Better Settle Than Sorry: The Regret Aversion Theory Of Litigation Behavior, Chris Guthrie Oct 1999

Better Settle Than Sorry: The Regret Aversion Theory Of Litigation Behavior, Chris Guthrie

Vanderbilt Law School Faculty Publications

Legal scholars have developed two dominant theories of litigation behavior: the Economic Theory of Suit and Settlement, which is based on expected utility theory, and the Framing Theory of Litigation, which is based on prospect theory. While Professor Guthrie acknowledges the explanatory power of these theories, he argues that they are flawed because they portray litigants solely as calculating creatures. These theories disregard any role emotion might play in litigation decision making. Guthrie proposes a mplementary theory-the Regret Aversion Theory of Litigation Behavior-that views litigants as both calculating and emotional creatures. With roots in economics, cognitive psychology, and social psychology, the …

The Unfulfilled Promise Of Promissory Estoppel In The Employment Setting, Robert A. Hillman Oct 1999

The Unfulfilled Promise Of Promissory Estoppel In The Employment Setting, Robert A. Hillman

Cornell Law Faculty Publications

Although the theory of promissory estoppel enforces promises that induce reasonable detrimental reliance, this article reveals the theory's colossal failure in the non-union employment setting. This conclusion is based on an examination of all of the reported decisions in the United States that discussed promissory estoppel over a two-year period in the mid 1990's. During this period, employees won only 4.23 percent of employment promissory estoppel cases decided on the merits. At first blush, this is very surprising because employers, through their communications, seek to create the expectation of a stable, secure work environment and employees, because of their lack …

A Comparative Study Of The Morale Levels Of Lower And Upper Elementary Public School Teachers, Marcellina Hummer Anderson

Student Work

This study involved the development of a new instrument, the Teacher Outlook and Perceptions Survey, to explore the nature of teacher morale, what predicts teacher morale, and the influence of the anticipated outlook of the job situation on teacher morale. The instrument consisted of 47 items, including a global item in which teachers assessed their morale levels. The scores of the instrument produced an alpha reliability coefficient of .91. Elementary teachers from a large urban district participated in the study (N = 308). The instrument was based on a morale model developed by the researcher. Morale was defined as a …

Prereferral Assistance Teams: The Impact Of Implementing Problem-Solving On Referrals And Accommodations., Leanne Lowell Josoff

Student Work

Prereferral assistance teams have been implemented in many schools to provide a formal process of monitoring interventions in regular education before referring students to testing for special education. The main purpose of the current study is to determine if using the problem-solving process during prereferral assistance team meetings is more effective than not using problem-solving during team meetings. The results from the study indicated that prereferral assistance teams that use problem solving are more successful in reducing the number of referrals to psychoeducational testing and in increasing the number of specific and appropriate accommodations developed during prereferral assistance team meetings. …

The Benefits Of Voluntary Inpatient Psychiatric Hospitalization: Myth Or Reality?, Donald H. Stone Oct 1999

The Benefits Of Voluntary Inpatient Psychiatric Hospitalization: Myth Or Reality?, Donald H. Stone

All Faculty Scholarship

Throughout the United States, mentally ill persons are confined against their will in psychiatric hospitals as a result of being accused of dangerous behavior. Some are committed involuntarily by a judge after an administrative hearing during which they are afforded legal representation, a right to be present, and important due process protections, including the right to cross-examine witnesses and present one's own witnesses. However, a significant number of individuals, initially confined in psychiatric institutions for allegedly posing a danger to life or safety, never see an impartial judge, lawyer, or even a family member. These mentally ill individuals are not …

Performing Selves/Performing As Self: Autobiographical Films Of Children Of Jewish Holocaust Survivors, Jennifer Levi Oct 1999

Performing Selves/Performing As Self: Autobiographical Films Of Children Of Jewish Holocaust Survivors, Jennifer Levi

Journal of Religion & Film

For many Holocaust survivors, one of the most difficult obstacles to overcome is the simultaneous need to tell one's story and the awareness that language cannot convey the horrors of the experience. This awareness that words fall to communicate across generations, cultures, religions, etc. is the legacy of children of Jewish Holocaust survivors who both can't understand and are formed by their parents' stories/experiences. By engaging Deb Filler's film rendition of her one-woman stage show, Punch Me in the Stomach, and Abraham Ravett's documentary Everything's for You, I explore the ways in which film allows the second generation …

Seeing And Being Seen: Distinctively Filmic And Religious Elements In Film, Greg Watkins Oct 1999

Seeing And Being Seen: Distinctively Filmic And Religious Elements In Film, Greg Watkins

Journal of Religion & Film

Using philosophical propositions from Stanley Cavell's work The World Viewed, I argue in this paper that there is a religious dimension available in film which has to do with a creative and disruptive approach to the normal and naturalized habits of the typical viewer. By examining both Von Trier's Breaking the Waves and Tarkovsky's The Sacrifice, I attempt to show that these film makers challenge their viewers via the nature of the medium itself and in ways that have religious/ethical implications.

