Identification Of The Unknown Soldier And The Fight For The Right To Anonymity: The Human Genome Project And Implications Of A National Dna Database, Kelly S. Erbes Jan 1999

Identification Of The Unknown Soldier And The Fight For The Right To Anonymity: The Human Genome Project And Implications Of A National Dna Database, Kelly S. Erbes

Cleveland State Law Review

The focus of this writing is the use of DNA for identification purposes and the issues that arise when genetic traits and/or predisposition to physical or mental conditions are linked to the individual specifically, along with the implications of a national DNA database as a system of identification. It has become the general rule that it is not an unreasonable invasion of privacy to take DNA for the purpose of identifying criminal offenders through a DNA database. This writing will examine the potential for nonconsensual inclusion of nearly everyone into such a system, as well as the ramifications in the …

Appellate Review Under The New Felony Sentencing Guidelines: Where Do We Stand , Mark P. Painter

Cleveland State Law Review

Now that it has been more than four years since Senate Bill 2 became effective, this is a good time to analyze the cases to see where courts stand in their interpretations of the guidelines. This article will review the case law and show how different courts have dealt with the legislation. My analysis concentrates on one aspect of the guidelines in particular: the standard of review that appeals courts have used to determine the propriety of sentences. To illustrate my points, I focus on the issue of when judges can impose maximum prison sentences under the guidelines, one of …

Regional Odontodisplasia Presenting As A Softtissue Swelling, Murat Meti̇n, Cahi̇t Üçok, Ahmet Keski̇n, Fi̇gen Çi̇zmeci̇

Turkish Journal of Medical Sciences

Regional odontodisplasia is a developmental anomaly of dental tissues with characteristic clinical, radiographic and histologic appearances. It most commonly affects the maxillary anterior teeth of both the primary and permanent dentition, and occurs in females twice as often as in males. The pathogenesis is unknown. A case of a twelve- year old female with regional odontodisplasia is presented. Although the affected teeth displayed the radiographical and clinical features of odontodisplasia, the patient appeared with significant soft tissue swelling on the anterior region of the mandible.

Postabortion Care: Lessons From Operations Research, Dale Huntington, Nancy J. Piet-Pelon Jan 1999

Postabortion Care: Lessons From Operations Research, Dale Huntington, Nancy J. Piet-Pelon

Reproductive Health

This book focuses on one central but until now intransigent aspect of women’s health: How to reduce the toll of death and morbidity associated with unsafe abortion. For the first time in the history of international decision-making, Cairo established a consensus on abortion. This was reaffirmed in the 1999 United Nations General Assembly statement. Where abortion is illegal, many women use herbal remedies, take modern drugs in unsupervised ways, attempt to physically self-induce, or seek help from abortion providers working outside the law. Where abortion is illegal, women are exposed to painful, dangerous procedures and many fall so sick that …

The United States Supreme Court Resolves The Effect Of Disability Benefit Claims Upon Americans With Disabilities Act Complaints In Cleveland V. Policy Management Systems Corporation, Christine Neylon O'Brien

Hofstra Labor & Employment Law Journal

Federal courts have grappled with the issue of whether claims under the Americans with Disabilities Act should be barred, or judicially estopped, by the plaintiff's earlier application for or receipt of disability benefits. This is a particularly vexing problem since recipients of disability benefits are presumed to be disabled even though they are not disabled for a particular job. These individuals, who are social security recipients and still, are qualified for a job yet they suffer adverse employment decisions in violation of the Americans with Disabilities Act. This article clarifies the law based on the Supreme Court decision, Cleveland v. …

Zionism, Racism, And The Palestinian People: Fifty Years Of Human Rights Violations In Israel And The Occupied Territories, Ardi Imseis

Dalhousie Journal of Legal Studies

The magnitude of Israeli human rights violations against the Palestinian people has been well documented by independent scholars, and intergovernmental and non-governmental organizations such as the United Nations, Amnesty International, and Human Rights Watch. However, relatively little has been written regarding the role the official Israeli state ideology has played in encouraging and upholding the Jewish state's policies regarding the indigenous Palestinians. Set against the backdrop of the fiftieth anniversaries of both the establishment of the State of Israel, and the proclamation of the Universal Declaration of Human Rights, the author partially surveys Israel's prolonged violation of Palestinian human rights …

