INTRODUCTION: A HOSTILE CLIMATE FOR CRIMINAL DEFENSE LAWYERS AND OUR CLIENTS
Criminal defense work is an increasingly difficult undertaking in these harsh times. Blame is a favorite pastime. Vengeance follows close behind. Compassion for those who commit wrongdoing out of misfortune seems either nostalgic or naive. Instead, there is a universal call for individual accountability; wrongdoers ought to be held strictly responsible for their actions, no matter the circumstance.
Along with blame and vengeance comes a lust for punishment. The public cannot seem to get enough of it. The United States is building prisons at a record pace. If the …

Judicial Politics, Death Penalty Appeals, And Case Selection: An Empirical Study, John H. Blume, Theodore Eisenberg
Judicial Politics, Death Penalty Appeals, And Case Selection: An Empirical Study, John H. Blume, Theodore Eisenberg
Cornell Law Faculty Publications
Several studies try to explain case outcomes based on the politics of judicial selection methods. Scholars usually hypothesize that judges selected by partisan popular elections are subject to greater political pressure in deciding cases than are other judges. No class of cases seems more amenable to such analysis than death penalty cases. No study, however, accounts both for judicial politics and case selection, the process through which cases are selected for death penalty litigation. Yet, the case selection process cannot be ignored because it yields a set of cases for adjudication that is far from a random selection of cases. …

Semiotics, Analogical Legal Reasoning, And The Cf. Citation: Getting Our Signals Uncrossed, Ira P. Robbins
Duke Law Journal
The Bluebook's introductory citation signals are essential to effective legal discourse. The choice of signal can influence not only the interpretation of cited cases, but also the path of the law. In this Article, Professor Ira Robbins examines one commonly used signal: the cf. After exploring its semiotic function, he details the multitude of ways in which this signal has been used and misused. He argues that lawyers' and judges' careless use of the cf. leads to confusing and often incoherent developments in the law, and concludes by proposing a precise working definition for this irksome, but potentially powerful, citation …

A Management Role Perspective Of Adult Protective Services, Isaac Garza
Theses and Dissertations - UTB/UTPA
This study examines the most important management roles, as viewed by Adult Protective Services supervisors and Adult Protective Services staff members in Region 11. A total of 6 supervisors and 51 staff members were mailed questionnaires on October 1, 1998. A total of 5 supervisors and 26 staff members completed and returned the questionnaires.
The study is limited by a lack of a consistent management role theory, limited to a basic method of aggregation, and limited to a specific population.
APS supervisors were found to believe the management roles of leader, monitor and disturbance handler as being most important to …

Assessment Of A Technical Assistance Model: Serving Youth With Disabilities In Residential Settings In North Dakota., Joan Bonsness
Theses and Dissertations
State education agencies, school districts, and residential corrective and treatment facilities share common concern for the disproportionate number of youth with disabilities placed in out-of-district settings. Central to this concern is the fact that many juveniles with disabilities in residential facilities may not receive the educational services to which they are entitled. The North Dakota Department of Public Instruction (DPI) initiated a technical assistance project in an effort to facilitate cooperation between corrective and treatment facilities and school districts in serving these youth. The purpose of this study was to identify if a technical assistance project could facilitate interaction among educators …
