Spin-Up In A Tank Induced By A Rotating Bluff Body, R. Daniel Maynes, J. Klewicki, P. Mcmurty
Spin-Up In A Tank Induced By A Rotating Bluff Body, R. Daniel Maynes, J. Klewicki, P. Mcmurty
Faculty Publications
Spin-up of a turbulent flow in a cylindrical tank caused by a rotating bluff body has been investigated using flow visualization, fluid velocity measurements, and hydrodynamic torque measurements. During the spin-up process three distinct temporal regimes exist. These regimes are: (i) a build-up regime where the torque and the tangential velocity fluctuations in the close proximity of the body remain constant; (ii) a decay regime where these quantities decay with power-law relations; and (iii) a mean flow steady state where these values remain relatively constant. Experiments were conducted in two tanks differing in volume by a factor of 80 and …

Microwave radiometers, while traditionally utilized in atmospheric and oceanic studies, can also be used in land surface applications. However, the problem of undesirable atmospheric effects caused by clouds and precipitation must be addressed. In this paper, temporal composite surface brightness images are generated from special sensor microwave/imager (SSM/I) data with the aid of new algorithms to eliminate small-scale distortion caused by clouds or precipitation. Mean, second-highest value, modified maximum average (MMA), and hybrid compositing algorithms are compared. The effectiveness of each algorithm is illustrated through simulation and real data distribution analysis. The results show that the second-highest value algorithm is …

Making Something Out Of Nothing: The Law Of Takings And Phillips V. Washington Legal Foundation, Michael A. Heller, James E. Krier

Phillips v. Washington Legal Foundation held that interest on principal amounts deposited into IOLTA accounts is the property of the various clients who handed over the money but expressed no view as to whether the Texas IOLTA program worked a taking, or, if it did, whether any compensation was due. The debates among the justices about the meaning of private property, argued in terms of contextual and conceptual severance, are unlikely to prove fruitful. We elaborate a better approach in terms of the underlying purposes of just compensation. We conclude that efficiency and justice are best served by uncoupling matters …
The Boundaries Of Private Property, Michael A. Heller
The Boundaries Of Private Property, Michael A. Heller

If your house and fields are worth more separately, divide them; if you want to leave a ring to your child now and grandchild later, split the ownership in a trust. The American law of property encourages owners to subdivide resources freely. Hidden within the law, however, is a boundary principle that limits the right to subdivide private property into wasteful fragments. While people often create wealth when they break up and recombine property in novel ways, owners may make mistakes, or their self-interest may clash with social welfare. Property law responds with diverse doctrines that prevent and abolish excessive …
Why Start-Ups?, Joseph Bankman, Ronald J. Gilson
Why Start-Ups?, Joseph Bankman, Ronald J. Gilson
Faculty Scholarship
The prototypical start-up involves an employee leaving her job with an idea and selling a portion of that idea to a venture capitalist. In many respects, however, the idea should be worth more to the former employer. The former employer can be expected to have better information concerning the employee-entrepreneur and the technology, have opportunities to capture economies of scale and scope not available to a venture capital-backed start-up, and will receive more favorable tax treatment than the start-up should the innovation fail. In connection with an auction of the idea, the former employer should have both a more accurate …
In God's Image: The Religious Imperative Of Equality Under Law, George P. Fletcher
In God's Image: The Religious Imperative Of Equality Under Law, George P. Fletcher
Faculty Scholarship
This Essay argues that the principle of equality under law is best grounded in a holistic view of human dignity. Rejecting modem attempts to justify equality by reducing humanity to a particular actual characteristic, it articulates a religious imperative to treat people equally by drawing on biblical as well as modern philosophical sources. The principle "all men are created equal," as celebrated in the Declaration of Independence and Gettysburg Address, draws on this holistic understanding of humanity. This admittedly romantic approach to equality generates a critique of contemporary Supreme Court doctrine, including the prevailing approaches to strict scrutiny, affirmative action, …
Grand Jury Secrecy: Plugging The Leaks In An Empty Bucket, Daniel Richman
Grand Jury Secrecy: Plugging The Leaks In An Empty Bucket, Daniel Richman

Although people can quarrel about the significance or reliability of Independent Counsel Kenneth Starr's investigative findings, no one can deny that his investigation produced new law. We now know that the attorney-client privilege survives the death of the client, that government lawyers may not rely on that privilege to shield communications from their "client" relating to criminal misconduct, and that there is no "protective function privilege" (at least not yet), While bringing some clarity to certain areas, the Independent Counsel's investigation also highlighted the confused state of the law relating to Rule 6(e)'s grand jury secrecy provisions.
Deterrence And Distribution In The Law Of Takings, Michael A. Heller, James E. Krier
Deterrence And Distribution In The Law Of Takings, Michael A. Heller, James E. Krier

