Miller V. Albright: Problems Of Constitutionalization In Family Law, Katharine B. Silbaugh Jan 1999

Miller V. Albright: Problems Of Constitutionalization In Family Law, Katharine B. Silbaugh

Faculty Scholarship

From time to time, the Supreme Court chooses to hear a case addressing a family law issue. The family law cases accepted by the Supreme Court almost always present a constitutional challenge because absent a constitutional question, state law governs family law. Because the Supreme Court controls its docket, it is free to select only those cases that, in the view of the Court, pose particularly challenging issues. On most occasions, the Court chooses only those family law cases that present other, unrelated issues of interest to the Court.

Assessing Career Value Of Hospitality Management Curriculum From Program Alumni, James Reid Jan 1999

Assessing Career Value Of Hospitality Management Curriculum From Program Alumni, James Reid

Theses

The purpose of this study was to investigate the assessment of hospitality management baccalaureate program alumni from New York Technical College (NYCTC) as being a valuable resource to the Hospitality Management curriculum assessment effort . Through the development of an alumni questionnaire, participants in this study were asked to rate individual courses of their curriculum (both core and elective) by the degree of value each course had been in terms of usefulness to their career development and/or relevance to meeting the demands of their current positions. Although the questionnaire response rate was less than desirable, it is stressed that survey …

The material is multilayered, with aluminium foil as its core plus is top coated and has a sealant layer as its bottom coating. Background literary review commences with a chronological assessment of packaging down through the ages and culminates with details on multilayered materials, concentrating on the type of material being researched. A test plan details the research requirements. Seal testing consists of burst and peel testing of the material …

The Best And The Brightest: Canadian Law School Admissions, Dawna Tong, W. Wesley Pue Jan 1999

The Best And The Brightest: Canadian Law School Admissions, Dawna Tong, W. Wesley Pue

All Faculty Publications

This article assesses the admissions policies commonly employed by law faculties in common law Canada. These faculties rely heavily on admissions criteria and policies developed in the United States and, like their American counterparts, typically admit students on the basis of "index scores" produced by combining Law School Admissions Test (LSAT) performance with Undergraduate Grade Point Average (UGPA). The appropriateness of this American model to the Canadian context has never been rigorously assessed. This raises serious questions as to whether Canadian law school admissions policies serve either of their stated goals of finding the "best" students or of advancing social …

Constitutional Tales Of Violence: Populists, Outgroups, And The Multicultural Landscape Of The Second Amendment, David C. Williams Jan 1999

Constitutional Tales Of Violence: Populists, Outgroups, And The Multicultural Landscape Of The Second Amendment, David C. Williams

Articles by Maurer Faculty

Traditionally, populists have claimed the Second Amendment as their particular cultural property; by contrast, outgroups and elites have found the Amendment somewhat culturally alien. Recently, some outgroup members have argued that their groups ought to embrace the Amendment because the right to keep and bear arms can be a valuable way of resisting populist oppression. This Article explores this changing multicultural landscape of the Second Amendment It recognizes that in particular instances and in the short term, outgroups might need to arm themselves against hate violence. It argues, however, that only a consensus culture on the use of violence will …

Embracing Descent: The Bankruptcy Of A Business Paradigm For Conceptualizing And Regulating The Legal Profession, Jeffrey W. Stempel Jan 1999

Embracing Descent: The Bankruptcy Of A Business Paradigm For Conceptualizing And Regulating The Legal Profession, Jeffrey W. Stempel

Scholarly Works

Lawyers are said to travel in packs, or at least pairs, and in the popular parlance are often compared to hoards of locusts, herds of cattle, or unruly mobs. However, at least for purposes of assessing concerns with professionalism currently surrounding the bar and the public, whether attorneys are more or less social than other human animals does not matter. My point is simply that lawyers are social beings; like other human beings in social and occupational groups, lawyers behave largely in accordance with group norms, in much the same way peer pressure led Julian English toward juvenile delinquency in …

Pigeonholing Illness: Medical Diagnosis As A Legal Construct, Lars Noah Jan 1999

Pigeonholing Illness: Medical Diagnosis As A Legal Construct, Lars Noah

UC Law Journal

Disease definitions and clinical judgments routinely affect coverage and reimbursement decisions by health insurers, the licensing determinations of regulatory agencies charged with reviewing new therapeutic technologies, evidentiary and substantive rulings by the judiciary in personal injury lawsuits and criminal trials, eligibility decisions in disability programs, and the resolution of claims before workers' compensation tribunals. This reliance on the definition and identification of disease by the medical profession fails to appreciate the extent to which our conceptions of illness are socially constructed rather than based on value-neutral scientific data and the application of technical expertise.

