Nomos, Narrative, And Adjudication: Toward A Jurisgenetic Theory Of Law, Franklin G. Snyder May 1999

Nomos, Narrative, And Adjudication: Toward A Jurisgenetic Theory Of Law, Franklin G. Snyder

Faculty Scholarship

The world is bubbling over with law. As the late Robert Cover tells us in Nomos and Narrative, it springs up about us incessantly and inexorably in a spontaneous riot of luxuriant foliage. It bursts forth not from gods or kings or parliaments or courts but from the normative universe--what Cover calls the nomos --of each group within a society, a process he calls "the creation of legal meaning" or "jurisgenesis." As there are unnumbered groups in society, all with their unique nomoi, all jostling each other, the very air is alive with divergent legal meanings on every …

At Risk In The Writing Classroom: Negotiating A Lesbian Teacher Identity, Irene G. Meaker May 1999

At Risk In The Writing Classroom: Negotiating A Lesbian Teacher Identity, Irene G. Meaker

Department of English: Dissertations, Theses, and Student Research

"Education is a fearful enterprise," says teacher and philosopher, Parker Palmer. Student-centered/ processoriented pedagogy asks teachers to step out from behind the relative safety of the teacher mask and to enter the risky arena of learning. For the writing teacher, a special challenge is to help students negotiate the risks inherent in the act of writing and in sharing writing with the "Other."

To prevent fears from dominating our students, teachers must model risk-taking and risk negotiation. In my own teaching, my fears around students' reactions to learning my sexual identity meant that I more often reinforced fears than dispelled …

Alternative Spring Break And Social Responsibility Is There A Relationship?, Judith Angela Biggs Garbuio

Thesis, Dissertations, Student Creative Activity, and Scholarship

Humans are living in a complex, interdependent, global society. Violence by youth is at an all-time high, the school system is failing to educate students (especially in urban areas), and all of this is compounded by major economic and social forces that are significantly altering the fabric of our lives. According to Keith (1994) these forces include: “… the impact of technology and the globalization of the economy on social relations and the structure of work (Broyn. 1991; Mingrone, 1983; Offee & Heinz. 1992; Wilson. 1987); the depletion of non-renewable resources and the ecological crisis; the mounting pace of population …

Habitus Wars And Field(S) Of Dreams: Using Bourdieu To Reframe The Sense Of A Crisis, Louann Hofheins Cummings May 1999

Habitus Wars And Field(S) Of Dreams: Using Bourdieu To Reframe The Sense Of A Crisis, Louann Hofheins Cummings

Student Scholarship

The paper illustrates the application of Pierre Bourdieu's oeuvre to a qualitative research project regarding organizational change. Considerable attention is given to the interaction of field delineation, capital stakes struggle, interests, and individual/class habitus at both a church and a medical college. It is posited that a focus on field analysis considers the sources of capital struggle in a given realm. This, in turn, grants a researcher a new way to analyze who participates in these struggles, what prized capital stimulates interest, and how action and prctices are subsequently engendered. This body of work suggests that agents and/or classes have …

Cross-Examining The Myth Of Lawyers' Misery, Kathleen E. Hull May 1999

Cross-Examining The Myth Of Lawyers' Misery, Kathleen E. Hull

Vanderbilt Law Review

This comment will address one important aspect of Professor Schiltz's broader argument, namely his contention that the legal profession is afflicted with widespread job dissatisfaction. More specifically, Schiltz makes the following assertions about lawyers' unhappiness with their professional lives: (1) dissatisfaction is high; (2) dissatisfaction is increasing; and (3) dissatisfaction is highest among lawyers in private practice in large firms.' Using data from a recent survey of Chicago attorneys as well as other studies of lawyers' job satisfaction, including those cited by Schiltz, I will address each of these points in turn.

Comparisons were made between the current sample and the sample of Bossard and Boll. Numerous changes in family rituals were identified. Christmas was found to be the most discussed ritual, but Christmas Eve rituals were more often discussed than Christmas Day rituals. The importance …

The Value Of Independence In Old Age, Paula C. Carder May 1999

The Value Of Independence In Old Age, Paula C. Carder

Dissertations and Theses

Why is independence a central theme for proponents of assisted living facilities? How do assisted living providers respond to this theme? These questions are pursued in an ethnographic study centered on Oregon's assisted living program. Assisted living facilities (ALF), defined and monitored by Oregon's Senior and Disabled Services Division (SDSD), are a type of housing for disabled, primarily elderly, persons. Oregon Administrative Rules (OAR-411-56) define independence, requiring ALF providers to support resident independence.

Using social worlds theory as a sensitizing concept, assisted living is treated as a distinct social world. The activities of key groups, including SDSD staff, an ALF …

These institutions are normally occupied by the senior citizens who are not only poor but also unable to look after …

Transportation System In Malaysian Rural Areas, Hamidah Yusof May 1999

Transportation System In Malaysian Rural Areas, Hamidah Yusof

Master's Projects

This study aims to generate an empirical transportation model to facilitate and improve mobility in the rural areas of Malaysia. Mobility is a catalyst for economic and social development of the rural areas. Residents in the villages face two main problems: limited public transportation services and minimum goods transportation facilities. The number of passenger trips and trips for transporting goods is still at a minimum level which affects the planning of better transportation systems. Private companies and operators are not interested in investing in public transportation services as profits are uncertain.

Three villages in Malaysia have been selected for the …

Relating Children's Social Competence To Maternal Beliefs And Management Strategies Of Peer Relationships, Eryn D. Hamel

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

This study explored the links between maternal beliefs about the importance of children's social skills, modes of obtaining social skills, management strategies, and children's social competence. Subjects were 67 mothers whose 3- and 4-year-old children attended one of five preschools in Cache Valley, Utah. Mothers completed questionnaires assessing their beliefs about the importance of social skills, their beliefs about how children acquire social skills, and the ways they are involved in their children 's peer relationships. Demographic measures were also completed by the mothers. Classroom teachers completed the Child Behavior Scale on every child in their class, regardless of maternal …

Temperament, Attachment, And Parenting Stress In Infancy: Relations To Social Competence Of Second Graders, Gina A. Cook May 1999

Temperament, Attachment, And Parenting Stress In Infancy: Relations To Social Competence Of Second Graders, Gina A. Cook

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

The importance of social competence in children's development has been recognized, and evidence has been found that children who are socially incompetent are at risk for academic problems. Yet the influences that may be involved from infancy, such as temperament and attachment, have not been explored longitudinally. The purpose of this study was to investigate the influence of infant temperament characteristics on later social development and to explore the idea that this influence may be affected by the infant's attachment security mediated by parenting stress.

Eighteen-month-old infants, from a previous study, were studied as second graders to examine whether their …