The Apostle: A Psychiatric Appraisal, Carl Greiner Oct 1999

The Apostle: A Psychiatric Appraisal, Carl Greiner

Journal of Religion & Film

Robert Duvall's 1997 film, The Apostle, provides a remarkable portrait of a charismatic minister with problems. The Apostle E.F., first known as "Sonny" (played by Duvall), has charismatic gifts and sometimes an uncontrollable temper. The viewer is challenged to make sense of the conflicting character elements. During the course of the film, the Apostle E.F. kills an adulterous rival and physically assaults some who would stand in his way. Yet this is not a simple moral warning about a preacher's righteous public façade versus the sordid character of his private life, as in Elmer Gantry. Rather it reveals …

Intravascular Lymphomatosis With Bone Marrow Involvement: A Case Report And Review Of The Literature, Tammy J. Tucker Oct 1999

Intravascular Lymphomatosis With Bone Marrow Involvement: A Case Report And Review Of The Literature, Tammy J. Tucker

Student Publications

We describe the case of a 56-year-old man who presented with numbness and tingling of the extremities, weakness, and fatigue. Laboratory findings included anemia and thrombocytopenia. A diagnosis of intravascular lymphomatosis was established when liver, omentum, and bone marrow samples were examined. A review of the literature reveals that most cases of intravascular lymphomatosis have cytopenias, mainly anemia and thrombocytopenia, but bone marrow involvement is rare. In our case, a subtle neoplastic infiltrate in the marrow sinusoids was highlighted with a B-cell marker. While immunohistochemical analysis was not performed in most reported cases in the literature, our studies suggest that …

Toward The Development Of A Pursuit Decision Calculus: Pursuit Benefits Versus Pursuit Cost, Thomas J. Madden, Geoffrey P. Alpert Oct 1999

Toward The Development Of A Pursuit Decision Calculus: Pursuit Benefits Versus Pursuit Cost, Thomas J. Madden, Geoffrey P. Alpert

Faculty Publications

To make unbiased decisions about whether to pursue a fleeing vehicle, officers must understand both the costs and the potential benefits of a pursuit. This manuscript describes an approach that identifies and assesses the impact of pursuit characteristics on pursuit costs. Data from official pursuit forms generated by officers in the Miami-Dade police department were used as a basis of the study. Log-linear models were used to identify direct and interactive effects of the pursuit characteristics. Upon finding significant effects, odds ratios were calculated. The findings indicate that there are certain pursuit characteristics, including number of units and speed, that …

Race-Focused Service-Learning Courses: Issues And Recommendations, Roberta L. Coles

Social and Cultural Sciences Faculty Research and Publications

This article discusses the interaction between race and service-learning in the college classroom. The author found that students of color were more likely to choose the service-learning option in her courses when the incentive was higher and there was more latitude in site choice. The article then looks at factors that adversely affect the service-learning experience in courses that are specifically race-focused and suggests counterbalancing strategies.

The Parallel Organization And Employee Perceptions Of Participative Leadership In A Mid-Atlantic City, Landis Denise Faulcon Oct 1999

The Parallel Organization And Employee Perceptions Of Participative Leadership In A Mid-Atlantic City, Landis Denise Faulcon

Theses and Dissertations in Urban Services - Urban Management

Current literature is replete with examples of how bureaucracy hinders organizational performance in rapidly changing social, economic, and political environments. The use of a parallel organization has emerged as one approach to transforming traditional bureaucratic structures into high performance work systems.

This study examines a parallel organization created as part of a high performance organization (HPO) model in a mid-Atlantic city. The purpose of the parallel organization is to conduct the work of leadership, which consists of five functions: identifying customer needs and expectations; developing a shared vision and values; integration and stewardship; creating an environment conducive to learning, thinking, …
