Environmentally Friendly Ranching? An Interview On The High Desert, Lisa Johnson Jan 2000

Environmentally Friendly Ranching? An Interview On The High Desert, Lisa Johnson

Animal Law Review

The following is an interview with Doc Hatfield about his views on raising cattle and his association with Oregon Country Beef, a cooperative organization that his wife, Connie, helped start in 1986. Doc was on his cell phone while we talked, as he and Connie were on their way to Portland from their High Desert Ranch in Brothers, Oregon to give a talk to an agricultural group. Connie was driving while Doc and I spoke. They have a rule against driving and talking on the phone at the same time. I agreed that was probably a good policy.

Feedlots -- Rural America's Sewer, Marilyn Lee Nardo Jan 2000

Feedlots -- Rural America's Sewer, Marilyn Lee Nardo

Animal Law Review

Over one billion tons of animal waste is produced each year in the United States by animal feedlot operations (AFOs). In 1995 alone, 63.5 million gallons of manure spilled from AFOs. Manure spills poison rivers, lakes, and ponds, seep into groundwater, causing fishkills, human disease, and death. The United States Environmental Protection Agency, reports that AFOs are a primary factor in the impairment of forty percent of the nation's waterways. Despite these conditions, there are no federal standards for the storage, application, or management of animal waste. This Comment evaluates the existing regulation of AFOs under the Clean Water Act …

Asset Forfeiture And Animal Cruelty: Making One Of The Most Powerful Tools In The Law Work For The Most Powerless Members Of Society, Amy A. Breyer

Animal Law Review

Animals have historically been one of the most vulnerable segments of society to crime due both to their status as property and their inability to aduocate for themselves. While this has long worked to their disadvantage, developments in an area ofjurisprudence where criminal and property law merge now offer an unprecedented possibility. Forfeiture laws have become one of the most powerful and effective tools in the war against crime. The principles and precedents that have emerged from asset forfeiture are aptly suited to application in the animal cruelty context as well. This article discusses asset forfeiture and animal cruelty, offering …

Animal Custody Disputes: A Growing Crack In The "Legal Thinghood" Of Nonhuman Animals, Barbara Newell Jan 2000

Animal Custody Disputes: A Growing Crack In The "Legal Thinghood" Of Nonhuman Animals, Barbara Newell

Animal Law Review

Despite the traditional view of animals as mere chattels, courts are increasingly viewing animals as more than "things," recognizing the intrinsic value of animal companions. With the help of organizations such as the Animal Legal Defense Fund, case law, local ordinances, and popular attitudes are changing, reflecting the understanding that animals have the capacity to live full mental and emotional lives. This essay tracks these changes, arguing that the time has come to recognize a different legal status for companion animals.

Concluding The Uruguay Round---Creating The New Architecture Of Trade For The Global Economy, Peter D. Sutherland

Fordham International Law Journal

This Essay is an attempt to go back to some of the principles and factors which lay behind the launching of the Uruguay Round and the package which resulted, to look at some of the current unease about the WTO, and to see where the institution may need to go to reassert its role to command fully public and political confidence once again.

"Working" With The Ada's "Regarded As" Definition Of A Disability, Thomas Simmons Jan 2000

"Working" With The Ada's "Regarded As" Definition Of A Disability, Thomas Simmons

Faculty Publications

The Americans with Disabilities Act of 1990 prohibits discrimination against and mandates accommodations for individuals with disabilities. As a threshold matter, the Act requires the plaintiff to demonstrate that she is an individual with a disability; that is, that she has an actual disability or is "regarded as" having a disability as the statute defines it. This article discusses the threshold "regarded as" showing as refined by three Supreme Court cases decided in the summer of 1999. Although in the past the "regarded as" definition has often played "second fiddle" to the "actual disability" definition, the author suggests that there …

Managing Population-Environment Systems: Problems Of Institutional Design, Geoffrey Mcnicoll Jan 2000

Managing Population-Environment Systems: Problems Of Institutional Design, Geoffrey Mcnicoll

Poverty, Gender, and Youth

In population–environment systems human activity is inherently part of the system rather than something to be minimized in order to maintain or restore “natural” environmental conditions. Issues arising in managing such systems are discussed in this paper. The system’s boundaries must be identified, defining its human participants and its ecological content. Procedures for monitoring demographic and environmental change in the system must be set up and consensus must be reached on how to evaluate that change.

The Constitutionality Of Mandatory Public School Community Service Programs, Rodney A. Smolla Jan 2000

The Constitutionality Of Mandatory Public School Community Service Programs, Rodney A. Smolla

Law Faculty Publications

Proposals for public service programs have long had currency in America, and may be gaining a certain millennium momentum in current public debate. While proposals for national public service programs of varying ambition and scope continue to be debated, at the local level a growing number of U.S. public school districts are implementing community service programs for high school students. Community service programs generally require students to complete a specified number of hours of service as a condition for graduation. In a typical program, a student may be required to complete forty to sixty hours of community service with organizations …

On Causation, Mari J. Matsuda Jan 2000

On Causation, Mari J. Matsuda

Georgetown Law Faculty Publications and Other Works

In this Essay, Professor Matsuda argues that the narrow dyadic focus of tort law perpetuates very real, and remediable, social harms. Using tort causation doctrine as her starting point, Professor Matsuda demonstrates how the tort system sacrifices human bodies to maintain the smooth flow of the economic system. Time after time, tragedies occur: school systems fail, first graders shoot each other, women live in constant fear of rape. Yet each tragedy is met with the same systematic response: those without resources, those least able to correct the harm, are considered the legal cause of the harm. The economic and corporate …

The Collusion Of Law And Science In The Piracy Of Human Genes, Tina Piper Jan 2000

The Collusion Of Law And Science In The Piracy Of Human Genes, Tina Piper

Dalhousie Journal of Legal Studies

Advances in biotechnology over the last decade have created a demand for biological resources by transnational corporations. The search for biological resources has primarily focused on acquiring these resources from indigenous communities and countries of the South. However, the means by which these biological resources are obtained is exploitative and often tantamount to theft (or, as it is commonly known, biopiracy). As a result of communities attempting to prevent this theft and corporations seeking more international legitimacy for their "bioprospecting", "bioprospecting contracts" are more frequently being concluded between governments and corporations. Through the prism of current events in Iceland, I …

Adolescents And Reproductive Health In Pakistan: A Literature Review, Ayesha Khan Jan 2000

Adolescents And Reproductive Health In Pakistan: A Literature Review, Ayesha Khan

Reproductive Health

This report reviews research and findings on adolescents and reproductive health in Pakistan. The material is drawn from a range of national surveys and medical research, as well as information gathered by nongovernmental organizations. Although adolescents make up a quarter of the population of Pakistan, they are still a new subject for research. The characterization of adolescents for this review is individuals ages 10–19, whether or not they are married, sexually active, or parents. The discussion of the research material is based on the assumption that adolescence is a developmental phase, a transition from childhood to adulthood. Basic data on …

Vse Luchshe Detiam: All The Best To The Children, Soviet Ideology In Children's Fairy Tale Cartoons, Matthew Boyd '00

Honors Projects

I have chosen as a focus the analysis of fairy tale cartoons in the Soviet Union and have attempted to establish the specific ideological use of five films spanning 1947-1979. For the analysis of these cartoons as ideological tools I have established a theoretical apparatus. This apparatus is based upon a thorough definition of ideology as it applies to these films taken from Terry Eagleton's book Ideology. I have adopted Vladimir Propp's theoretical apparatus on the classification of fairytales from his book Morphology of the Folktale. To aid both in interpreting the history of the 1920s to 1970s Soviet Union …
