The California gold rush, the first international gold rush in history, turned the world upside down, reaching its zenith in the years 1849-50. As a result of the rush during these two climactic years, the population swelled our nation's Pacific coast, entitling California to receive statehood in the fall of 1850. During these catalytic years, Latter-day Saints were journeying to the American West for a different kind of treasure. This dissertation evaluates a program that was developed for the retention of new members in the New Jerusalem Seventh-day Adventist Church. One of the greatest needs of new Christians is help in establishing a meaningful relationship within the body of Christ. The church, not the new converts, is primarily responsible for the process of assimilation. Two strategies were implemented at the New Jerusalem Church: 1. S. Nassir Ghaemi tells us that whereas "neurologists are sometimes accused of admiring disease rather than treating it," psychiatrists seek to cure disease even when they do not understand it. At the same time, he notes that Freud had both theoretical and practical interests that occasionally point in different directions, and psychiatrists have learned that theoretical understanding of the sources of suffering does not always translate directly into useful clinical practice. For their part, philosophers are often criticized for indulging in armchair speculation that yields neither empirical understanding nor practical efficacy. This article explores, criticizes, and extends John Dewey's arguments about art in relation to public life in a democracy. Dewey believed that art is a potent form of communication through which community is developed and political action undertaken. Although correct, Dewey erased conflict, negotiation and contestation From art, and failed to address the crucial role of power in the world of art. Three distinct kinds of political action through art are developed: pragmatic, deliberative, and confrontational.

This Note examines the effects of a defendant's claim of lack of "positional disposition" (i.e., the inability to commit the crime unaided) to support an entrapment defense.

The solution to the positional predisposition dispute requires answering two questions. First, on what grounds should criminal ability be considered at all by a court in determining a defendant's predisposition? Second, if ability is probative of predisposition, what degree of inability should be required for exculpation? This Note argues that a defendant's criminal ability is probative of that defendant's predisposition, and further, that a defendant's inability should be exculpatory to the degree that …

Congressional districting has historically fostered single-member, geographically compact districts consisting of contiguous territory and has resulted in common representation for those who live near each other. Underlying compact districting is the assumption that people living relatively close together share political interests that can be adequately served by common representation. When the United States was a sparsely populated agrarian nation and only the propertied were the enfranchised, providing common representation based on residential proximity was sensible. Over time, however, the connection between residence and political interests has diminished. In the wake of the Supreme Court's suggestion that representation should focus on …

Part I of this Article describes how the Court turned the Confrontation Clause into a rule excluding unreliable hearsay, culminating in the 1980 decision in Ohio v. Roberts, in which the Court set out the "general approach" that dominates confrontation-hearsay analysis today. Part II assesses the application of the Court's exclusionary rule in the two decades since Roberts, a period during which the Confrontation Clause largely has merged with, and disappeared into, the law of evidence, in the process losing its significance as an independent protection for the accused in an adversarial system. We have developed version 1.0 of a freely available (including source code) suite of basic X-Ray Absorption Fine Structure (XAFS) data analysis programs for data reduction and single scattering analysis. This package is based on the University of Washington (UW/NRL) Fortran 77 programs that are available on the International XAFS Society (IXS) database, complemented by a graphical TCL/TK scripting language based user interface which runs virtually unchanged between platforms, using the native look and feel of the corresponding platform. Symmetry breaking surface fields give rise to nontrivial and long-ranged order parameter profiles for critical systems such as fluids, alloys, or magnets confined to wedges. We discuss the properties of the corresponding universal scaling functions of the order parameter profile and the two-point correlation function, and determine the critical exponents η∥ and η⊥ for the so-called normal transition.

The amicus curiae brief has become a common occurrence in today's legal arena, especially with the proliferation of private interest groups that specialize in numerous topics of political and social interest. The substantial increase in the use of amici briefs, however, has sparked criticism concerning both the costs (in effort and resources) associated with filing these griefs and the persuasive effect (or lack thereof) the briefs have on the Court. Much of this criticism arises from the failure of many interest groups to posit "legal" arguments that apply the facts of a given case to the law. Instead, the amici …

