"Global Environmental Problems Require Global Solutions": A Case Study In Ecomessianism, Tyler Veak, Wyatt Galusky

Faculty Publications and Presentations

Many Western environmental activist groups and theorists have sounded the call for the Earth's salvation from the "global environmental crisis." What is lacking, however, is some reflection on the ramifications of framing the problem globally, and on the justifications for particular solutions. This paper examines the "ecomessiah" (saviors of the Earth) phenomenon to investigate the impacts of these types of programs. Specifically, we examine the "global environmental ethic" proposed by J. Baird Callicott. His program, presented as an inclusive system that incorporates non-Western belief systems, trades heavily on Western science as an authority and a justification. We contend that his …

Strike Two: An Analysis Of The Child Online Protection Act’S Constitutional Failures, Heather L. Miller Dec 1999

Strike Two: An Analysis Of The Child Online Protection Act’S Constitutional Failures, Heather L. Miller

Federal Communications Law Journal

Congress's first attempt to regulate minors' access to sexually explicit material via the Internet failed. Congress responded with the Child Online Protection Act, which, despite its narrower scope, cannot withstand constitutional scrutiny. This Notes delves into the constitutionality of Congress's second attempt by addressing the difficulty of applying the vague "harmful to minors" definition to the Internet medium and the economic and technological unavailability of the Act's affirmative defenses. This Note concludes with an explanation as to why legislation is an ineffective mechanism to address the problem of minors' access to online pornography.

The Sustainable, The Expendable, And The Obsolete, Michael D. Lieber Dec 1999

The Sustainable, The Expendable, And The Obsolete, Michael D. Lieber

Pacific Studies

This is a preliminary exploration of the concept of sustainability and its potential usefulness to anthropologists. “Sustainable” is distinguished from “stable” and “viable” in terms of its implications of directionality of time, pointing both backward and forward. Given the time implications, the contexts of “sustainable Xs” (technology, activity, development, etc.) are crucial to explaining what happened to X in the past and prognosticating its future. The argument is illustrated by analyzing data on obsolete fishing practices on Kapingamarangi Atoll (Federated States of Micronesia), focusing on the contexts of change in political /religious organization in the twentieth century. Changing access to …

Regressive Model Approach To The Generation Of Test Trajectories, Brian James Taylor Dec 1999

Regressive Model Approach To The Generation Of Test Trajectories, Brian James Taylor

Graduate Theses, Dissertations, and Problem Reports (ETD)

One possible method of reliability assurance is the application of large testing sets upon a system via statistical reliability assessment. Under this method, a software system's operations are tested according to their actual usage. A problem with this approach is the large number of tests required to properly assess reliability. Complicating the process are situations where an input into the system is a trajectory of data, where a trajectory is defined as a series of data points with each point relying upon the previous points. Examples of trajectories of data include an airplane's flight path or data describing a nuclear …

Voluntary Mobile Source Emission Reduction Programs, Barbara Laurenson Dec 1999

Voluntary Mobile Source Emission Reduction Programs, Barbara Laurenson

Master's Projects

As a society we aspire to live in communities with healthy air quality. Achieving this goal is contingent upon contolling many different sources of air pollution. In the past twenty years, the largest sources of air pollution have shifted from easily targeted “smoke stack industries” to difficult to target “mobile sources, Mobile sources, which include automobiles and trucks, are difficult to control because they involve not just the technology that creates the pollution but also how individuals choose to (or are required to) use mobile sources. As a result, controlling these sources of air pollution can be a complex endeavor. …

Shrinkwrap And Clickwrap Agreements: 2b Or Not 2b?, Garry L. Founds

Federal Communications Law Journal

Several problems plague typical mass-market software licensing agreement, specifically that the public is powerless to negotiate and the terms often are perceived as exceedingly broad and restrictive. The Uniform Computer Information Transactions Act is designed to remedy those problems and establish the general enforceability of such agreements, with certain qualifications related to unconscionability, assent, and other caveats. UCITA, however, does not resolve, or even purport to resolve, the tension between federal copyright law and state contract law. This Note analyzes UCITA's attempt to resolve the enforceability issue; argues for an approach to preemption that promotes clarity and preserves the objectives …

Administrative Law, Mark H. Cohen, David C. Will Dec 1999

Administrative Law, Mark H. Cohen, David C. Will

Mercer Law Review

This Article covers important developments in Georgia administrative law for the two-year period from June 1, 1997 through May 31, 1999. Because administrative law has been omitted from major consideration in the Annual Survey of Georgia Law since 1987, this Article is an attempt to cover an additional period of review, which, the authors hope, will be continued in future surveys. This Article includes cases as well as a discussion of two significant legislative enactments during the survey period.