Just as social forces shape medical …

The Judicial Politics Of White Collar Crime, J. Kelly Strader Jan 1999

The Judicial Politics Of White Collar Crime, J. Kelly Strader

UC Law Journal

White collar crime cases produce a curious paradox in Supreme Court jurisprudence: in a substantial number of the Court's leading white collar criminal cases, ranging from insider trading to political corruption cases, the "liberal" justices have voted to affirm convictions, and the "conservative" justices to reverse them. Even more frequently, these cases have produced strange alliances among the liberals and conservatives, who rarely split into such groupings in non-white collar criminal cases. And it is not merely votes and alliances that change in white collar cases; judicial philosophies, attitudes, and rhetoric transmogrify into a veritable twilight zone of Supreme Court …

America's Uneasy Relationship With The Working Poor, A. Mechele Dickerson Jan 1999

America's Uneasy Relationship With The Working Poor, A. Mechele Dickerson

UC Law Journal

While Americans historically have supported efforts to provide financial assistance to the truly needy members of our society, we have a fear that giving cash or other forms of economic assistance to the unemployed but able-bodied is morally corrupting and fosters economic dependency. Recent efforts to overhaul welfare and bankruptcy laws resulted from the public's perception that too many people failed to become economically self-sufficient despite an extended peacetime period of economic prosperity.

This Article examines our society's uneasy relationship with the working poor and our hesitancy to provide economic relief to ablebodied people who appear to have contributed to …

Revisiting The Struggle For Integration, Michelle Fine, Bernadette Anand Jan 1999

Revisiting The Struggle For Integration, Michelle Fine, Bernadette Anand

Publications and Research

The project we describe in this article emerged from thinking about Fridays. While the Monday through Thursday schedule at Renaissance Middle School in Montclair, New Jersey covers the traditional distribution of curriculum, Fridays are dedicated to nine-week cycles of two hour sessions. Each session involves in-depth work focusing on five themes: Aviation, Genetics, Building Bridges, Community Service and this, the Oral History Project. Because the school is thematically organized around core notions of justice, history, social movements and "renaissances" (that is, Italian, Harlem and Montclair), we structured this project around the deeply contested history of desegregation of the Montclair public …

Bourdieu's Concept Of Social Capital : An Examination Of His Broader Theoretical Framework And The Concept's Applications And Implications For Australian Social Policy, Dawn Marie Atkin Jan 1999

Bourdieu's Concept Of Social Capital : An Examination Of His Broader Theoretical Framework And The Concept's Applications And Implications For Australian Social Policy, Dawn Marie Atkin

Theses : Honours

The concept of social capital is investigated in this thesis both in its theoretical and potential social policy environment Pierre Bourdicu 's 'Theory of Practice' provides the theoretical frame within which this concept is investigated. A variety of texts, with a particular focus on Australian publications, provide the basis for further application analysis. This is primarily a textual research therefore data gathering procedures were library based. Being a theoretical analysis of the current status of social capital, as it relates to prospective social policy reform in Australia, this thesis both collates and contributes to a body of knowledge regarding the …

Dancing With Difference, Michael J. Lenney Jan 1999

Dancing With Difference, Michael J. Lenney

Theses : Honours

This is a symbolic interactionist study into behaviours surrounding social interaction. The study has two components, asking how people with able-bodies interact with a young person with a disability, and how does the young person, who is non-verbal, respond to and interpret such interactions? Participants were observed and recorded using a digital camera whilst interacting at a social venue. The able-bodied participants were not aware of the camera at the time of filming, and were approached after the filming to participate in the study. Seven participants were later interviewed and asked to explain what they were aware of as they …

Bicultural Involvement And Psychological Well-Being In Second Generation Chinese Migrants In Australia, Denise A. Kensit Jan 1999

Bicultural Involvement And Psychological Well-Being In Second Generation Chinese Migrants In Australia, Denise A. Kensit

Theses : Honours

The present study, a replication of Szapocnik, Kurtines and Fernandez's (1980) study, measured the relationship between bicultural involvement and psychological wellbeing for second generation (i.e. born in Australia) Chinese migrants in Perth, Western Australia. Ninety volunteers participated in the study. They were all Australian citizens, over l 8 years of age, and spoke English. Two studies were conducted. Firstly, four volunteers participated in semi-structured interviews to provide a context to data yielded from the quantitative study. Secondly, eighty-six second generation migrants (i.e. born in Australia) completed a questionnaire that included the Bicultural Involvement Questionnaire (B1Q) and the General Health Questionnaire, …

Academic Security Education : The Development Of An Industry Based Security Management Curriculum, Layne M. Hesse Jan 1999

Academic Security Education : The Development Of An Industry Based Security Management Curriculum, Layne M. Hesse

