Displacement-Based Analysis And Design Of Rigid Retaining Walls During Earthquakes, Yingwei Wu Jan 1999

Displacement-Based Analysis And Design Of Rigid Retaining Walls During Earthquakes, Yingwei Wu

Doctoral Dissertations

"This research focused on the analysis and design of rigid retaining walls subjected to earthquakes and considered nonlinear foundation soil properties. The simultaneous sliding and rocking movements of retaining walls were considered. Seven field conditions, including moist, submerged, perched and saturated backfill with a sloping drain, were specified by design codes. A computer program capable of computing displacement using real time history records or equivalent sinusoidal motions was developed. Finally, a dynamic design procedure was proposed for practicing engineers.

The study revealed that maximum shear modulus in foundation soil, maximum ground acceleration, and soil nonlinearity had significant effect on the …

Machine Tool Accuracy Characterization, Error Modeling And Compensation Using Telescopic Ballbar And Laser Interferometer, Yalcin M. Ertekin Jan 1999

Machine Tool Accuracy Characterization, Error Modeling And Compensation Using Telescopic Ballbar And Laser Interferometer, Yalcin M. Ertekin

Doctoral Dissertations

"This dissertation presents the results of the research investigation on the machine tool accuracy characterization, error modeling and error compensation using telescopic ballbar and laser interferometer. Increasing demand for both higher machine tool accuracy and machining tolerances has resulted in a great need to measure and characterize the accuracy of NC machine tools and minimize machine tool induced errors on machined components before manufacturing parts, instead of inferring it from parts already machined. Using a telescopic magnetic ballbar, the results of the accuracy assessment of an old Bridgeport Series I CNC 2 1/2 axes vertical machining center are presented in …

Stability Of Paleosinks And Karstic Carbonates In The Southern Fire Clay Mining District Of Missouri, Robert Weiser Dillon Jan 1999

Stability Of Paleosinks And Karstic Carbonates In The Southern Fire Clay Mining District Of Missouri, Robert Weiser Dillon

Doctoral Dissertations

"The Southern Fire Clay District of Missouri was intensely mined during the late-1800’s to mid-1900’s for its valuable resource of high refractory clays deposited within Pennsylvanian sinkholes “paleosinks”. Mining operations have produced modifications in the Ozark aquifer, which in effect has possibly increased the instability of this paleokarst terrain and the potential of further environmental impacts to the land. Evidence supporting this hypothesis are: (1) A southerly shift in the regional groundwater divide relative to the topographic divide. This possibly is caused by the distribution of leaking clay pits, which suggests that the bedrock permeability or hydraulic conductivity has been …

Laughing At Treaties, Carlos Manuel Vázquez Jan 1999

Laughing At Treaties, Carlos Manuel Vázquez

Georgetown Law Faculty Publications and Other Works

This article responds to two articles by Professor John Yoo appearing in the same volume. Professor Yoo maintains that treaties, either categorically or presumptively, have the same status in the United States as in the United Kingdom, where they lack the force of domestic law, and hence are not judicially enforceable, until implemented by statute. This response argues that Yoo's thesis contradicts the text of the Constitution, which declares treaties to be the 'law of the land.' The response notes, further, that Professor Yoo's reliance on the ratification debates to read the Supremacy Clause's reference to treaties out of the …

Dignity And Discrimination: Toward A Pluralistic Understanding Of Workplace Harassment, Rosa Ehrenreich Brooks Jan 1999

Dignity And Discrimination: Toward A Pluralistic Understanding Of Workplace Harassment, Rosa Ehrenreich Brooks

Georgetown Law Faculty Publications and Other Works

Part I of this article briefly examines some of the drawbacks and inconsistencies of Title VII sexual harassment jurisprudence and shows that Title VII does not provide an adequate framework for understanding many common forms of workplace harassment. Title VII is unquestionably a critical means of fighting against workplace discrimination; however, by emphasizing discrimination at the expense of dignity, the Title VII workplace harassment paradigm provides an incomplete understanding of the wrongs of workplace harassment.

Part II of this article asserts the importance of an approach to sexual harassment that distinguishes between the nature of the harm of workplace sexual …

An Originalism For Nonoriginalists, Randy E. Barnett Jan 1999

An Originalism For Nonoriginalists, Randy E. Barnett

Georgetown Law Faculty Publications and Other Works

The received wisdom among law professors is that originalism is dead, having been defeated in intellectual combat sometime in the eighties. According to this story, Edwin Meese and Robert Bork proposed that the Constitution be interpreted according to the original intentions of its framers. Their view was trounced by many academic critics, perhaps most notably by Paul Brest in his widely-cited 1980 Boston University Law Review article, The Misconceived Quest for Original Understanding, and by H. Jefferson Powell in his 1985 Harvard Law Review article, The Original Understanding of Original Intent. Taken together, these and other articles represent …

Federalism, Welfare Reform And The Minority Poor: Accounting For The Tyranny Of State Majorities, Sheryll D. Cashin Jan 1999

Federalism, Welfare Reform And The Minority Poor: Accounting For The Tyranny Of State Majorities, Sheryll D. Cashin

Georgetown Law Faculty Publications and Other Works

The ideals of federalism contributed significantly to the passage of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996, which repealed the AFDC entitlement program and devolved broad authority to the states to design and administer programs for welfare reform. Professor Cashin challenges the federalist, a priori assumption that states are the natural situs of policy authority concerning the poor. She argues that the Act is likely to yield harmful consequences for the poor-especially the minority poor-because the political economy of state decisionmaking is more hostile to redistributive aims than is that of national decisionmaking.

