In the past twenty years, the Chinese government has been adopting open door and economic reform policies. Because of historical, economic, legal, and cultural traditions, a modern corporation system is far from being established in China. It is the focus of this thesis to critically evaluate the cooperative enforcement option proffered by the US authorities with a view to judging its attractiveness to other nations and its adequacy in solving problems posed by extraterritoriality in today's highly liberalized economy. In this regard, we shall see that the various models of cooperative enforcement arrangements adopted within the United States have failed to result in productive bilateral cooperation. This is due in large part, to the commitment of individual countries to satisfying national interests over cooperative obligations arising under the agreements. The legal status of the teacher refers to his life both inside and outside the classroom. The most obvious part of his job is teaching, which consists of the passing of knowledge to his students. Yet before he enters the classroom, there are issues to be resolved. For instance, the nature of the employment contract must be determined. Since job security is a substantial matter, the teacher needs to know whether the employment contract is at will. Consider the following fact situation: A, an artist, designs art work and registers the copyright in that art work. A then licenses P to publish note cards using the art work. The note cards are published by P and distributed to retail card stores. T purchases several hundred cards and then takes each card, glues it carefully to a ceramic tile, and sells the tiles for a profit as "tile art" that purchasers can use to decorate walls, counters, even floors. Acknowledging that its decision means that "some household members" may be without a "critical social necessity," the Massachusetts Supreme Iudicial Court (SJC) ruled in Connors v. City of Boston that Boston Mayor Thomas M. Menino's executive order granting health insurance benefits to the domestic partners of city employees could not stand in the face of a Massachusetts state insurance law. In Connors, the SJC simultaneously recognized that although the demographics of Massachusetts households have changed within the more than forty years since the state insurance law, G.L. c. 32B (Chapter 32B), was adopted, that law nevertheless constrains municipalities from extending …

The Author provides a history and overview of peremptory challenges and their relationship with challenges for cause. Part I of the Article outlines the various types of state statutes and state case law related to the mandatory or permissive use of peremptory challenges to correct perceived error in deciding challenges for cause.
Part II includes a discussion of the current law of error analysis in the federal courts and recent trends in that area of law. Part III consists of a review of the Supreme Court case law involving error analysis and peremptory challenges. This Part examines the specific situation, …

In this Article the Author discusses improving Title IX compliance in athletic programs by reforming the Office for Civil Rights ("OCR"), the agency within the Department of Education responsible for Title IX enforcement. The Author addresses several problem areas within OCR's procedures, including OCR's approach toward student grievances, its standards for assessing alleged Title IX violations, and its inadequate monitoring and enforcement of institutions in violation of Title IX.

The recent extension of intensive agriculture on the karst plateaus has caused different types of impact: soil management, generalised and/or localised pollution. Yet paradoxically rural depopulation can also have negative impacts, which largely depend on the characteristics and the hydrological function of the different karst environments. They are often negative, particularly as far as the water quality is concerned, which is why protection measures are undertaken, either in a defined area for a catchment, or in the framework of regional parks. Italy is made up for about 1/5 of its surface by soluble rocks, which represent the arena of karst environments. The karst morpho-units, some hundreds, are mainly distributed inside the alpine structure of the Mediterranean mountains. A very large number of rock formations are present, different in facies, lithology, age, etc. Among these, carbonate rocks prevail, followed by gypsum and salt. Most of the carbonate rocks are limestones sedimented in a platform environment and they show a wide range of porosity, frequency of fractures and bedding planes. The dry climate of Israel and the karstic nature of its rocks have always imposed human innovation for utilisation of water resources and agriculture. Large perennial karst springs are available only in the lowlands, but sophisticated water supply systems were built both in the lowland and highland regions. Marl layers interbedded within carbonates give rise to local perched springs and allow terrace construction. Deforestation has taken place for some 4000 years, causing intense soil erosion, but terraces have reduced this impact.

The exposed carbonate rocks aged from Sinian to Mid-Triassic Periods cover an area of 500,000 km2 in south-west China. In karst areas with spectacular landscapes characterized by magnificent tower karst and conical karst, rare surface drainage systems and prevalent subsurface drainage systems, the environment is ecologically very fragile. The rapid increase of population, over deforested and cultivated lands, worsted the ecological system, causing a higher frequency of draught, flood and various disasters, backward economic development, low living standard of the people.
