the first section of this essay is devoted to demonstrating the courts' errors. Nonetheless, considered together, these opinions are perhaps an understandable reflection of judicial unease with an important component of the federal sentencing system — the longstanding, but increasingly common, practice of making deals with criminal defendants to reduce their sentences in return for testimony against their accomplices. This Article's second section will consider the most common criticisms of the system of bargaining for testimony under the United States Sentencing Guidelines (the Guidelines) to determine whether Singleton and Sealed Case may be good policy even if they are bad …
Biculturalism And Native American College Students' Performance On The Wais-Iii, Teton Ducheneaux
Biculturalism And Native American College Students' Performance On The Wais-Iii, Teton Ducheneaux
Theses and Dissertations
Consideration of cultural appropriateness in using Westem-European standardized intelligence measures with Native Americans for clinical and educational purposes has been neglected by professionals in the field of clinical assessment. Some studies suggest the possibility of a “Native American Pattern” on such tests, indicating a consistent, yet little-understood discrepancy. The present study investigated the impact of cultural identification of Native American college students on the Wechsler Adult Intelligence Scale-Third Edition (WAIS-III). The study assessed the relationship between cultural identification and cognitive-testing scores between two groups of Native American college students. The first group consisted of off-reservation Native American students attending the …

Constitutional Criminal Procedure: A Two Year Survey, James P. Fleissner, Jeffrey R. Harris
Mercer Law Review
This Article surveys significant constitutional criminal procedure decisions of the United States Court of Appeals for the Eleventh Circuit issued during 1997 and 1998. The "constitutional" branch of criminal procedure focuses on the interpretation of the Fourth, Fifth, and Sixth Amendments to the United States Constitution. In selecting "significant" decisions, we emphasized questions of first impression, other noteworthy cases, and issues likely to interest attorneys practicing in the courts of the Eleventh Circuit. We have endeavored to summarize the selected decisions and provide commentary that, hopefully, will illuminate the issues and assist the reader in understanding the importance and implications …

Executive Privilege Or Punishment? The Need To Define Legitimate Invocations And Conflict Resolution Techniques, Mark P. Doherty
Executive Privilege Or Punishment? The Need To Define Legitimate Invocations And Conflict Resolution Techniques, Mark P. Doherty
Northern Illinois University Law Review
This comment describes justifications for the doctrine of executive privilege and then examines various arguments against its legitimacy and use. This comment then reflects on several historical invocations of the privilege and the ensuing public, political, and judicial reactions. Finally, the author suggests that Congress implement guidelines for legitimate invocations of the executive privilege and outlines an effective system to safeguard this constitutional executive prerogative.
The Wisconsin Bear Arms Amendment And The Case Against An Absolute Prohibition On Carrying Concealed Weapons, Christopher R. Mcfadden
The Wisconsin Bear Arms Amendment And The Case Against An Absolute Prohibition On Carrying Concealed Weapons, Christopher R. Mcfadden
Northern Illinois University Law Review
In November 1998, the voters of Wisconsin established a constitutional right to keep and bear arms. The Wisconsin Legislature framed and sent to the voters a broadly worded constitutional amendment that created an individual right to keep and bear arms for defense, security, hunting, recreation, or any other lawful purpose. It was designed to repeal and prevent the subsequent re-enactment of unreasonable prohibitions of that right, including the state's current sweeping prohibition of the liberty to carry concealed weapons at any time or place or in any manner. In light of this legislative history and voter understanding of the amendment, …

Sex, Culture, And The Biology Of Rape: Toward Explanation And Prevention, Owen D. Jones
Sex, Culture, And The Biology Of Rape: Toward Explanation And Prevention, Owen D. Jones
Vanderbilt Law School Faculty Publications
For all that has been written about rape, its multiple causes remain insufficiently understood for law to deter it effectively. This follows, in part, from inadequately interdisciplinary study of rape causation. This Article argues that integrating life science and social science perspectives on sexual aggression can improve law's model of rape behavior, and further our efforts to reduce its incidence.
The Article first explains biobehavioral theories of sexual aggression, and offers a guide to common but avoidable errors in assessing them. It then compares a number of those theories' predictions with existing data and demonstrates how knowledge of the effects …
