Richmond Journal of Law & Technology

The World Wide Web has experienced rapid growth during the 1990s, with millions of publishers adding diverse opinions, objectives and page content. The main programming feature that has kept this network of networks from becoming a twisted thicket of web-sites is the hyperlink. These links guide users across the Web by creating connections from page to page and site to site, allowing a reader to follow tangential paths to whatever it is the Web has to offer her. Links provide connections within a site and are also used constantly to travel from one publisher's site to another. Because the linking …

Conceptual Foundations Of Privacy: Looking Backward Before Stepping Forward, Robert A. Reilly Jan 1999

Conceptual Foundations Of Privacy: Looking Backward Before Stepping Forward, Robert A. Reilly

Richmond Journal of Law & Technology

In cyberspace, as in today's real world, there seems to be confusion in regard to what privacy is and what it is not. One scholar, Ruth Granson highlights recent efforts to fully comprehend privacy: "the concept of privacy is a central one in most discussions of modern Western life, yet only recently have there been serious efforts to analyze just what is meant by privacy." Over the years, the conception of the nature and extent of privacy has been severely bent out of shape. The definitions and concepts of privacy are as varied as those in the legal and academic …

Affordable Internet Access For All Americans, Mark J. Maier Jan 1999

Affordable Internet Access For All Americans, Mark J. Maier

Richmond Journal of Law & Technology

There are times in our history where new technologies burst onto the scene and have a major impact on our lives. We live in one such time. The Internet is revolutionizing how people and organizations interact with each other. Examples of these paradigm changes include how students are now being educated online with minimal face time with their teachers; governments are being forced to adapt to the new circumstance where once formidable geographical boundaries between countries are being lowered by information technology; and the military is realizing that it needs to harness this new technology or be defeated by it.

The Creative As Enemy Of The True: The Meaning Of Originality In The Matthew Bender Cases, Deborah Tussey Jan 1999

The Creative As Enemy Of The True: The Meaning Of Originality In The Matthew Bender Cases, Deborah Tussey

Richmond Journal of Law & Technology

The scope of copyright protection for case reports and case reporters has been the subject of litigation since the Supreme Court decided its first copyright case, Wheaton v. Peters,[1] in 1834. Prior to the development of electronic technologies, the courts established a fairly consistent set of guidelines on which print publishers could rely. However, the development of electronic research tools raised new questions which the old guidelines did not address. With the founding of Lexis's online research service, and the later development of CD-ROM research products, West Publishing Co., the premier publisher of case reports, found itself in possession of …

A Nice Place To Visit But I Wouldn't Want To Litigate There: The Effects Of Cybersell V. Cybersell On The Law Of Personal Jurisdiction, W. David Falcon Jr.

Richmond Journal of Law & Technology

In a world divided by barriers of language and culture, the Internet is the nexus that connects the most rural outposts of technology to the global business centers. The Internet's most popular user interface, the World Wide Web, is an interwoven network of computers through which news and information can traverse international barriers in a matter of seconds. Using an Internet Service Provider ("ISP") and a personal computer, the average user can access the World Wide Web and enter the largest repository of public information on the planet. The boundaries are virtually limitless, and the general absence of content restrictions …

Contributions Of Pg Graded Asphalt To Low Temperature Cracking Resistance Of Pavement, Ssu-Wei Loh, J. Olek

JTRP Technical Reports

The purpose of this research was to study and evaluate the role that asphalt binders play in the resistance of asphalt pavements to low temperature cracking. As part of the Strategic Highway Research Program (SHRP) new specifications for asphalt binders were developed that are based on the performance of the material. The asphalt binder graded and specified according to these new performance-based specifications is called PG binder. These new specifications are commonly referred to as Superpave (Superior Performing Asphalt Pavement) binder specifications. A section of Interstate 64 in southern Indiana was experiencing severe low temperature cracking before it was reconstructed …

Consequences Of Using Fear As A Motivator And Its Effects On The Employer / Employee Relationship, Nicole M. Griggs Jan 1999

Consequences Of Using Fear As A Motivator And Its Effects On The Employer / Employee Relationship, Nicole M. Griggs

Theses

The following work is an in-depth analysis of the consequences of using fear as a motivator, specifically, in the workplace, and the effects fear has on employees. The empirical research identifies the successful, and often, unsuccessful components of the employer/employee relationship. For many, using fear would seem to be a powerful way of getting employees to produce more, work harder, increasing motivation. This is not always the answer. The study provides reasons why fear can be a negative motivator and detrimental to an organization.

The Appearance Of Ferrielectric Phases In Confined Liquid Crystal Studied By Photon Correlation Spectroscopy, Yuri Panarin, Fouad M. Aliev, Charles Rosenblatt Jan 1999

The Appearance Of Ferrielectric Phases In Confined Liquid Crystal Studied By Photon Correlation Spectroscopy, Yuri Panarin, Fouad M. Aliev, Charles Rosenblatt

Articles

The influence of confinement on the dynamic properties and appearance of ferrielectric phases has been investigated by dynamic light scattering, performed in the bulk AFLC as well as confined in 200 8, and 2000 8, cylindrical pores. The analysis of the experimental results shows that the ferrielectric phases are not formed in 200 A pores, while they appear in 2000 8, pores as well as in bulk.

The Most Creative Moments In The History Of Environmental Law: "The Who's", William H. Rodgers, Jr. Jan 1999

The Most Creative Moments In The History Of Environmental Law: "The Who's", William H. Rodgers, Jr.

Articles

My definition of creativity in environmental law is any legal initiative that advances the subject with new levels of analysis, structure, or institutional bridges. There are two requirements: improvement on function and novelty. Law is better if it increases the prospect of protecting the natural world or its inhabitants. Law is novel if it combines mandate, process, or structure in unusual ways.

There are reasons to suspect that environmental law as a field may be more creative than other legal subjects such as trust and estates, contracts, property, or tax law. One reason, as Oliver Houck has said, is that …

What A Salmon Czar Might Hope For, William H. Rodgers, Jr. Jan 1999

What A Salmon Czar Might Hope For, William H. Rodgers, Jr.

Articles

There is a windowof opportunity in the wave of Endangered Species Act salmon listings that has descended on the Pacific Northwest in 1998 and 1999. Federal law links listings to the "inadequacy of existing regulatory mechanisms." Experience in Oregon has shown that EPA listings cannot be avoided by "voluntary or future conservation efforts."

Meaningful state law that will deter federal overrides must be "current" and "enforceable." With salmon stocks plummeting and with "inadequate" regulation prominently confirmed, what would the naive observer expect from a Washington State legislature intent upon saving the salmon and protecting its authority? A spate of stunning …

Aquatic Vegetation In Irrigation Canals, Mark Sytsma, Michael Parker Jan 1999

Aquatic Vegetation In Irrigation Canals, Mark Sytsma, Michael Parker

Center for Lakes and Reservoirs Publications and Presentations

Preparation of this guidance manual for integrated aquatic vegetation management in irrigation canals was stimulated, in large part, by the accidental release of acrolein-treated irrigation water into Bear Creek in southern Oregon. The resulting fish kill brought into focus the need to examine the methods available for managing aquatic vegetation in flowing water. Furthermore, it demonstrated the need for technical assistance on aquatic vegetation management in Oregon. Vegetation management in flowing water is a difficult undertaking. The interconnectedness of natural and manmade water conveyance systems, the tenuous status of many aquatic species, and the necessity of water delivery for profitable …