Supreme Court decisions over the last three-quarters of a century have turned the words of the Takings Clause into a secret code that only a momentary majority of the Court is able to understand. The Justices faithfully moor their opinions to the particular terms of the Fifth Amendment, but only by stretching the text beyond recognition. A better approach is to consider the purposes of the Takings Clause, efficiency and justice, and go anew from there. Such a method reveals that in some cases there are good reasons to require payment by the government when it regulates property, but not …
The Cutting Edge Of Poster Law, Michael A. Heller
The Cutting Edge Of Poster Law, Michael A. Heller

Students place tens of thousands of posters around law schools each year – in staircases, on walls, and on bulletin boards. Rarely, however, do formal disputes about postering arise. Students know how far to go – and go no farther despite numerous avenues for postering deviance: blizzarding, megasigns, commercial or scurrilous signs. What is the history of poster law? What are its norms and rules, privileges and procedures? Is poster law effident? Is it just?
The Association Of Fluid Intake With Total Natural-Cause Mortality, Coronary Heart Disease And Fatal Stroke, Jacqueline Chung Lun Chan
The Association Of Fluid Intake With Total Natural-Cause Mortality, Coronary Heart Disease And Fatal Stroke, Jacqueline Chung Lun Chan
Loma Linda University Electronic Theses, Dissertations & Projects
Hypohydration may be more widespread than realized since it does not always arouse a sense of thirst. When thirst is felt, it is often ignored, or satisfied before euhydration is achieved. There is growing evidence indicating that hypohydration contributes to acute and chronic illnesses, and to rheological factors associated with coronary heart disease (CHD) and stroke. Therefore the relationship of fluid intake with risk of total natural-cause mortality, CHD and stroke death was examined using data on 34,192 white, non-Hispanic participants in the Adventist Health Study.
Among the 27,342 reporting no CHD, stroke or diabetes at baseline, during six years …

The Case For Sound Symbolism, Janis B. Nuckolls

proposal that linguistic sounds such as phonemes, features, syllables, or tones can be meaningful, or sound-symbolic, contradicts the principles of arbitrariness and double articulation that are axiomatic to structural linguistics. Nevertheless, a considerable body of research that supports principles of sound symbolism has accumulated. This review discusses the most widely attested forms of sound symbolism and the research programs linked to sound symbolism that have influenced linguists and anthropologists most. Numerous reports of magnitude sound symbolism in the form of experimental studies and comparative surveys have been integrated into a biologically based theory of its motivation. Magnitude sound symbolism also …

State Immunity Waivers For Suits By The United States, Evan H. Caminker
State Immunity Waivers For Suits By The United States, Evan H. Caminker
Articles
The Supreme Court closed this millennium with a virtual celebration of state sovereignty, protecting state authority from the reach of congressional power in several significant ways. In a pair of cases, Seminole Tribe v. Florida1 and Alden v. Maine,2 the Court held that states enjoy a constitutional immunity from being sued without their consent. In Seminole Tribe, the Court opined that "the background principle of state sovereign immunity embodied in the Eleventh Amendment"3 protects states from unconsented suits in federal court. In Alden, the Court held that this principle is not merely embodied in the Eleventh Amendment but rather is …

The Constitutionality Of Taxing Compensatory Damages For Mental Distress When There Was No Accompanying Physical Injury, Douglas A. Kahn

Since 1919, statutory tax law has excluded from gross income compensatory damages received on account of a personal injury or sickness.1 The current version of that exclusion is set forth in section 104 (a) (2) of the Internal Revenue Code of 1986.2 The construction of that exclusion, both by the courts and by the Commissioner, underwent significant alterations over the 80-year period that the provision has existed.3 The statute itself was amended several times, most recently in 1996.4 It is the 1996 amendment that has raised a constitutional issue concerning the validity of a portion of the statute.5

About the time William Rehnquist ascended to the Chief Justiceship of the United States, two events occurred that increased the likelihood that Miranda would enjoy a long life. In Moran v. Burbine,' a 6-3 majority held that a confession preceded by an otherwise valid waiver of a suspect's Miranda rights should not be excluded either (a) because the police misled an inquiring attorney when they told her they were not going to question the suspect she called about or (b) because the police failed to inform the suspect of the attorney's efforts to reach him.

Lost Lives: Miscarriages Of Justice In Capital Cases, Samuel R. Gross

In case after case, erroneous conviction for capital murder has been proven. I contend that these are not disconnected accidents, but systematic consequences of the nature of homicice prosecution in the general and capital prosecution in particular - that in this respect, as in others, death distorts and undermines the course of the law.
The Three Threats To Miranda, Yale Kamisar
The Three Threats To Miranda, Yale Kamisar

Miranda v. Arizona (1966) was the centerpiece of the Warren Court's "revolution" in American criminal procedure. Moreover, as Professor Stephen Schulhofer of the University of Chicago Law School has recently noted, a numbir of the Miranda safeguards "have now become entrenched in the interrogation procedures of many countries around the world." But Miranda is in serious trouble at home.

