The Christian Librarian

I approach the topic of Internet filters as a librarian at a Christian liberal arts institution of higher education, PointLomaNazarene University (PLNU). The following should not be taken as an official statement regarding PLNU policy. No doubt Christian librarians at public libraries find they must address these issues differently from those encountered at Christian campuses.

Transparent Adjudication And Social Science Research In Constitutional Criminal Procedure, Tracey L. Meares, Bernard Harcourt Jan 2000

Transparent Adjudication And Social Science Research In Constitutional Criminal Procedure, Tracey L. Meares, Bernard Harcourt

Faculty Scholarship

The October 1999 Term was a year of consolidation in the law of police investigations in constitutional criminal procedure. In four short and compact opinions – three supported by sizeable majorities and three written by the Chief Justice – the Supreme Court synthesized and consolidated its criminal procedure jurisprudence, and offered clear guidance to law enforcement officers and private citizens alike. Miranda warnings are required by the Fifth Amendment, and the police must continue to "Mirandize" citizens before conducting any custodial interrogations. Reasonable suspicion under the Fourth Amendment calls for a totality-of-the-circumstances test, and a citizen's flight from the police …

The President And Choices Not To Enforce, Peter L. Strauss Jan 2000

The President And Choices Not To Enforce, Peter L. Strauss

Faculty Scholarship

The executive branch is often called upon to assess how a particular statute it is charged to administer fits within the larger framework of the law. Professor Dawn Johnsen's thoughtful analysis addresses an important subset of these challenges: situations in which the President believes a particular statute is inconsistent with one or another provision of the Constitution and, therefore, should not be enforced. My purpose here is to explore the context of executive non-enforcement more broadly, in a way that may help in understanding the particular problem she addresses.

Issues of constitutional structure and function are among the most daunting …

Liberality, Philip A. Hamburger Jan 2000

Liberality, Philip A. Hamburger

Faculty Scholarship

Did late eighteenth-century Americans ever consider themselves liberal? To many historians, this will seem a strange question. The concept of liberalism is widely held to be a nineteenth-century innovation, and therefore to inquire whether Americans in the previous century thought of themselves as liberal seems anachronistic.

Yet precisely because so many scholars take for granted the late evolution of liberal ideas, it may be all the more valuable to reexamine this assumption. Is there really no evidence that eighteenth-century Americans considered themselves liberal? Although they may not have embraced later concepts of liberalism, is it not at least possible that …

Street Stops And Broken Windows: Terry, Race And Disorder In New York City, Jeffery Fagan, Garth Davies Jan 2000

Street Stops And Broken Windows: Terry, Race And Disorder In New York City, Jeffery Fagan, Garth Davies

Faculty Scholarship

Patterns of "stop and frisk" activity by police across New York City neighborhoods reflect competing theories of aggressive policing. "Broken Windows" theory suggest that neighborhoods with greater concentration of physical and social disorder should evidence higher stop and frisk activity, especially for "quality of life" crimes. However, although disorder theory informs quality of life policing strategies, patterns of stop and frisk activity suggest that neighborhood characteristics such as racial composition, poverty levels, and extent of social disorganization are stronger predictors of race- and crime-specific stops. Accordingly, neighborhood "street stop" activity reflects competing assumptions and meanings of policing strategy. Furthermore, looking …

Drug Treatment Courts And Emergent Experimentalist Government, Michael C. Dorf, Charles F. Sabel Jan 2000

Drug Treatment Courts And Emergent Experimentalist Government, Michael C. Dorf, Charles F. Sabel

Faculty Scholarship

Despite the continuing "war on drugs," the last decade has witnessed the creation and nationwide spread of a remarkable set of institutions, drug treatment courts. In drug treatment court, a criminal defendant pleads guilty or otherwise accepts responsibility for a charged offense and accepts placement in a court-mandated program of drug treatment. The judge and court personnel closely monitor the defendant's performance in the program and the program's capacity to serve the mandated client. The federal government and national associations in turn monitor the local drug treatment courts and disseminate successful practices. The ensemble of institutions, monitoring, and pooling exemplifies …

Collegiate Aviation Maintenance Programs: Focus On Quality Or Safety?, Alan J. Stolzer Jan 2000

Collegiate Aviation Maintenance Programs: Focus On Quality Or Safety?, Alan J. Stolzer

Journal of Aviation/Aerospace Education & Research

Safety is a prime concern of managers of collegiate aviation maintenance facilities, but often the 'safety' program developed is not as effective as the managers desire. A literature review was conducted to explore the relationship between quality and safety programs, and to determine whether coupling a safety program with a comprehensive quality program might produce better results. Strategies such as behavioral sampling, fishbone diagrams, flow charts, and statistical process control (SPC) - all techniques used extensively in the quality profession - can reveal system flaws and lead to continuous improvement. The literature review suggests that the implementation of a quality …

Pilot Education: The Beginnings, Tim Brady Jan 2000

Pilot Education: The Beginnings, Tim Brady

Journal of Aviation/Aerospace Education & Research

For those of us involved with flight education, it is easy to take for granted some of the concepts that we practice daily, concepts such as a standardized flight curriculum, periodic flight checks, clearly defined flight instruction procedures, and progression from the simple to the more complex aircraft. These concepts did not simply appear full-blown, they were born, shaped, and modified via the crucible of world conflict. To find the roots of these flight education concepts, we have to look to Europe, to the early days of flight, to 1914, to what we now call World War I.

