In 1999, a federal jury, in the case of Planned Parenthood v. American Coalition of Life Activists, returned a verdict in plaintiff's favor to the tune of $100 million. At issue was whether the Web site known as The Nuremberg Files, as well as printed "wanted style" posters dubbed The Deadly Dozen, both listing personal information regarding abortion physicians, were "threats" under The Freedom of Access to Clinic Entrances Act of 1994 (FACE).

Divining Regulatory Intent: The Place For A "Legislative History" Of Agency Rules, Lars Noah

This Article juxtaposes the recent debates about statutory interpretation and the judicial uses of legislative histories with the relative quiescence over methods for interpreting agency regulations. The latter subject merits more attention than it has received given the relatively greater prevalence and practical import of legislative rules issued by administrative agencies as compared with statutory commands from the legislature. Unlike attempts to understand the legislature's original intent, whether by focusing solely on statutory text or considering extrinsic aids found in various pre-enactment explanatory materials, courts routinely defer to agencies' post-promulgation interpretations of the meaning of their regulations. Many researchers believe that nurses live in a dual structure, encompassing both the social and nursing worlds. They contend that these two worlds have contrasting views toward nurses. This is, while nurses are guided to establish professional status, society still expects them to remain in a dependent role. This conflict is assumed to have a negative impact on nurses’ psychological and functional states (Kalisch & Kalisch, 1983 & 1987). However, this assumption has not yet been explored sufficiently. The purpose of this study was to examine regular classroom teachers' attitudes to additional classroom support, both physical and personnel, for students with mild and severe intellectual disabilities who may be integrated into regular classrooms. The concerns of the regular classroom teachers with regard to the successful inclusion of students with intellectual disabilities are certainly merit addressing. As the regular classroom teachers are largely responsible for the education of these integrated students, it is worthwhile to examine their perceived support levels in relation to integrated students with intellectual disabilities. The purpose of this study is to explore and describe the experiences of a specific group of arts workers in an isolated rural community in the South West of Western Australia. These participants have all worked in the community as arts workers for an extended period of time. Through phenomenological research, the telling of these workers stories, it is anticipated that the research will highlight, strengthen and enrich the political and economic positions of these workers. Being a man or woman is at the core of human social lives and personal identity, and guides appropriate behaviours such as dress, mannerisms and relationships. Transvestism, or the practice of wearing the clothes of the other gender, challenges societal values and guidelines for behaviour. The attitude of society to this practice has varied from veneration to vilification depending on the period of history and the culture of the people. Interactionist theories of second language acquisition (SLA) claim that both comprehensible input and modified interaction in the target language are necessary for language learning. In the foreign language context, little opportunity exists for such input simply through exposure to the target language outside the classroom. Therefore, the quantity as well as quality of input within classrooms is especially important. However in spite of this fact many non-native teachers of second language, including English as a foreign language (EFL) teachers, tend to avoid using the target language in their classrooms. This study deals with the estimation of the optimal hedge ratios using various econometric models. Most of the recent papers have demonstrated that the conventional ordinary least squares (OLS) method of estimating constant hedge ratios is inappropriate, other more complicated models however seem to produce no more efficient hedge ratios. Using daily AOIs and SPI futures on the Australian market, optimal hedge ratios are calculated from four different models: the OLS regression model, the bivariate vector autoaggressive model (BVAR), the error-correction model (ECM) and the multivariate diagonal Vcc GARCH Model. The main advantages and disadvantages of the Telematics environment for talented mathematics students were investigated through a case study. The case study considered the interaction of, and opinions of 11 Year 9 students and the teacher/researcher. Participants were from nine schools in regional Western Australia, and were withdrawn from face-to-face classes to attend mathematics transmissions. Qualitative data were collected through student interviews, an anonymous questionnaire, tape recording of lessons, and teacher field notes. Students all agreed the main disadvantage occurred if timetabling for Telematics transmissions did not align with their local school class times for the same subject. The teacher …

