Perhaps following broader legal trends, the Eleventh Circuit's environmental law decisions in this survey period suggest a rise in the importance of state law, both as it might impact enforcement of federal environmental programs and as a source of independent environmental remedies. As an example of the former, the court narrowed the extent to which the absence of a state-level program to implement the federal Clean Water Act's permit requirement shields a member of the regulated community from the obligation to obtain a permit. "Images of Christ in Latter-day Saint Visual Culture" by Noel Carmack offers an outline of the history of the Latter-day Saint use of images depicting Christ, pointing out influences and tensions that Carmack argues directed the choice of these images from 1890 to 1999. My own approach to this historical pattern is a simpler one: the selection of images of Christ by most Latter-day Saints today is influenced more than anything else by the Saints' cultural background, which determines how they think Jesus would look; and the proliferation of these images is largely an economic issue and a result of …

This publication is a revision of the previous swine nutrition publication prepared by the University of Nebraska and South Dakota State University. The focus of the publication continues to be on nutrient recommendations for swine. Specific factors (nutritional, environmental and managerial) that affect nutrient recommendations (Figure 1) have been considered and discussed. We believe that the identification and description of the factors in Figure 1 provide the framework for the nutrient recommendations presented in Tables 11 to 16. Because of their inherent abstraction, systems ideas are not themselves sufficient for gaining scientific knowledge or solving practical problems, but they can be a source of insights into the universality of imperfection, insights which can contribute to a new scientific world view. Systems theory offers a metaphysics, or more precisely an ontology, of imperfection. Through it, we can heed Spinoza's injunction, “Not to lament, not to curse, but to understand.”

Kentucky Transportation Center Research Report

Two-lane rural roads in Kentucky have the highest fatal crash rate of any type of highway in Kentucky. This report is the first phase of a study with the objectives of: 1) identifying safety problems related to crashes on two-lane rural roads, 2) identifying high-crash locations, ad 3) recommending possible improvements. The procedure used in this phase of the study involved an analysis of crash data to identify characteristics of crashes on two-lane rural roads, use of the crash data to identify one-mile sections having critical crash rates, and a review of countermeasures to start development of recommendations to reduce …

Chronic arsenic exposure has been associated with a range of neurologic, vascular, dermatologic, and carcinogenic effects. However, limited research has been directed at the association of arsenic exposure and human reproductive health outcomes. The principal aim of this study was to investigate the trends in infant mortality between two geographic locations in Chile: Antofagasta, which has a well-documented history of arsenic exposure from naturally contaminated water, and Valparaíso, a comparable low-exposure city. The arsenic concentration in Antofagasta's public drinking water supply rose substantially in 1958 with the introduction of a new water source, and remained elevated until 1970. We used …

The purpose of the Establishment Clause is not to safeguard individual religious rights. That is the role of the Free Exercise Clause, indeed its singular role. The purpose of the Establishment Clause, rather, is as a structural restraint on governmental power. Because of its structural character, the task of the Establishment Clause is to limit government from legislating or otherwise acting on any matter "respecting an establishment of religion." Two thousand years after the writing of Psalm 139, Andreas Vesalius (Figure 1) began to unlock the mysteries of the human body. When Vesalius was born in Brussels in 1514, no one could have foreseen that anatomy would be changed forever. During Vesalius’ time, the teachings of the Greek physician Claudius Galen (130-201 A. D.) were the ultimate authority on anatomy. Because Galen had dissected very few (if any) human cadavers, his anatomical descriptions were limited to animal dissections. Galen’s works contained many errors because his conclusions regarding human body functions were based on data obtained from nonhuman animals. Vesalius …

Three years after the first CD-ROM brief was accepted, there is debate on acceptance as a regular practice. Issues include what the legal profession and the courts have done about adopting CD-ROM briefs, what obstacles are being encountered, and how those obstacles are being dealt with. Both views are examined along with the circumstances in which a CD-ROM brief is likely to be accepted favorably by a court.

Agricultural land values and cash rental rates in South Dakota, by region and by state, are the primary topics of this report, which is written for farmers and ranchers, landowners, agricultural professionals (lenders, rural appraisers, professional farm managers, Extension agents, and educators), and policy makers interested in agricultural land market trends. A new movement in America espousing a novel doctrine, property-rights absolutism, has gained some popular and political appeal. But the property rights absolutists tend to ignore the societal foundations of property, and especially de-emphasize the responsibilities property owners have to the community in which they live. They fail to consider properly the significance of the police power and its vital role in the American and Washington State constitutional systems. This Article debunks the newly minted mythology of the property-rights absolutists and places the police power and property rights in their proper historical perspective.
