Around The Nation, Paula Hannaford-Agor

A number of courts have taken strong steps to deal with issues of lawyer professionalism and competence. Some state appellate courts have declared incivility unacceptable, and some trial courts have closely regulated lawyer conduct in the courtroom. Some state court systems have instituted commissions, standards and programs to improve significantly professionalism, ethics, and excellence in practice. But more judicial leadership and daily involvement is needed in all these areas. It is this goal that the Conference of Chief Justices (CCJ) has addressed in its bold and comprehensive National Action Plan on Lawyer Conduct and Professionalism, unanimously adopted by the CCJ …

Increasing Access To The University Of California: A Case Study Of Senate Constitutional Amendment 7, Jamillah Moore Jan 1999

Increasing Access To The University Of California: A Case Study Of Senate Constitutional Amendment 7, Jamillah Moore

Doctoral Dissertations

The purpose of this case study was to examine alternatives to the admissions process for students seeking enrollment in the University of California. As the University of California was the first public university in the nation to eliminate the consideration of race within their admissions process under SP-1, this study focused on undergraduate admissions solely within this institution. In addition, SP-1 did not ban affirmative action therefore this study did not focus on it. It should be noted that the University of California Board of Regents established SP-1 based upon Governor Wilson's executive order which called for the end of …

Is Nafta Up To Its Green Expectations? Effective Law Enforcement Under The North American Agreement On Environmental Cooperation, Beatriz Bugeda Jan 1999

Is Nafta Up To Its Green Expectations? Effective Law Enforcement Under The North American Agreement On Environmental Cooperation, Beatriz Bugeda

University of Richmond Law Review

On January 1, 1994, the North American Free Trade Agreement (NAFTA) between the governments of Mexico, Canada and the United States went into effect. Together with this trade agreement, the governments of the three countries entered into a side agreement on the environment: the North American Agreement on Environmental Cooperation (NAAEC). This agreement, also known as the Environmental Side Agreement, responded to some of the concerns of NAFTA critics. Some environmentalists believed NAFTA would promote environmentally insensitive and uncontrolled growth, and others thought the liberalization of trade would be used as a means to preempt stringent domestic environmental regulations.

The Leak And The Craft: A Hard Line Proposal To Stop Unaccountable Disclosures Of Law Enforcement Information, John Q. Barrett Jan 1999

The Leak And The Craft: A Hard Line Proposal To Stop Unaccountable Disclosures Of Law Enforcement Information, John Q. Barrett

Faculty Publications

The critics of Kenneth W. Starr accused him, in the five-plus years that he served as the multi-tasked Independent Counsel, of many failings, mistakes, and improprieties. One of the most prevalent charges was one that has significance to lawyers and resonates with the general public's sense of bad behavior by prosecutors: the allegation that Starr and/or members of his staff "leaked" information. This general accusation was, of course, imprecise. It also might have been overbroad. Prosecutorial "leaks" include such plain illegalities as disclosing grand jury information to the media or other unauthorized persons, and also the much less regulated practice …

Educational And Occupational Aspirations Of Rural High School Seniors In The Private And Public Schools In Northwest Iowa, Duane Bajema Jan 1999

Educational And Occupational Aspirations Of Rural High School Seniors In The Private And Public Schools In Northwest Iowa, Duane Bajema

Faculty Work Comprehensive List

Research has suggested that rural youth have lower educational and occupational aspirations than their nonrural counterparts, and they may experience barriers to educational and occupational attainment. Discrepancies and barriers that may exist have implications for educational policy and educational planning.

Seventeen rural high schools in northwest Iowa were examined; thirteen public and four private schools. Rural high school students were studied to examine their perceptions concerning potential educational and occupational barriers. Student characteristics and qualities were examined based on where the student lived and the type of school they attended. Students who had been involved in the agricultural curricula in …

Independent Counsel Law Improvements For The Next Five Years, John Q. Barrett Jan 1999

Independent Counsel Law Improvements For The Next Five Years, John Q. Barrett

Faculty Publications

This Article is adapted from remarks made in New Orleans on January 8, 1999, as part of an Association of American Law Schools (AALS) Administrative Law Section panel discussion entitled, "Separation of Powers Revisited: Should the Independent Counsel Law Be Renewed?" Our topic is "Should the Independent Counsel Law Be Renewed?" and my answer is, "Not exactly." I will not be, in other words, defending the status quo. Indeed, the empty chair you see here on the dais nicely contains the only "defender" of the status quo of whom I know. What I would like to do is remind us …

How Children In Cults May Use Emancipation Laws To Free Themselves, Robin A. Boyle Jan 1999

How Children In Cults May Use Emancipation Laws To Free Themselves, Robin A. Boyle

Faculty Publications

The author examines how children who are born into cults or brought into them at a young age can use state emancipation laws to gain independence when they are in their mid-teens, so long as they can demonstrate criteria that their states have established. Commonly, states require a showing that the minor has achieved some level of economic self-sufficiency and can live emotionally and physically independently from his or her parents. There are some difficulties for cultic children in demonstrating these criteria, but the obstacles are not insurmountable.

