What began in the 1950s as a small patch of weeds near a grain elevator in Juab County, turned into a serious environmental problem that impacts the state’s wildlife, grazing and tourist industries. In the early 1990s, it was estimated that squarrose knapweed infested nearly 200,000 acres of rangeland in central Utah.

How diverse aspects of an organism’s environment influence the structure and function of its genes is of profound importance for understanding the molecular basis of evolution as well as the causes of disease, cancer and aging. Genes and the Environment addresses these issues from a molecular biological perspective. High school education is currently based upon technicist pedagogy, transforming education into mere technical training for the workforce. The regimen of testing in schools standardizes experiences and fails to provide a complete view of what students know and are able to do. Students need freedom to question and to insert their own interests into what they are studying. Such freedom provides more than preparation for graduation; it provides emancipatory education. I focused on a single curricular program—Senior Project. Many species of Neotropical migrant songbirds have been reported to be declining in the last few decades, and the loss and fragmentation of stopover habitat has been implicated as a potential cause of these population declines. To manage properly a fragmented forest landscape for migrating songbirds information is needed on how the size and the habitat of forest fragments influence their use by migrants during stopover. Breastfeeding involves phases of initiation, continuation, and weaning. Research to date has focused upon its initiation and continuation rather than the later phases, when the child is weaned from the breast. Selective aspects relating to weaning have been explored to determine infant feeding practices such as the timing of food introduction. However, that research has focused upon developing countries where the impact of infant feeding patterns and weaning practices have a significant impact on infant growth and child health. "Waive" Goodbye To Tort Liability: A Proposal To Remove Paternalism From Product Sales Transactions, Richard C. Ausness

This Article argues that waivers of tort liability should be permitted in connection with product sales. Currently, sellers cannot limit their liability under tort law for personal injuries caused by defective products even though such waivers are allowed, albeit reluctantly, under principles of negligence and warranty law.

Cultivating The Genetic Commons: Imperfect Patent Protection And The Network Model Of Innovation, Jonathan M. Barnett

This Article enters this debate and argues the following position. Assuming that antitrust authorities persist in certain strategies to impede patent consolidation, the recent introduction of patent rights for certain biotechnological innovations is likely to encourage private investment in the genetic commons and reduce (or, at least, not enhance) the accessibility costs that could stunt technological advance. To reach this conclusion, this Article shows that the two leading theories of patent protection, the "incentive" theory7 and the "prospect" theory,8 do not explain private industry's willingness to sink significant investment capital into highly uncertain biopharmaceutical projects. To determine the extent to which Aboriginal title-holders enjoy control over Aboriginal title lands, it is necessary to explore fiduciary doctrine, for the application of this doctrine to the question of legislative infringement determines the limits within which Aboriginal title-holders can expect to see their interests respected. In Delgamuukw the Supreme Court of Canada adopted and applied an understanding of the Crown-Aboriginal fiduciary relationship it developed in Gladstone. In so doing the Supreme Court set out the power of Canadian governments to control the uses to which Aboriginal title lands can be put. Ironically, since Aboriginal title is characterized by …

Part of Professor William Eskridge's mission in Gaylaw (Gaylaw: Challenging the Apartheid of the Closet by William N. Eskridge, Jr., Harvard University Press, 1999) is to describe the historical development of the complex legal and, to some extent the cultural, landscape for gays. (pp. 17-137) Though not much of Eskridge's presentation of the history of American law's treatment of gays draws from original research, its synthesis of the available secondary sources is a useful contribution and will likely become a staple of classes treating the subject.

The last fifteen years have witnessed significant changes in the way that charitable contributions by individuals are treated under the Canadian Income Tax Act. The most significant of these changes involves the conversion in 1988 of what had previously been a deduction for charitable contributions whereby the value of the tax benefit depends on the donor?s level of income, into a tax credit under which the value of this benefit depends on the total amount of charitable contributions claimed in the particular taxation year. How parents view the nature of a child and their own role as parents has great influence over the life of that child. Many perspectives about the nature of children have arisen in the course of Western Civilization that have shaped childrearing practices for centuries, including the increasingly accepted scholarly view that parents matter relatively little in children’s lives. (2) This chapter emphasizes inspired, eternal principles that are supported by empirical and conceptual scholarship, which suggests that optimal parenting does indeed matter in children’s lives.

The Relationships Of Organizational Personality Variables With Worker Socio-Communicative Orientation, Communication Apprehension, Immediacy, And Job Satisfaction., Heather Teresa Smith

This study examined the organizational personality types of "upward mobile," "ambivalent," and "indifferent" with reference to their relationships with worker sociocommunicative orientation, communication apprehension, immediacy, and job satisfaction. The study examined self-report data from the measures of organizational personality scales, job satisfaction, communication apprehension, immediacy, and assertiveness/responsiveness. The study found that each of the three personality variables have unique relationships (some linear, some non-linear) with communication apprehension, immediacy, assertiveness, responsiveness, and job satisfaction.