As we wring our hands over increasing reports of severe child abuse and how violent many of our children have become, it might be time to reassess policies that give parents and others the license to use even the most mild forms of violence against our children.
The Tentative Case Against Flexibility In Commercial Law, Omri Ben-Shahar
The Tentative Case Against Flexibility In Commercial Law, Omri Ben-Shahar
Articles
Well-rooted in modern commercial law is the idea that the law and the obligations that it enforces should reflect the empirical reality of the relationship between the contracting parties. The Uniform Commercial Code ("Code") champions this tradition by viewing the performance practices formed among the parties throughout their interaction as a primary source for interpreting and supplementing their explicit contracts. The generous recognition of waiver and modifications, as well as the binding force the Code accords to course of performance, course of dealings, and customary trade usages, effectively permits unwritten commercial practices to vary and to erode explicit contractual provisions.
Family Law And Gay And Lesbian Family Issues In The Twentieth Century, David L. Chambers, Nancy D. Polikoff
Family Law And Gay And Lesbian Family Issues In The Twentieth Century, David L. Chambers, Nancy D. Polikoff
Articles
Over these thirty years, lesbians and gay men have increasingly challenged conventional definitions of marriage and the family. In this brief article, we tell the story of gay people and family law in the United States across this period. We divide our discussion into two sections: issues regarding the recognition of the same-sex couple relationship and issues regarding gay men and lesbians as parents. These issues overlap, of course, but since family law discussions commonly treat adult-adult issues of all sorts separately from parent-child issues, we believe it convenient and helpful to do so as well.
Near Misses, William I. Miller
Near Misses, William I. Miller
Articles
I was recently invited to give a keynote address for a small academic conference whose advertised theme was "Near Misses, Contingencies, and Histories." I have a rough and ready understanding of the near miss, the same kind of understanding we have of most words and phrases that spill out effortlessly in normal conversation. I use it and have heard it used by myriad others to describe a certain style of disappointment and regret. It is a concept generally available to us all, but when coupled with contingencies and histories, as in the title of the conference with its vague suggestions …
Commercial Speech, Professional Speech, And The Constitutional Status Of Social Institutions, Daniel Halberstam
Commercial Speech, Professional Speech, And The Constitutional Status Of Social Institutions, Daniel Halberstam
Articles
Current First Amendment analysis lacks a coherent view of speech in the professions. Classic cases address the street-comer orator, lone pamphleteer, newspaper editor, broadcaster, cable operator, public employee, grant recipient, vendor, corporation, and, most recently, Internet content provider. And an abundance of theory accompanies these speakers along the way. Although some of these actors may be professionals, both theory and practice generally meet their roles as members of a profession with silence. Despite the century-old recognition of the regulation of professions, we still have, for example, no paradigm for the First Amendment rights of attorneys, physicians, or financial advisers when …

Dimensions Of Roles, Responsibilities, Training Background And Needs, Policies, And Procedures For Paraeducators Dealing With Students With Special Needs, Beverly Anne Plagge
Dissertations and Theses @ UNI
The problem of this research study was to delineate and synthesize the roles, responsibilities, skill level, and training background and needs of paraeducators working with students with special needs from a state that requires paraeducator certification and a state that does not require paraeducator certification. The five core areas of roles and responsibilities were: (a) instructional support, (b) behavior management, (c) diagnostic support, (d) classroom organization, and (e) personal care assistance from the special education paraeducator and the special education teacher who teams with the paraeducator. Very few differences existed between what paraeducators and their teachers felt were appropriate and …

Revaluing Restitution: From The Talmud To Postsocialism, Michael A. Heller, Christopher Serkin
Faculty Scholarship
Whatever happened to the study of restitution? Once a core private law subject along with property, torts, and contracts, restitution has receded from American legal scholarship. Few law professors teach the material, fewer still write in the area, and no one even agrees what the field comprises anymore. Hanoch threatens to reverse the tide and make restitution interesting again. The book takes commonplace words such as "value" and "gain" and shows how they embody a society's underlying normative principles. Variations across cultures in the law of unjust enrichment reflect differences in national understandings of sharing, property, and even personhood. As …

An Evaluation Of Adhd Assessment, Intervention, And Progress Monitoring Practices In One School According To Best Practice Recommendations, Kristin M. Briggs
Dissertations and Theses @ UNI
This study investigated the quality of ADHD assessment, interventions, and progress monitoring practices in a school building. Education personnel were also surveyed (n = 8) to gain further insight into the current school policies and practices for ADHD. Barkley's 1990 model of ADHD assessment and intervention was chosen as the standard of best practice in which current practices were compared. One school was selected for participation in the study. All students on medication for ADHD in kindergarten through twelfth grades served as subjects (n = 13). Data analysis revealed that seven of these student files (54%) did not include documentation …