Sovereignty, Compliance, And The World Trade Organization: Lessons From The History Of Supreme Court Review, Mark L. Movsesian Jan 1999

Sovereignty, Compliance, And The World Trade Organization: Lessons From The History Of Supreme Court Review, Mark L. Movsesian

Faculty Publications

One of the World Trade Organization’s (WTO's) more remarkable and controversial innovations is its mechanism for resolving trade disputes among member states. Traditionally, states have resolved such disputes in "pragmatic" fashion, through negotiation and compromise informed by the relative power of the parties involved. But no longer: the WTO's Understanding on Rules and Procedures Governing the Settlement of Disputes (the DSU) provides that disputes between member states are to be resolved in adversary proceedings before impartial panels of experts." Under the DSU, panels have authority to decide whether members' laws violate international trade norms; panel decisions are essentially binding, though …

Policy Research In Higher Education: Data, Decisions, Dilemmas, And Disconnect, Edward R. Hines Jan 1999

Policy Research In Higher Education: Data, Decisions, Dilemmas, And Disconnect, Edward R. Hines

Mid-Western Educational Researcher

This address dichotomized academic research and policymaking as two separate, distinct, and often conflicting worlds or cultures. Higher education as a field of study was used as a case example illustrating academic research, and state legislative politics illustrated the world of policymaking. Suggestions were made for finding ways of communicating between the two cultures, and specific recommendations were included.

Academic Careers In The Twenty First Century: New Options For Faculty, Judith M. Gappa Jan 1999

Academic Careers In The Twenty First Century: New Options For Faculty, Judith M. Gappa

Mid-Western Educational Researcher

The faculty career is changing in response to external and internal pressures. Public calls for productivity and accountability, student demands for access and high quality education, faculty workloads, tenure criteria and processes, and the desire for balance in personal and professional lives are all contributing to change. Today less than 50% of all faculty members occupy tenure-track positions; 26% of full-time faculty occupy nontenurable positions. This paper examines these and other pressures for institutional change, describes current faculty demographics, and explores possible institutional responses including modifications to traditional tenure systems and faculty career alternatives outside tenure.

The Value Of Multimethod Qualitative/Quantitative Research Methodology In An Educational Program Evaluation: A Case Study, Catharine C. Knight, Walter J. Kuleck Jan 1999

The Value Of Multimethod Qualitative/Quantitative Research Methodology In An Educational Program Evaluation: A Case Study, Catharine C. Knight, Walter J. Kuleck

Mid-Western Educational Researcher

This paper presents the case of an evaluation of a literacy-based public school classroom intervention that had been implemented without initial regard for subsequent evaluation, to examine the value of a multimethod qualitative and quantitative approach. We show how this evaluation challenge was ad-dressed using both techniques, and how they complement each other to create richer understandings. Given the small number of participants in and the brevity of the intervention, the finding of quantitative results that support the very positive qualitative results is encouraging. Thus, the multimethod qualitative/ quantitative approach appears to have been a useful and informative one in …

Time Spent On Higher-Order Tasks In Two Teacher-Apprentice Options, Elizabeth A. Wilkins-Canter, Audrey T. Edwards Jan 1999

Time Spent On Higher-Order Tasks In Two Teacher-Apprentice Options, Elizabeth A. Wilkins-Canter, Audrey T. Edwards

Mid-Western Educational Researcher

This study investigates the process of assisting a teacher prior to student teaching. Teacher candidates in two certification programs kept a log documenting the tasks they did during their on-site experiences and the time spent on eight types of tasks. A one-way analysis for repeated measures showed that, in both programs, candidates spent a majority of their time on clerical tasks, despite the value they saw in interpersonal contact. A t test for independent measures revealed no significant difference between constant and varied placements in time spent on teaching a whole class and on other highly valued tasks.