Aviation Students In Industry: Strategies That Enhance Learning, Michael Leasure, David Stanley Jan 2000

Aviation Students In Industry: Strategies That Enhance Learning, Michael Leasure, David Stanley

Journal of Aviation/Aerospace Education & Research

It is important that the graduates of aviation training schools possess both academic training and practical experience. Academic training is often the most convenient to provide in that a classroom, a lab facility, an instructor, and samples of the parts and equipment related to the learning objectives are all that is required. It is a structured and accepted process that continues under the watchkl eye of the Federal Aviation Administration and the mandates of federal law.

Developing Future Aviation Leaders: Advice From Today’S Leaders!, Mary N. Kutz Jan 2000

Developing Future Aviation Leaders: Advice From Today’S Leaders!, Mary N. Kutz

Journal of Aviation/Aerospace Education & Research

Because of their technical achievements, aviation personnel frequently find themselves in positions of influence or leadership in the community. The soft skills, which aid in the transition from a highly technical career to the intangible tasks of leadership, may have been neglected, thus making their new role even more difficult. Utilizing the findings of a qualitative study and a series of interviews with successful aviation leaders of Oklahoma, this paper addresses specific recommendations from today's leaders for filling the gap between the technical and soft skills required for effective leadership. Increased emphasis on communications curricula, development of decision-making and critical …

Suspected Unapproved Parts In The Aviation Industry: Consideration Of System Safety And Control, Steven J. Sletten

Journal of Aviation/Aerospace Education & Research

It is well known and highly touted that there is a historically high level of safety in U.S. air transportation. The American traveling public has come to expect this level of safety in the skies. Key elements in maintaining this high level of air safety are specific federal regulations, along with Federal Aviation Administration (FAA) surveillance, inspection, and enforcement activities. The U.S. Code of Federal Regulations include a framework of rules governing the design, manufacture, and use of aviation products and parts. The rules are in place to assist the aviation industry in maintaining its excellent safety record, and serve …

Gender Differences In An Aviation Physiology Environment, Cass D. Howell Jan 2000

Gender Differences In An Aviation Physiology Environment, Cass D. Howell

Journal of Aviation/Aerospace Education & Research

Men still dominate flying by better than a ten to one ratio, but there is no question that female participation in all aspects of aviation has increased dramatically in the past decade, and will no doubt continue to do so in the future. Although women have been flying airplanes since 1910, little attention was paid to them in terms of suitability and adaptability to flight, as compared to their male counterparts, until recently. It wasn't until the 1980's, after Congress modified existing law to allow women into the flight programs of the military in large numbers, that studies to ascertain …

The Development Of A Job Performance Aid Design Model For Use In Aviation, Anthony J. Adamski Jan 2000

The Development Of A Job Performance Aid Design Model For Use In Aviation, Anthony J. Adamski

Journal of Aviation/Aerospace Education & Research

The aviation industry depends heavily on the high-reliability of its equipment and human performers. One method used to assist human performance has been the job performance aid. Traditionally job performance aids were only considered repositories for information and substitutes for training. Today, however, job performance aids have taken on a new role that includes aiding the human information process. Consequently, it was determined that an effective job performance aid design model would be beneficial to those responsible for job performance aid design. This article presents an overview of a study that incorporated principles from the fields of instructional technology and …

Data were gathered using a questionnaire presented to U.S. Air Force aircrew members currently flying fighter aircraft. The data were analyzed using a nonparametric Chi-Square test to determine if the voice of a person in a position of authority significantly commands more attention than the female voice. The null hypothesis …

International Copyright: From A "Bundle" Of National Copyright Laws To A Supranational Code?, Jane C. Ginsburg

Faculty Scholarship

In recent years, the number and content of substantive norms that international copyright treaties impose on member states have increased considerably. It is therefore appropriate to consider the extent to which those instruments have in effect created an international (or at least multinational) copyright code, as well as to inquire what role national copyright laws do and should have in an era not only of international copyright norms, but of international dissemination of copyrighted works. This Article first considers the displacement of national norms through the evolution of a de facto international copyright code, elaborated in multilateral instruments such as …

Perceived Personal And Societal Control Of Events And Millennial Irrationalism, Angela Nicole Dennis

Dissertations and Theses @ UNI

The purpose of the present study was to investigate the relationship among millennial irrationalism and the degree to which people believe they have control over the events in their lives as reflected by performance on a locus of control scale. This belief is referred to in this study as internal or external locus of control. It was hypothesized that individuals who feel that they have considerable control over the things that happen to them would express less irrationalism than those who tend to ascribe the course of their lives more to external factors. It was also predicted that there would …

An Exploration Of Social Withdrawal In Adolescence, Ryan Lee Channel Jan 2000

An Exploration Of Social Withdrawal In Adolescence, Ryan Lee Channel

Dissertations and Theses @ UNI

Social withdrawal is most frequently described in the literature as a form of social maladjustment characterized by a lack of prosocial and cooperative behaviors combined with shyness, anxiety, and oversensitivity leading to withdrawal from social interactions and avoidance of the peer group. Social withdrawal can lead to rejection by the peer group, with the assumption being that peers would not necessarily reject the socially withdrawn student if the child interacted appropriately in social situations. The opposite, however, may also be true. The rejection by peers may be the cause of the social withdrawal. This study focuses on an adolescent who …

Success & Failure Of The Sewerage Privatisation In Malaysia : A Management Perspective, Izali Sulaiman

Student Works (2000-2009)

It is depressing to note that the sewerage condition in the country has long been in a deplorable state that untreated waste and unhygienic sanitation is widespread. So little emphasis has been placed on the development of this public utility sector where lack of funds and expertise has always been the logical excuse. The development pace has been too slow to meet the demands of the country's progress and environmental disaster; somehow, looms in the near future. The sewerage privatisation was seen as a necessary move by the government and in doing so, changed the industry from being public-owned to …
