Critical Hermeneutics: The Intertwining Of Explanation And Understanding As Exemplified In Legal Analysis, George H. Taylor Dec 2000

Critical Hermeneutics: The Intertwining Of Explanation And Understanding As Exemplified In Legal Analysis, George H. Taylor

Chicago-Kent Law Review

Understanding and explanation are often viewed as oppositional: understanding is considered a search for the meaning a text provides, while explanation employs a critical, analytic method that maintains a distance from the text it interrogates. This Article demonstrates that in legal interpretation, understanding and explanation are not opposed but inextricably interconnected. Drawing first on the work of Robert Bork and Justice Antonin Scalia, this Article shows how elements of critique are present even within forms of legal interpretation that seek to maintain fidelity to the "understanding" of authorial meaning. Second, it illuminates the converse, that theories drawn to methods of …

A Communitarian Critique Of The Child Protective System, Toni Terling-Watt Dec 2000

A Communitarian Critique Of The Child Protective System, Toni Terling-Watt

The Journal of Sociology & Social Welfare

Child Protective Services (CPS) has been defined as an ineffective system. Common criticisms are that the system is overburdened and that family preservation policy pressures CPS to reunite families that can't be repaired. However, empirical analyses that identify the deficiencies of this organization are limited. This study utilizes case files and in-depth interviews with interventionists within and outside of CPS to explore the issue. Results reveal that the most common criticisms of the system do have merit. However, it reveals additional system limitations. Results suggest that the child protective system is characterized by an individualistic approach and that this focus …

The Role Of Organized Religions In Changing Death Penalty Debates, Michael L. Radelet Dec 2000

The Role Of Organized Religions In Changing Death Penalty Debates, Michael L. Radelet

William & Mary Bill of Rights Journal

In his Article, Professor Michael L. Radelet describes a global decline in the use of the death penalty, the United Nation's progressively stronger stance against executions, and a growing opposition to capital punishment in the United States. This decrease is attributed to both empirical studies casting doubt on the death penalty's efficacy in promoting its stated underlying goals, and to the increasingly vocal stance of religious leaders morally opposed to capital punishment. Nevertheless, the decline in other justifications for capital punishment has been met with increasing reliance on retribution as the primary argument in its support. Professor Radelet argues that …

The Founders Go On-Line: An Original Intent Solution To A Jurisdictional Dilemma, Christine G. Heslinga

William & Mary Bill of Rights Journal

The Internet has created a blossoming cyber-economy and a new way of conducting business. Unfortunately for those looking for jurisdictional certainty, however, cyberspace also effectively eliminates geographic boundaries. The unprecedented circumstances set by this new frontier have put federal courts in the unenviable position of deciding whether Internet-based cases meet diversity jurisdiction requirements. Examining the constitutional history and recent use of diversity, this Note argues that the Founders did not foresee an era where every contract or sales case would end up in federal court; rather, they intended diversity jurisdiction to be a rare and perhaps temporary proposition. The author …

A Synonym In The Genus Fluda (Araneae: Salticidae, G. B. Edwards Dec 2000

A Synonym In The Genus Fluda (Araneae: Salticidae, G. B. Edwards

Insecta Mundi

Galiano (1971) revised the genus Fluda Peckham and Peckham 1892, and later updated the revision with additional descriptions, including a new species (Galiano 1986). In her original revision, she transferred Keyserlingella perdita Peckham and Peckham 1892, from Colombia, into the genus. This species was described from both sexes, but only the female was adequately illustrated. Galiano (1971) noted that Banks (1929) had examined only the female type of K. perdita when he described the Panamanian Fluda princeps from both sexes. She concluded that the male of K. perdita was lost subsequent to its description but prior to Banks examination. If …

The Internet In Turkey And Pakistan: A Comparative Analysis, Peter Wolcott, Seymour E. Goodman Dec 2000

The Internet In Turkey And Pakistan: A Comparative Analysis, Peter Wolcott, Seymour E. Goodman

Information Systems and Quantitative Analysis Faculty Publications

The Global Diffusion of the Internet Project was initiated in 1997 to study the diffusion and absorption of the Internet to, and within, many diverse countries. This research has resulted in an ongoing series of reports and articles that have developed an analytic framework for evaluating the Internet within countries and applied it to more than 25 countries. (Seehttp://mosaic.unomaha.edu/gdi.html for links to some of these reports and articles.)

The current report applies the analytic framework to compare and contrast the Internet experiences of Turkey and Pakistan, through mid-2000. Although historically these countries have not been closely related, there are …

Influence Of Habitat Use Patterns On Cooperative Breeding In The Brown-Headed Nuthatch, Albert Herb Jr., D. Brent Burt Dec 2000

Influence Of Habitat Use Patterns On Cooperative Breeding In The Brown-Headed Nuthatch, Albert Herb Jr., D. Brent Burt

Bulletin of the Texas Ornithological Society

We document the habitat use patterns of the Brown-headed Nuthatch (Sitta pusilla). We describe how its habitat use patterns contribute to ecological constraints that may maintain cooperative breeding in this species. Brown-headed Nuthatches are pine specialists. In particularly, Brown-headed Nuthatches forage primarily on the bark and cones in the top distal portions of mature pines. Breeding territories differ considerably in pine density. We suggest that differences in pine density are an indicator of habitat and territory quality. We predict that additional studies will document that helpers are more common on relatively small territories with high tree densities and in habitats …
