Narrative And Client-Centered Representation: What Is A True Believer To Do When His Two Favorite Theories Collide?, John B. Mitchell Jan 1999

Narrative And Client-Centered Representation: What Is A True Believer To Do When His Two Favorite Theories Collide?, John B. Mitchell

Faculty Articles

Professor Mitchell illustrates that Client-centered Representation does not simplistically reduce to a single admonition: Tell the client's story. The concept is far more nuanced than that. It incorporates a constellation of ideas. Listen to the client's story. Hear what they want. Try to be creative about ways to tell the story. Look for opportunities to bring their story into the legal process. At the same time, the attorney must join together to discuss any risks and problems which may result from various strategic choices, including the risks in even telling the story and whether those risks are worth it to …

Imperatives, Normativity, And The Law, Gregory Silverman Jan 1999

Imperatives, Normativity, And The Law, Gregory Silverman

Faculty Articles

In this article Professor Silverman sets out to resolve the problem of legal normativity. Professor Silverman argues that legal scholars have been prevented from transcending the limited conception of law engendered by a key dogma of nineteenth century jurisprudence: the dogma that laws are a species of commands, orders, or imperatives. As a result, even as we enter the twenty-first century, legal scholars have yet to articulate a legal architectonic that properly situates the normative commitments of a society within a post-modern legal system. An adequate theory of law must offer an account of the normativity of law: an account …

Presidential Certifications In U.S. Foreign Policy Legislation, Mark A. Chinen Jan 1999

Presidential Certifications In U.S. Foreign Policy Legislation, Mark A. Chinen

Faculty Articles

This article has two purposes; the first is to assess the value of certification requirements by describing their operation in foreign affairs legislation and by accounting for their use and the controversies that attend them. The second purpose of this article is to suggest ways to minimize the costs of certification requirements. The findings are presented in four sections. The author begins by sketching the features of certification requirements in current legislation. Next, the author discusses the constitutional background out of which these requirements arise. Then, in what forms the greater part of this article, the author describes and evaluates …

Introduction: Critical Race Praxis And Legal Scholarship, Margaret Chon Jan 1999

Introduction: Critical Race Praxis And Legal Scholarship, Margaret Chon

Faculty Articles

In this introduction, Professors Margaret Chon and Keith Aoki situate both Professor Yamamoto's work and the articles that respond to it. They also follow Yamamoto's advice and "perform" critical race praxis as it might relate to legal education and legal scholarship. Thus, the latter part of this introduction takes the form of an epistolary exchange, culled loosely from various e-mail messages between Professors Aoki and Chon. It is intended (in both form and content) to illustrate how conceptual tools that Yamamoto provides can be used to address the intergroup racial justice issues that permeate law schools.

The Distributive Foundation Of Corrective Justice, Hanoch Dagan Jan 1999

The Distributive Foundation Of Corrective Justice, Hanoch Dagan

Michigan Law Review

There are two, apparently conflicting, approaches to private law theorizing. One approach - by now, dare I say, the prevailing approach - analyzes private law through the lens of its social, economic, cultural, or political meanings and ramifications. For the purposes of this Article, we may call the proponents of this approach the "social values school." Other theorists, those who take a corrective justice approach, insist that the adjective "private" is significant and should be the starting point for any understanding of "private law." They claim that this starting point inevitably generates a radically different understanding of private law. Organized …

China's Bid To The Wto— Hidtory Task Needs Joint Efforts, Lei Du Jan 1999

China's Bid To The Wto— Hidtory Task Needs Joint Efforts, Lei Du

LLM Theses and Essays

As one of the three international institutions formed in the aftermath of the Second World War constituted the postwar world economic order, the GATT was an international treaty with its central mission promoting free trade among the contracting parties. During the forty-seven years of its existence (1947-1994), the GATT provided a legal framework within which most international trades were conducted. On January 1, 1995, the WTO was established in accordance with the results of the Uruguay Round of Multilateral Negotiations under the auspices of the GATT. The replacement of the GATT by an institutional body, the WTO, ushered in a …

Population. Environment. And Development: The Changing Paradigm Of The 1990s, Sharmini Abbasi Jan 1999

Population. Environment. And Development: The Changing Paradigm Of The 1990s, Sharmini Abbasi

LLM Theses and Essays

Among the vast web of challenges before us in the wake of the new millennium population growth is one of the most worrying aspects of human existence. The consequences of the world's rapid population growth on human well-being and on the environment have been the subject of intense controversy for many years and got even more accentuated as the 1990s progress. However, the framework of international environmental law and agreement has for long failed to consider adequately the clear linkages between rapid population growth and environmental degradation. Thus, the study attempts to discuss and analyze competing for international perspectives, theories, …

Legal Aspects Of International Transfer Of Technology, Anna Mikhailovna Otkina Jan 1999