The intent of this study is to examine the present institutional arrangements of the Newfoundland and Labrador Northern shrimp fishery, to identify the roles of cooperative fisheries economic development corporations and make recommendations for institutional improvements. There are a number of institutional and organizational arrangements more favorable for fisheries management and development than present ones (Bishop, 1981; Bromley, 1982; McCay and Acheson, 1987; Pinkerton, 1989). With the breakup of the Soviet Union, the United States Navy has seen the fleet shrink from nearly 600 ships in 1988 to 320 ships in 1999, with a planned reduction to 305 ships by 2004. While the fleet has been reduced by nearly 50 percent over the last decade, the deployment of U.S. naval forces has continued at near-Cold War levels. The result is a mismatch between the national security requirements that naval forces are called on to support, and the forces available to meet those requirements. A reversed-phase solid-phase extraction–gas chromatography (SPE–GC)–electron capture detection method is developed to quantitate individual rethrin residues in pyrethrum-exposed brown tree snakes. Aliquots (6 g) of homogenized snake tissue are extracted with 10 mL acetonitrile. The rethrins are recovered from the acetonitrile extract and concentrated using C₈ SPE. The rethrins are eluted from the SPE column with pentane, evaporated to near dryness, and reconstituted to 1 mL with 1-propanol. Individual rethrins are quantitated using GC analysis of the 1-propanol solution. Method limits of detection for rethrins range from 0.63 to 6.51 ng/g. The mean recovery for all rethrins is 70.8% …

Traditionally fed-batch biochemical process optimization and control uses complicated theoretical off-line optimizers, with no online model adaptation or re-optimization. This study demonstrates the applicability, effectiveness, and economic potential of a simple phenomenological model for modeling, and an adaptive critic design, generalized dual heuristic programming, for online re-optimization and control of an aerobic fed-batch fermentor. This study of recent cases of billing and expense fraud confirms the views of David Wilkins, Ted Schneyer, and many other scholars that the disciplinary system performs only one of several needed regulatory functions. The cases demonstrate the need for public and private regulatory responses that not only receive and investigate complaints, but also provide education, prevention, proactive monitoring, and remediation. Lawyers who engage in billing and expense fraud should be fired, disbarred, prosecuted on criminal charges, sued for malpractice. If the public and private organizations that can attend to this problem take it seriously, the norms in the legal …

This is the preliminary report, one in a series on the archaeology of the Wapato Valley region of the Lower Columbia River. Most of the reports discuss aspects of the excavations and archaeology of two sites, the Meier site (35CO5) and Cathlapotle site (45CL1). Other related topics are also treated.

Archaeological investigations at site 45CL1, Clark County, Washington, demonstrate that the locality is a very large (c 1.5ha), deeply stratified (2-4m) town site with an occupation spanning at least 1000 years (c. AD 1000 to 1840). Six large, complex depressions have been mapped. Test excavations show that these depressions represent …

Pre-Baiting For Increased Acceptance Of Zinc Phosphide Baits By Voles: An Assessment Technique, Ray Sterner

During a product-performance test of 2% zinc phosphide (Zn₃P₂) steam-rolled-oat groats (11.2 kg ha^-1) to control voles (Microtus spp) in alfalfa (Medicago sativa), randomly located, brushed-dirt plots were used to assess broadcast distribution and remova/acceptance of placebo particles. Results showed that the Spyker® Model-75 Spreaders were calibrated adequately, with placebo baits broadcast uniformly onto plots [x ± SD = 3.5 (±2.7) groats 930 cmp^-1]. Acceptance of the placebos by voles increased rapidly - 28% and 60% by 24h and 48h post-broadcast, respectively. Analyses of variance confirmed the uniformity (non-significance) …

Fossorial rodents damage lawns/water impoundments/ crops. We conducted a two-choice, parametric-type study to determine the effects of capsicum-oleoresin/soil mixtures (0.00, 0.75, 1.50, and 2.25%) upon soil-contact, soil-digging, and pelage-grooming behaviors in northern pocket gophers (Thomomys talpoides). In 3 alternate-day (1-h/day) exposures to ≥1.50% capsicum-oleoresin soil mixtures, gophers decreased mean soil contact time by 46% relative to placebo-exposed animals. Grooming time yielded a concentration x trial interaction that showed intense grooming by capsicum-exposed animals during trial 1, with "convergence" of times to near those of the "placebos" (0.00% capsicum oleoresin) by trial 3. Brown tree snakes (Boiga irregularis, BTS), inadvertently introduced to the island of Guam shortly after World War II, have had catastrophic effects on the native fauna of this U.S. territory. We used radio-telemetry to monitor daytime refugia and nightly movements of 60 BTS (30 during each of two seasonal periods) to determine the extent of nightly, weekly, and monthly movements. Eighty-three percent of subadult daytime sightings were in trees, compared to only 49% of adult daytime sightings. Most measures of movement did not vary with seasonal period, sex, or age class.
