthew Sableski Jan 2000

Augmentative Communication Devices In The Classroom And Community, Matthew Sableski

Electronic Journal for Inclusive Education

Assistive technologies may be defined as "any item, device, or piece of equipment that is used to increase, maintain, or improve the functional abilities of persons with disabilities"(Holder-Brown & Parette, 1992, p.73). Devices such as automatic door openers, chair lifts, large print books, customized cars, hearing aids, and wheelchair ramps enhance the independence and productivity of persons with disabilities and increase their ability to participate in the mainstream of society. In a school setting, this technology is not an end in itself; rather it is a means to provide increased experiences, opportunities, and independence for children who have disabilities. Assistive …

Optimization Techniques For Data Intensive Decision Flows, Richard Hull, Francois Llirbat, Bharat Kumar, Gang Zhou, Guozhu Dong, Jianwen Su

Kno.e.sis Publications

For an enterprise to take advantage of the opportunities afforded by electronic commerce it must be able to make decisions about business transactions in near-real-time. In the coming era of segment-of-one marketing, these decisions will be quite intricate, so that customer treatments can be highly personalized, reflecting customer preferences, the customer's history with the enterprise, and targeted business objectives. This paper describes a paradigm called “decision flows” for specifying a form of incremental decision-making that can combine diverse business factors in near-real-time.

This paper introduces and empirically analyzes a variety of optimization strategies for decision flows that are “data-intensive”, i.e. …