Legal Aspects Of International Transfer Of Technology, Anna Mikhailovna Otkina

LLM Theses and Essays

For any international law practitioner issues relating to technology and proprietary information can arise in a number of a different situation. For example, transactions involving foreign distribution and sales rights relating to domestic products are a common part of the day-to-day practice of anyone engaged in the multinational business arena. Many of those transactions involve a contractual agreement in the form of a license, which is intended to transfer to the licensee the technology and related information, and the legal rights therewith, necessary to complete successfully the objective of the transaction: the distribution and sale of the domestic product at …

Trade Liberalization: A Study Of The Agricultural Trade Policies Of The United States And European Community And Its Effect On Developing Countries (Africa), Andrea Osei-Nsafoah

LLM Theses and Essays

The purpose of this thesis is to study the various protectionist policies of the European Union and the United States and to ascertain its effect on developing countries. The focus of the thesis will be from the perspective of the Agreement of the World Trade Organization. In the course of this thesis, I will deduce that protectionism has limited the advancement of trade in agriculture and the fundamental principles of the General Agreement on Tariffs and Trade have often been disregarded. While the thesis proposes free trade it does not propose the abolition of all barriers to trade since this …

Poison And Dead Hand Pills, Markets For Corporate Control, And Implications For An Emerging Market Like China, Shueiqing Zhou Jan 1999

Poison And Dead Hand Pills, Markets For Corporate Control, And Implications For An Emerging Market Like China, Shueiqing Zhou

LLM Theses and Essays

In the past twenty years, the Chinese government has been adopting open door and economic reform policies. Because of historical, economic, legal, and cultural traditions, a modern corporation system is far from being established in China. There are lots of things that need to do to establish a perfect corporate system. This thesis reviews diverse interpretations of the function of poison pills in light of recent judicial decisions and underlying empirical evidence. It also reviews recent judicial decisions regarding the new version of poison and dead hand pill. The author discusses the recent trend of by-law restrictions in an attempt …

International Cooperative Enforcement Agreements And Antitrust Extraterritoriality In The 21st Century, Basil Dominic Udotai Jan 1999

International Cooperative Enforcement Agreements And Antitrust Extraterritoriality In The 21st Century, Basil Dominic Udotai

LLM Theses and Essays

It is the focus of this thesis to critically evaluate the cooperative enforcement option proffered by the US authorities with a view to judging its attractiveness to other nations and its adequacy in solving problems posed by extraterritoriality in today's highly liberalized economy. In this regard, we shall see that the various models of cooperative enforcement arrangements adopted within the United States have failed to result in productive bilateral cooperation. This is due in large part, to the commitment of individual countries to satisfying national interests over cooperative obligations arising under the agreements. Because of these insufficiencies, the thesis reiterates …

The Legal Status Of Teachers: A Comparative Study Between The System In The United States And The System In Belgium., Hildegard Ann Schmidt Jan 1999

The Legal Status Of Teachers: A Comparative Study Between The System In The United States And The System In Belgium., Hildegard Ann Schmidt

LLM Theses and Essays

The legal status of the teacher refers to his life both inside and outside the classroom. The most obvious part of his job is teaching, which consists of the passing of knowledge to his students. Yet before he enters the classroom, there are issues to be resolved. For instance, the nature of the employment contract must be determined. Since job security is a substantial matter, the teacher needs to know whether the employment contract is at will. If it is not an at-will contract, the reasons for dismissal should be clearly established. The teacher also will be concerned about the …

An Emerging Right For Mature Minors To Receive Information, Catherine J. Ross Jan 1999

An Emerging Right For Mature Minors To Receive Information, Catherine J. Ross

GW Law Faculty Publications & Other Works

This article argues that parental objections should not be allowed to block minors from accessing information from government agencies, including schools and libraries. This is particularly important when a mature minor seeks information that is essential to meaningful decisions about the exercise of autonomy rights that are constitutionally protected for teenagers, such as reproductive rights including the right to contraception and abortion. The right to receive information is also implicated where minors seek information to facilitate emerging identity choices that may conflict with those of their parents, such as religion and reliance on medical care. Part I analyzes the nature, …

School-Based Juvenile Boot Camps: Evaluating Specialized Treatment And Rehabilitation (Star), Chad R. Trulson, Ruth Triplett Jan 1999

School-Based Juvenile Boot Camps: Evaluating Specialized Treatment And Rehabilitation (Star), Chad R. Trulson, Ruth Triplett

Sociology & Criminal Justice Faculty Publications

Implemented in Montgomery County, Texas, STAR deviates from traditional boot camps in a variety of ways. The program is closely coupled with school jurisdictions, the juvenile court, and correctional authorities. In addition, the program is non-residential and serves status, misdemeanor, and felony juvenile offenders and mandates parental participation. STAR was initiated to address several goals: enable individuals to remain in school while reducing their disruptive behavior, use school expulsion as a last resort, improve the academic performance of participants, coordinate a joint effort between juvenile authorities and school jurisdictions, instill a sense of pride and discipline in participants, and reduce …

Uniformly Antisymmetric Function With Bounded Range, Krzysztof Ciesielski Jan 1999

Uniformly Antisymmetric Function With Bounded Range, Krzysztof Ciesielski

Faculty & Staff Scholarship

The goal of this note is to construct a uniformly antisymmetric function f : R → R with a bounded countable range. This answers Problem 1(b) of Ciesielski and Larson [6]. (See also the list of problems in Thomson [9] and Problem 2(b) from Ciesielski’s survey [5].) A problem of existence of uniformly antisymmetric function f : R → R with finite range remains open.

