The Rise And Fall Of Affirmative Action Injury Selection, Avern Cohn, David R. Sherwood

The U.S. District Court for the Eastern District of Michigan has historically experienced difficulty in achieving jury compositions that truly represented the surrounding community. In response, the Authors share their insight as to how the court instituted a "balancing" program. By reducing the number of white names in the jury wheel, the balancing program successfully incorporated more minorities into the jury system. The Authors further discuss the Sixth Circuit decision, United States v. Ovalle, which marked the end of the balancing program.

The Interplay Of Race And False Claims Of Jury Nullification, Nancy S. Marder

After the verdicts in the OJ Simpson and Stacey Koon/Laurence Powell cases, many in the press explained the juries' acquittals as instances of jury nullification. However these were unlikely to have been instances of nullification, particularly because the jurors explained that their verdicts were based on reasonable doubt. One motivation for these false claims of jury nullification was the homogeneity of the juries-a largely African-American jury in the case of Simpson and a largely white jury in the case of Koon/Powell. Nullification became the term by which press and public attempted to discredit verdicts rendered by juries they distrusted. A …

The Arizona Jury Reform Permitting Civil Jury Trial Discussions: The Views Of Trial Participants, Judges, And Jurors, Valerie P. Hans, Paula L. Hannaford, G. Thomas Munslerman

In 1995, the Arizona Supreme Court reformed the jury trial process by allowing civil jurors to discuss the evidence presented during trial prior to their formal deliberations. This Article examines and evaluates the theoretical, legal, and policy issues raised by this reform and presents the early results of afield experiment that tested the impact of trial discussions. Jurors, judges, attorneys, and litigants in civil jury trials in Arizona were questioned regarding their observations, experiences, and reactions during trial as well as what they perceived to be the benefits and drawback of juror discussions. The Offense: Interpreting The Indictment Requirement In 21 U.S.C. § 851, Christopher Serkin

Congress enacted the Comprehensive Drug Abuse Prevention and Control Act of 1970 ("the Act") to unify and rationalize its treatment of drug offenses. The Act was an enormous piece of legislation, requiring months of congressional hearings before it was passed. Today, the Act encompasses over 150 sections of title 21 of the U.S. Code and regulates behavior ranging from manufacturing and mislabeling to prescribing controlled substances. Like any piece of complex legislation, the Act has spawned its share of litigation. One controversy has defied satisfactory resolution: the meaning of the innocuous phrase, "the offense," in section 851(a)(2). The statute's structure …

The study focuses on the issue of establishing a citizen review board at the Las Vegas Metropolitan Police Department (LVMPD) for the purpose of reviewing allegations of misconduct. With the recent increase of police officer misconduct the LVMPD has come under a great deal of scrutiny by residents of the community. The credibility of the department has been jeopardized as a result of the current complaint investigations process which is conducted by the Internal Affairs Bureau. Community activist have demanded that a citizen review board be established to investigate complaints of police misconduct. The purpose of setting up a citizen …

The Estimation Of Rape Prevalence: A Reflexive Account Of The Construction And Pretesting Of A New Questionnaire, Edith Marie Fisher

A review of the rape literature and current assessment suggests that research done in this highly sensitive area is especially vulnerable to response effects. Comparisons between studies is problematic due to vast differences in the conceptualizations of rape, the wording and context of the questions used to solicit data as well as the method of data collection. I created a new rape prevalence questionnaire with the intent of decreasing response effects. I conducted 15 semi-structured pretest interviews with female Western Michigan University students and three pilot tests, in which 30 telephone interviews were completed, 30 personal interviews were completed, and …

Perceiving Oppression: Relationships With Resilience, Self-Esteem, Depressive Symptoms, And Reliance On God In African-American Homeless Men, Jill Littrell, Elizabeth Beck
The Journal of Sociology & Social Welfare
Empowerment has been proffered as a desirable goal for many disadvantaged populations. The process of empowerment can include encouraging disadvantaged individuals to recognize the structural factors in society (e.g., discrimination, oppression, injustice) which contribute to disadvantaged status. Two studies sought to determine the impact that recognition of oppression has on a disadvantaged individual's (1) self-esteem; (2) level of depressive symptoms; (3) resilience which includes a sense of master y and optimism; (4) anger; and (5) reliance on God. These issues were investiga ted in a sample of African-American men seeking services at a soup-kitchen ministry. Perceptions of racial discrimination were …

VCU Today, the University’s first official administrative organ, began as a somewhat irregular monthly publication but moved to a bi-weekly newspaper format in the 1980s. The newspaper changed its name to VCU Voice in 1988 and ten years later it appeared under the title UniverCity News. As it neared the end of its run as a physical newspaper, the publication became simply VCU News. These four publications were essentially the same periodical published under different titles by the Office of University Relations. VCU News appeared online for the first time in 2002.