The Article tests the …

International Economic Sanctions: Improving The Haphazard U.S. Legal Regime, Barry E. Carter Jan 1999

International Economic Sanctions: Improving The Haphazard U.S. Legal Regime, Barry E. Carter

Georgetown Law Faculty Publications and Other Works

The United States has resorted increasingly to economic sanctions as a major tool in its foreign policy. Recent targets include Panama, South Africa, Nicaragua, Libya, the Soviet Union, Poland, and Iran. These sanctions encompass controls on government programs (such as foreign aid), US. exports, imports, private financial transactions, and assistance by international financial institutions.

In this Article, Professor Carter demonstrates that the present US. legal regime governing the use of sanctions for foreign policy reasons is haphazard and in need of reform. Current US. laws provide the President with nearly unfettered authority to cut off government programs and exports, but …

Rawls’ Political Constructivism As A Judicial Heuristic: A Response To Professor Allen, Heidi Li Feldman Jan 1999

Rawls’ Political Constructivism As A Judicial Heuristic: A Response To Professor Allen, Heidi Li Feldman

Georgetown Law Faculty Publications and Other Works

In her Dunwody Lecture, Professor Anita Allen insightfully calls our attention to the social contract tropes that pepper American case law. She claims that these tropes function ideologically, disguising politics, biases, and raw power in judicial decision-making. To examine this claim, I distinguish two versions of social contract theory Professor Allen groups together. Metaphors drawn from classical social contract theory-epitomized by the work of John Locke and Jean-Jacques Rousseau may well function as Professor Allen suspects. Tools taken from twentieth century neo-Kantian social contract theory-inaugurated and developed by John Rawls-could have precisely the opposite effect. Rawlsian social contract theory might …

Between Two Faiths: The Arabization Of The Knights Templar During The Crusades, Paula Regina Stiles Jan 1999

Between Two Faiths: The Arabization Of The Knights Templar During The Crusades, Paula Regina Stiles

Open Access Master's Theses

The military orders , especially the first, the Order of the Poor Knights of the Temple of Solomon (Knights Templar) played a critical role in the preservation of the Crusader kingdoms in Palestine between 1119 and their fall in 1291. It is generally acknowledged that part of the Templars' success, in both Palestine and Spain, stemmed from their ability to deal with the Muslim enemy in a variety of situations. This naturally involved some assimilation of the Templars into the local culture during the 12th and 13th centuries.

This thesis explores the nature of that assimilation (either arabization or islamization), …

Reduction Of Quantum Noise In Transmittance Estimation Using Photonecorrelated Beams, Majeed M. Hayat, Adel Joobeur, Bahaa E.A. Saleh Jan 1999

Reduction Of Quantum Noise In Transmittance Estimation Using Photonecorrelated Beams, Majeed M. Hayat, Adel Joobeur, Bahaa E.A. Saleh

Electrical and Computer Engineering Faculty Research and Publications

The accuracy of optical measurements at low light levels is limited by the quantum noise of the source and by the random nature of the interaction with the measured object. The source noise may be reduced by use of nonclassical photon-number squeezed light. This paper considers the use of two photon-correlated beams (generated, for example, by spontaneous parametric downconversion) to measure the optical transmittance of an object. The photons of each beam obey a random Poisson process, but are synchronized in time. One beam is used to probe the object while the other is used as a reference providing information …

Elucidation Of Hot Melt Wax Coating Systems, Anand S. Achanta Jan 1999

Elucidation Of Hot Melt Wax Coating Systems, Anand S. Achanta

Open Access Master's Theses

Hot melt coating methods are an interesting alternative to commonly used aqueous polymeric film coating methods. A critical evaluation of development of hot melt coating methods for sustained drug release and protection of moisture labile active ingredient applications has been performed. A detailed examination of the interaction of water with excipient films of pharmaceutical significance is reported. As water is an important detrimental variable in performance of pharmaceutical dosage forms, the description of a convenient method to characterize the interaction of water with excipient films is very useful. The widespread use of coated pharmaceutical products for a variety of applications …

The Limits Of Social Choice Theory: A Defense Of The Voting Rights Act, Grant M. Hayden Jan 1999

The Limits Of Social Choice Theory: A Defense Of The Voting Rights Act, Grant M. Hayden

Hofstra Law Faculty Scholarship

This Article presents a defense to the challenge that social choice theory presents to voting rights. Arrows theorem, the crown jewel of social choice theory, holds that no voting procedure that meets some minimal conditions of democratic fairness can ensure transitive, meaningful outcomes. The theorem provides a powerful argument against the ability of any court to devise objective vote dilution standards. Because such standards are now a necessary element of claims under section 2 of the Voting Rights Act, Arrows theorem may be viewed as a fundamental threat to the viability of all such claims. The defense of voting rights …
