The Heuristics Of Intellectual Due Process: A Primer For Triers Of Science, Erica Beecher-Monas

Scientific evidence is an inescapable facet of modern litigation. The Supreme Court; beginning with the seminal case of Daubert v. Merrell Dow Pharmaceuticals, Inc, and continuing with General Electric Co. v. Joiner and Kumho Tire Co. v. Carmichael, has instructed federal judges to evaluate the scientific validity of such evidence in determining the evidence's adinissibiliV. In this Article, Professor Erica Beecher-Monas argues that many judges ignore the science component of their "gatekeeping" duties, focusing instead on rules of convenience that have little scientific justification. DRS Conference Volumes

The La Clusaz conference focused on four central themes:

1 philosophies and theories of design

2 foundations and methods of design research

3 form and structure for the doctorate in design

4 the relationship between practice and research in design

Participants presented findings, debated ideas, proposed benchmarks for the future development of the doctorate in design, and entered into dialogue on how to develop programs. The conference encouraged participants to interact, using each session as a genuine opportunity to confer. One important goal of the conference was establishing significant working relationships, research alliances, and partnerships among universities.

Fecundity Of Litopenaeus Setiferus, Farfantepenaeus Aztecus And F. Duorarum, In The Southwestern Gulf Of Mexico, Martin Perez Velazquez, Adolfo Gracia

Gulf and Caribbean Research

Fecundity of white shrimp, Litopenaeus setiferus, brown shrimp, Farfantepenaeus aztecus, and pink shrimp F. duorarum and relationships to gonad weights and total and carapace length were estimated. Ovigerous females were collected in the southern Gulf of Mexico in February, May, August and November 1993. Fecundity was estimated by means of a gravimetric method. The equations relating fecundity to total weight and fecundity to gonad weight were linear in the 3 species. However, an exponential relationship was found between fecundity and carapace length in L. setiferus and F. aztecus. Of the relationships examined, gonad weight was considered a …

Protein Polymorphism In Two Populations Of The Brown Ear Tick, Rhipicephalus Appendiculatus Neumann (Acari: Ixodidae), F. N. Baliraine, E. O. Osir, S. B. Obuya', F. J. Mulaa

Two-dimensional gel electrophoresis was used to compare the protein profiles of two geographically isolated populations of the tick Rliipiccplmlus appcndiciilalus Neumann (Acnri: Ixodidne) in Kenya. Most of the protein spots were common to both populations, but a number were specific to each population. Since proteins are encoded by genes, the presence of populationspecific proteins suggests that there.may be genetic differences between the two populations. It is proposed that some of these population-specific proteins might be related to the differences in susceptibility of the ticks to Thcikria pawn infection. ©2000ICIPE.

Quartering Species: The Living Constitution, The Third Amendment, And The Endangered Species Act, Andrew P. Morriss, Richard L. Stroup

Faculty Scholarship

The authors argue that the fundamental flaw in the Endangered Species Act (ESA) is that it fails to force government decision makers to consider the opportunity cost of their actions, resulting in flawed decision making that imposes heavy costs on landowners without actually protecting endangered species. The authors develop this analysis through an examination of the ESA in light of the modern "living Constitution" theory of interpretation. They conclude that under this theory the ESA's "quartering of species" on private land violates the Third Amendment's ban on quartering soldiers.