Forming Strategic Alliances: Issues In Conceptualisation, Nagasimha Balakrishna Kanagal Dec 1999

Forming Strategic Alliances: Issues In Conceptualisation, Nagasimha Balakrishna Kanagal

IIMB Management Review

The interactive and interdependent economy of the present day is rooted in exchanges or 'give and take' of varying complexity. The process of conceptualising, planning and executing exchanges to the benefit of all players involved is basic to marketing. Given the three generic forms of economic organisation - market, hybrid and hierarchy, organisational expansions in high technology markets in recent times have witnessed the emergence of hybrid strategic alliances as an alternative to markets and hierarchies. Strategic alliances enable functional integration in inter-firm relationships involving tangible and intangible exchanges. Rapid technological innovations and technological complexity, and forces such as uncertainty, …

A Simplified Model Of Wound Healing - Ii: The Critical Size Defect In Two Dimensions, J. S. Arnold, John A. Adam

Mathematics & Statistics Faculty Publications

Recently, a one-dimensional model was developed which gives a reasonable explanation for the existence of a Critical Size Defect (CSD) in certain animals [1]. In this paper, we examine the more realistic two-dimensional model of a circular wound of uniform depth to see what modifications are to be found, as compared with the one-dimensional model, in studying the CSD phenomenon. It transpires that the range of CSD sizes for a reasonable estimate of parameter values is 1 mm-1 cm. More realistic estimates await the appropriate experimental data.

The Effect Of Dredging On The Plant Community Of A Missouri-River Floodplain Wetland., Lisa Ann Peterson Dec 1999

The Effect Of Dredging On The Plant Community Of A Missouri-River Floodplain Wetland., Lisa Ann Peterson

Student Work

A plant community gradient, consisting of Open-water, bulrush, Grass, and Forest Zones, was evaluated both before (1995) and one-year after (1997) restoration-dredging of a wetland along the Missouri River in east-central Nebraska. Species diversity declined significantly (P ≥ 0.05) in both the Bulrush and Grass Zones (-24 and -30 species) but not elsewhere. The Open-water Zone, which increased the most with dredging (+40 meters), was dominated by duckweed (Lemna minor) (53% canopy cover in 1995 and 45% in 1997) and watermeal (Wolddia columbiana) (53% and 61%) both before and after dredging. Coontail (Ceratophylum demersum) increased significantly (7% to 25%). The …

Georgia's Public Duty Doctrine: The Supreme Court Held Hostage, R. Perry Sentell Jr. Dec 1999

Georgia's Public Duty Doctrine: The Supreme Court Held Hostage, R. Perry Sentell Jr.

Mercer Law Review

A study published in 1994 sought to determine the single most litigated topic in Georgia local government law over the past thirty years. What legal issue of local government administration had most often confronted Georgia's appellate courts over that recent but considerable span of time? The revealed answer to that inquiry commanded serious consideration-not because of its unexpectedness but rather its unequivocal conclusiveness:

Local government liability for the alleged misconduct of officers and employees dwarfs all other subtopics. For the past thirty years, liability has extracted more time and attention from Georgia's appellate courts than any other subject of local …

Development Of A Construction Safety Program, Christopher Haux Dec 1999

Development Of A Construction Safety Program, Christopher Haux

Theses and Dissertations

In the mid to late 1990's the United States has been experiencing a thriving economy which has spurred increased amounts of construction. During this time of prosperity, the quality of work and the safety of workers can often be forgotten. Each of these areas becomes important to those involved, and to the ability to continue a strong and prosperous economy. Safety to those who produce and those who buy is a sign of a strong economy and a strong community; because construction of communities is what we are really doing.

Internally Constrained Mixtures Of Elastic Continua, Stephen M. Klisch Dec 1999

Internally Constrained Mixtures Of Elastic Continua, Stephen M. Klisch

Mechanical Engineering

A treatment of internally constrained mixtures of elastic continua at a common temperature is developed. Internal constraints involving the deformation gradient tensors and the common mixture temperature are represented by a constraint manifold, and an internally constrained mixture of elastic continua is associated with each unique equivalence class of unconstrained mixtures. The example of intrinsic incompressibility of each constituent first proposed by Mills is discussed.