Early Childhood Education: The Disadvantaged Child: How Early Is Early?, Eileen O'Neill Jan 1999

Early Childhood Education: The Disadvantaged Child: How Early Is Early?, Eileen O'Neill

Irish Journal of Applied Social Studies

This paper is influenced by many years of work in residential services for children in need. My experience has spanned the changing nature of residential care, from the group home model of the 1970 and 1980's - which provided long term care to children, apart from their family, with little or no family contact, - to the more individualised care offered in units today for children with very specific needs, for short periods of time, usually in conjunction with their own families. This is in keeping with the spirit of the Child Care Act (1991). Children admitted to care are …

Disadvantage Or Disadvantaging: Conceptualising Class Differences In Education As A Disease Or As A Process?, Roland Tormey Jan 1999

Disadvantage Or Disadvantaging: Conceptualising Class Differences In Education As A Disease Or As A Process?, Roland Tormey

Irish Journal of Applied Social Studies

Much of the writing on differences in educational attainment by different social classes in Ireland has started by accepting the use of the tenn 'educational disadvantage' and trying to define it afterwards (Kellaghan et at., 1995; Boldt and Devine, 1998). Others, like Drudy and Lynch have simply dismissed the use of the tenns out of hand, preferring instead to write about social class differences in education (1993, p 52). Far from discouraging the use of the term, this latter sort of intervention seems to have had no effect and the use of the tenn has continued to proliferate in this …

Mental Health, Adolescents And Children: A Comparative Analysis Of The Practice/Policy Interface, John S. G. Wells Jan 1999

Mental Health, Adolescents And Children: A Comparative Analysis Of The Practice/Policy Interface, John S. G. Wells

Irish Journal of Applied Social Studies

Mental health services for children and adolescents in Ireland exist in a state of ambiguity. Services operate within a context of resource constraints and increasing demand. The result is that practitioners have to prioritise the client groups according to policy dictates. In Ireland the policy priority is children at risk of physical and sexual abuse. Utilising current literature in the field, this paper discusses the potential consequences of such a focus for clients, practitioners and policy through a comparative analysis with the United Kingdom. It is argued that a lack of legislative clarity, combined with a focus on abuse has …

The Forgotten Ones: Maternal Abusers And Their Victims: A Pilot Study, Shane A. Dunphy Jan 1999

The Forgotten Ones: Maternal Abusers And Their Victims: A Pilot Study, Shane A. Dunphy

Irish Journal of Applied Social Studies

This paper analyses the phenomenon of mothers who sexually abuse their children, most specifically their sons. It defines the term Maternal Abuse, offers a review of the contemporary academic discourse on female sexual abusers, and presents a quantitative study of maternal abuse in the Republic of Ireland and Northern Ireland, which appears to show that the existing statistics from Health Board and ISPCC reports (SEHB Section 8 Report, 1997; ISPCC National Report, 1997) significantly underestimate it's prevelence. It concludes by suggesting that though Ireland is considerably more aware of the phenomenon of sexual abuse than in the past, but that …

From Family To Care: Issues For The Child, Paul Bailey Jan 1999

From Family To Care: Issues For The Child, Paul Bailey

Irish Journal of Applied Social Studies

It is still widely held that the traditional or conventional nuclear family is the only suitable environment in which children can grow up and that any deviation from this norm puts children at a considerable disadvantage (Kahan, 1989). The vulnerability of children and young people coming into residential care in Ireland due to their dysfunctional family experiences, and how coming into residential care and their subsequent experience therein can sometimes further increase this level of vulnerability for the adolescent child has been well documented. This paper discusses the question: What can we, as residential child care workers and agencies, do …

Social Care And The European Dimension, Damien Courtney Jan 1999

It introduces FESET, a European organisation for those working in social care and related areas and focuses on three programmes on offer - "FESET", "SOCRATES" AND "ECSPRESS". The paper examines current and future developments in social care.

Lagrangian Systems On Hyperbolic Manifolds, Philip Boyland, Christophe Golé Jan 1999

Lagrangian Systems On Hyperbolic Manifolds, Philip Boyland, Christophe Golé

Mathematics Sciences: Faculty Publications

This paper gives two results that show that the dynamics of a time-periodic Lagrangian system on a hyperbolic manifold are at least as complicated as the geodesic flow of a hyperbolic metric. Given a hyperbolic geodesic in the Poincaré ball, Theorem A asserts that there are minimizers of the lift of the Lagrangian system that are a bounded distance away and have a variety of approximate speeds. Theorem B gives the existence of a collection of compact invariant sets of the Euler-Lagrange flow that are semiconjugate to the geodesic flow of a hyperbolic metric. These results can be viewed as …