The western rock lobster is the most valuable single-species fishery in Australia returning a commercial value of around $250 million annually. This fishery is considered fully exploited and requires careful management to ensure a viable and sustainable fishery. Scientists at Marine Research Laboratory, Western Australia have already built detailed computer models of the lobster fishery and further research is required to continuously update and refine these models to provide an accurate picture of the fishery. This case study examined lower secondary student attitudes towards social studies and identified the factors that influenced attitudes in one Catholic secondary school located in the Perth metropolitan area. A total of 4 75 students were enrolled in Years 8 to 10 at the school in 1999. A modified version of Student Attitudes Towards Social Studies (Moroz 1996) questionnaire with 94 items, was utilised to gauge secondary student attitudes towards the learning area. Dead Mothers, Lonely Daughters : Negotiating Intersubjective Space In Young Adult Fiction, Anna-Claire Walsh

This thesis examines the effect of maternal absence on the ability of three central female characters to develop intersubjective relationships in three novels for young adults. The theoretical framework is Jessica Benjamin's psychoanalytic theory of 'intersubjectivity' which seeks to transcend split complementarities such as active-passive creating a model that synthesises traditionally opposed terms. Benjamin situates maternal subjectivity as the foundation from which a baby's identity is constructed and attributes women with both active and passive qualities. The relationship between mother and infant consequently acts as a paradigm for understanding the interaction between adult subjects in later life. Chapter One introduces …

This thesis describes the development of the application mapCAST, a computer-based concept-mapping tool that allows synchronous collaboration via TCP/IP networks, such as the Internet The useability and feasibility of mapCAST as a computer-based tool was examined and analysed in a real world situation. Results indicate that mapCAST is successful as a collaborative tool in a situations involving knowledge organisation, but lacks certain functionality that many Macintosh users are accustomed to.

This thesis is an analysis of Peter Carey's novel Jack Maggs and its attempt at writing back to Charles Dickens' Great Expectations. I will analyse the (de)construction of language games between Jack Maggs and Great Expectations; show how Carey as a post-colonial settler writer writes back to the centre, to Dickens' text as a canonical Victorian novel, through intergrating the very notion of the Victorian novel, and in his own terms giving the convict a "history". The aim of this thesis is to explore representations of class, social realism and region in Eleven months in Bunbury by James Ricks. This novel stands outside dominant literary theory in its representations of class, realism and regionalism. It also presents opportunities to consider ideology and class through the eyes of a working class person, in the language of the class that it depicts. Thus it speaks to a class which rarely has its point of view and lives represented in conventional literature. It is therefore a useful literary and social document.

Implementing new curriculum models for the first time can be difficult for teachers, especially those recently graduated. This study captured some of these challenges and difficulties, and the substantial rewards, through recording the teacher's reactions and reflections as he implemented his first season of SEPEP. The perceptions of the students involved in the season were recorded as a way of validating the teacher's reflections. When people practice a task, their performance in terms of speed and accuracy normally improves in a smooth manner that follows a power function. The consistency with which the performance of a wide range of skills conforms to this power function relationship is known as the Power Law of Learning, and has been an important assumption of many of the dominant theories of skill acquisition and transfer. The purpose of this study was to examine children’s attitudes towards Aboriginal and Non-Aboriginal peers with Conduct Disorder. A 2 x 2 x 2 factorial design was used to test the hypotheses. The three independent variables were: (a) Ethnicity of the target student (aboriginal/ Non-Aboriginal) described in a vignette, (b) disability or the target student (no disability/ conduct disorder) described in a vignette; and (c) the gender of the participants. A psychological sense of community (PSOC) has been found to facilitate adjustment and well-being. However, little research has been conducted in Australian universities. In order to gain a deeper understanding of the phenomena, a qualitative approach was adopted. In this thesis I will examine the construction of the concept of Virtual Reality. I argue that rather than a technology of liberation as it is often perceived, virtual realities' conception has been influenced significantly by a discourse of control and order. I examine books, articles and films concerning Virtual Reality to support this claim. Furthermore this discourse of control and order is born out of a larger ideology of Western culture that values order and control. Carl Jung's notion of contrasexuality allows women to embrace the masculine as well as feminine aspects of their personality. This creates a sense of complementarity or balance that is often lacking in the established psychoanalytic interpretation of female representations within mm texts. The 'animus,' or masculine complex, is an empowering theory in understanding representations of women within the filmic text as embarking on a process of self-realisation, self-acceptance, and the discovery of their own authority in the context of their relationships with men. Furthermore, the animus has been credited as Jung's greatest contribution to the study of the female psyche. …