Rights Discourse And Neonatal Euthanasia, Carl Schneider Jan 1999

Rights Discourse And Neonatal Euthanasia, Carl Schneider

Book Chapters

At the heart of our difficulty in approaching neonatal euthanasia lie the intractable questions it raises: What is human life? When is death preferable to life? What do parents owe their children? What does society owe the suffering? Those moral questions could hardly be more perplexing, yet they are further complicated when they must be resolved not informally and case by case, but through generally applicable social rules. This is so for numerous reasons. For instance, the wide range of deeply held opinions about neonatal euthanasia makes rules hard to formulate, and the wide range of factual situations in which …

Body Weight And Mortality Among Adults Who Never Smoked, Pramil N. Singh Jan 1999

Body Weight And Mortality Among Adults Who Never Smoked, Pramil N. Singh

Loma Linda University Electronic Theses, Dissertations & Projects

Most prospective studies identify an increased mortality risk for adults of high body mass index (> 27 kg/m2) that is commonly attributed to the effects of excess body fat, and also identify an increased mortality risk for adults of low body mass index (< 21 kg/m2), an association that, if causal among healthy adults, is without adequate pathophysiologic support.

In this dissertation, I have conducted three studies that continue the investigation of adiposity in relation to mortality among never-smoking adults of the California Seventh-day Adventist population. Among never-smoking adults of the Adventist Mortality Study (1960-1985), the relation between …

Practice Makes Perfect: Reasonable Accommodation Of Law Students With Disabilities In Clinical Placements, Sande L. Buhai

San Diego Law Review

Clinical legal education provides exceptional benefits to law students.' It is one of the best ways that law students can begin to: (1) identify which type of law they wish to practice, (2) make connections in the legal field to foster future employment opportunities, (3) develop mentoring relationships, (4) learn many important skills, and (5) learn professional responsibility and competence. These benefits directly translate into increased opportunities for successful employment upon graduation.

Dickerson And The Future Of Miranda, Brenda E. Mallinak Jan 1999

Dickerson And The Future Of Miranda, Brenda E. Mallinak

Richmond Journal of Law and the Public Interest

Dickerson v. United States is one such case where the Fourth Circuit considered §3501 sua sponte and applied the statute in the absence of Miranda warnings. This action by the Fourth Circuit raises four issues which will be addressed in this paper. Part I addresses the issue of whether the federal executive branch can decline to enforce a law passed by Congress will be examined, as well as the related question of whether, in the face of executive refusal to use a law, can the courts sua sponte rely on that law to decide a case. In Part 11 the …

Women In The New Millennium: The Promises Of The Past Are Now The Problems For The Millennium, Lundy Langston Jan 1999

Women In The New Millennium: The Promises Of The Past Are Now The Problems For The Millennium, Lundy Langston

Journal Publications

In this Article, I will explore the roles of women and the expectations that society maintains for them in the past and the expectations for the present and future. As we enter the millennium, the courts appear to administer the law in the same way as laws were administered prior to the women's rights movement. Judges appear to implement notions of equal rights while society attaches the notions of the "difference group" without any special treatment for the dual roles. Something interesting appears to be happening to the dual roles of women. There is one standard stating that women must …

Archival Orientation Interviews As Social Interactions, Michael R. Hill Jan 1999

Archival Orientation Interviews As Social Interactions, Michael R. Hill

Department of Sociology: Faculty Publications

For social scientists, every orientation interview is inherently an opportunity for systematic observation, analysis, and critique. Consider, by way of contrast, a hypothetical committee of mathematicians who visit archival repositories searching for documentary materials to display during the upcoming centennial celebration of the Mathematics Department at their home university. As mathematicians, orientation interviews are simply means to their pragmatic ends. For social scientists, however, especially for qualitative sociologists such as myself (Hill 1993), the situation is more complex. For some of us, every social interaction is potentially a source of sociological insight (Deegan and Hill 1987). Thus, every orientation interview …

A Risk-Amplification Model Of Victimization And Depressive Symptoms Among Runaway And Homeless Adolescents, Les B. Whitbeck, Dan R. Hoyt, Kevin Yoder Jan 1999

A Risk-Amplification Model Of Victimization And Depressive Symptoms Among Runaway And Homeless Adolescents, Les B. Whitbeck, Dan R. Hoyt, Kevin Yoder

Department of Sociology: Faculty Publications

This report is an examination of a theoretical model of risk amplification within a sample of 255 homeless and runaway adolescents. The young people were interviewed on the streets and in shelters in urban centers of four Midwestern states. Separate models were examined for males (n = 102) and females (n = 153). Results indicated that street experiences such as affiliation with deviant peers, deviant subsistence strategies, risky sexual behaviors, and drug and/or alcohol use amplified the effects of early family abuse on victimization and depressive symptoms for young women. These street adaptations significantly increased the likelihood of serious victimization …