Theses : Honours

This study examined the education profiles and skills and knowledge required for security managers conducted through an educational needs analysis of the security field. Little information is currently available about security education in Australia and there is no centralised source of information about such education. There is also comparatively little information exchanged across institutions, government and industry. A survey using the interview method obtained and analysed the opinions and perceptions of security skills and knowledge from the sample population. The aim of this study was to contribute to the security field by exploring and analysing the skills and knowledge required …

The Perception Of Aboriginal And Torres Strait Islander Values : Is Value Incongruence Related To Social Distance?, Lauren Jennifer Breen Jan 1999

The Perception Of Aboriginal And Torres Strait Islander Values : Is Value Incongruence Related To Social Distance?, Lauren Jennifer Breen

Theses : Honours

This review examines prejudicial actions directed towards outgroups as a function of personal values and the perception of the values held by other groups. Prejudice is a result of social and cognitive categorisation. Although it is well learned, prejudice is not inevitable, if individuals attend to and control their prejudicial thoughts. Pleasurable interaction, cooperation, equal status, and making humanitarian values conspicuous serve to reduce intergroup conflict. It was proposed that values motivate approach and avoidance behaviours directed at outgroups, and both belief congruence theory and expectance-value theory arc relevant in explaining such behaviour.

Moving To Western Australia : Decision Making Processes Of Migrants From The United Kingdom, Lynne Cohen Jan 1999

Moving To Western Australia : Decision Making Processes Of Migrants From The United Kingdom, Lynne Cohen

Theses: Doctorates and Masters

International migration has assumed a new importance during the last few decades due to the volume and increase of population movement. Two important questions are relevant to the migration process. The person has to make the decision to move and to select a place of destination. In this thesis a series of studies designed to examine the factors that led to the consideration of leaving and the attributes which contributed to the choice of destination are presented. This research begins by adopting suggestions proposed by Jahoda (1981) to ask questions and thereby increase the knowledge base. The methodological framework of …

A Case Study Of Pressure Group Activity In Western Australia: Medical Care Of The Dying Bill (1995), Hazel Jane Sims Jan 1999

A Case Study Of Pressure Group Activity In Western Australia: Medical Care Of The Dying Bill (1995), Hazel Jane Sims

Theses: Doctorates and Masters

When the Australian Labor Party member for Kalgoorlie, Ian Taylor, presented his Private Member's Bill - the Medical Care of the Dying Bill (1995), he laid the foundation for this thesis. Mr Taylor introduced his Bill to the Western Australian Legislative Assembly on 28 March 1995. The Bill codified the terminally ill patient's right to refuse medical treatment, which clarified common law. This thesis attempts to overcome the dearth of literature in Western Australian lobbying concerning conscience-vote issues. It also identifies the key issues in understanding political lobbying, the form of pressure group activity that takes place and why certain …

An Assessment Of The Project Challenge Pilot Program Evaluation, Judy Lynn Scripter Jan 1999

An Assessment Of The Project Challenge Pilot Program Evaluation, Judy Lynn Scripter

Cal Poly Humboldt theses and projects

There are ongoing discussions in the field of social research concerning the utility of Program Evaluation (Browne and Wildavsky, 1983; Posavac and Carey, 1989; Deshler and Ewert, 1995). Program managers need relevant information to make policy decisions, improve processes, or validate their existence. Program evaluation activities need to be assessed for the same reasons social researchers evaluate programs, i.e., accountability, selecting best practices, program improvement, etc.... Posavac and Carey (1989:3) state “The mission of program evaluation... is to assist in improving the quality of human services.” The purpose of this project was to assess the evaluation of Project Challenge Pilot …

The Media's Influence On Women's Labor Force Participation: A Content Analysis Of Magazines, Cassandra S. Crawford Jan 1999

The Media's Influence On Women's Labor Force Participation: A Content Analysis Of Magazines, Cassandra S. Crawford

Cal Poly Humboldt theses and projects

The media can be understood not as a mechanism which dictates cultural specifics, but rather, as forum for cultural mimicry. The Symbolic Interactionist perspective suggests that the media has a degree of influence similar to that of other actors, because readers are imputed in the production of meaning. Interactions are dynamic and, as a consequence, a multiplicity of meanings are inevitable. Women’s occupational imaging in advertisements can be utilized to illustrate this assertion. Year intervals in which labor force participation rates increased 1.5% or greater were extracted from labor force data. In order to ascertain what influence the media has …

The Shadow Children, Patricia A. Menzies Jan 1999

The Shadow Children, Patricia A. Menzies

Cal Poly Humboldt theses and projects

Fifty years ago, to be a good foster parent, all one needed was a lot of love and patience. As we approach the 21st century, foster parenting has become a complex career choice wherein the foster parent needs to have a multi-faceted background in order to adequately deal with children who have been traumatized by those who should have been protecting them. Oftentimes suffering severe psychological damage, these children can present an overwhelming challenge to particularly the novice foster parent, but also to the veteran foster parent who is finding that, with each year, the children are arriving with more …
